Technically, he was supposed to be given the position but since this is a politically sensitive issue, it is debatable. Besides, setting a precedence in that manner, would be considered somewhat unethical since its like benefitting from the suspicious death of your opponent. Who Will INEC Declare The Winner In Any Event Where The Supplementary Election Favors The APC? Will They Declare APC Winner Or A Candidate (Of A Party)? If They Declare A Candidate From APC, Who'll Will The Candidate Be And On What Laws Will They Premise The Person's Nomination As Candidate Of The APC At This Material Time? It's A Big Twist And Will Take More Than Wishful Thinking. Wada or wadada you re just wasting ur time. The artorney general opinion still remains the best cos it serves the course for natural justice. You cannot reap were you don't sow. On the ballot paper what do you see their? The answer is names of parties not candidates. Therefore any vote scored by the candidate is automatically for the party. Except pdp is now telling us that the death of audu implies the death of APC. 1 Like |

Desperate move! Wada wants to seize the opportunity of the demise of his major opponent to be declared winner. He has forgotten that to be declared winner, he needs to get at least one-third of the total votes in at least two-thirds of the local govt. areas in the state which he fell short of. Besides if it was himself that died there will be no supplementary election because the difference in votes between the first and third candidate is far higher than 49000 votes. Wada should be ready for a re-run as only party symbols are on ballot papers not photographs of candidates. |

adekolaelect: in bold, fine so what happens when the candidate after winning the election in the said party, assumes office and while in service decamps to another party, does the initial party demand that he/she quits the position? We have seen governors, senators etc leaving their initial parties to new party while in service yet the court has being silent even when their initial parties approach the courts to return the mandate to the initial parties. I think the matter is complex. What the electoral umpire must do is to ensure they pick any option that is nearest in meaning to what is in the constitution. Bc at the end of the day the constitution is the supreme set of laws everybody or org. must obey. |

PRYCE:Wada is a desperate mofo that is being deceived. I supported him but I can't be a party to fraud. Hon Abiodun James Faleke is the legitimate winner of the election by virtue of being APC candidate(by law). Wada can never be Governor beyond 2012. If the candididate the masses voted died, are u going to pervert justice and divert the masses prefered mandate to another person at will? If Inec says it is conducting suplementary elections, that means the votes casted for the late Audu still stands for anybody from APC to take over. On common sense, my dear, judge it urself. Did the masses vote the replacement for Audu or Audu himself? In my opinion. I think what should be done right is, since there is no provisions by the law to cover such senario. Let the elections be cancelled and reconducted afresh. Or still concider the plea of Idris Wada. |
