A Federal High Court sitting in Lagos on Tuesday stopped the prosecution of the indicted registered trustees and structural engineers of the Synagogue Church of All Nation (SCOAN) over the collapse of a six storey building within the church premises, pending the determination of their appeal.

Justice Ibrahim Buba who gave the order had on November 9, 2015 dismissed the suit filed by the engineers, Oladele Ogundeji and Aknibela Fatiregun.

But dissatisfied with the ruling, the two engineers approached the Appeal Court to upturn the decision of the lower court.
The engineers also filed another application for stay of execution to halt their prosecution pending the determination of their appeal filed against Justice Buba's ruling.

The prayers the engineers asked for in their application include: an order of injunction restraining the Commissioner of Police, by himself, through agents or otherwise from arresting or detaining them for any reason whatsoever in connection with the verdict of Magistrate Oyetade Komolafe dated July 8, 2015 pending the determination of the applicants’ appeal against Justice Buba’s ruling; an order of injunction restraining the state Attorney General, either by himself, officer and/or agents acting on his behalf from prosecuting or proceeding with their prosecution, pending the determination of the applicants’ appeal against Justice Buba's ruling.

But the state Attorney General, Adeniyi Kazeem challenged the application in a counter affidavit deposed to by Akinjide Bakare. He argued that the fresh application was not deposed to by the indicted engineers.

He also argued that the applicants did not have a valid appeal before the Court of Appeal, saying that granting the application would stop the Attorney General from performing his function as stated by the Constitution.

But Justice Buba granted an order of injunction restraining the Commissioner of Police from arresting and detaining the applicants.
