His elevation to the Presidency was to expose him as a fraud and hypocrite.

That piece of criminal code existed in the 1979 criminal code

The fact remains that Buhari committed a treasonable act by overthrowing a democratically elected civilian govt

Do you understand English at all? Do you understand what is meant by "anybody who forms an intention . . ." especially the function of 'attempt'? You can only prosecute a coupist if the coup failed, not when it succeeded. The coup of 31 December 1983 was successful.

Just as you can't prosecute a person who carried out a successful coup, so you can't prosecute a person who committed suicide. You can only prosecute a failed coupist just like you can only charge a person who made an attempt on his own life, with attempted suicide.

There is no charge for suicide, but attempted suicide.

Barrister Ojo, so you telling me that an armed robbery suspects can go free but those who get caught attempting are to be prosecuted?

There are cases of military coup juntas that were desposed almost immediately after taking over (Mali, Burkina Faso) and those officers are rotting in jail now.

You've no point. The case of Mali and Burkina Faso is different. Though the coupists succeeded, they succumbed to international pressure, but not until they're assured of not being prosecuted.

You are dead wrong.

You don't prosecute someone who committed suicide because he or she is no longer around to face the consequences.

What about someone that kills one million people before committing suicide? Such a person is not tried also because he is not around to face the consequences.

An ATTEMPT can be successful or unsuccessful. The keyword being ATTEMPT. Buhari attempted a coup and he must be tried for treason, and if found guilty, must be killed as the 1979 constitution stipulates.
He must not enjoy the proceeds of his crime which he is currently doing, by taking advantage of the name-recognition of his 1983 treason gave him, by ruling over this nation and still carrying on with his disregard for the constitution by illegally detaining those who competent courts set free

You guys are gradually running out of ideas, going back in time is a nice try though. why not try another stunt like; felony act by IBB against Buhari administration. I laugh at wailers, your bests are always watery. This govt has come to stay. Coup is a means to power as election in any democratic settings. The military would invoke the instrument of expediency if at any time the national security and economy is under threat. The same applies in a state of emergency under democracy. A successful coupist is rarely charged because the nation is addressed to such effect under the logic of "security from threats to national intergrity.

Hope you won't say you're hated if this is extended to Emmanuel Nwobosi, Ben Gbulie and others that took part in the January 15 1966 coup that are still living?

Of course, it must extend to anyone that has ever taken part in a coup and never detained or tried for the coup.

That is the only way we can permanently get rid of coups in Nigeria. If we only go after those that attempted unsuccessful coups, then the incentive is still there for people to carry out succeseful coups.

However, just like Buhari is only willing to investigate GEJ's term, I am very willing to concentrate on Buhari's coup and he must be tried, and if found guilty, must be killed by hanging or firing squad, and acid used to dissolve his earthly remains, just as they did to Ken Wiwa.

But that is the way to deal with criminals. They must face the full weight of the law, as a deterrent to other would-be knuckleheads.

Mumu-hammadu must be executed for treason i.e if found guilty of high treason, like a common criminal that he truly is
