Anger Grows In Judiciary Against Buhari, Chief Judge Bars Remand Orders To EFCC

The Whistler.

There is growing anger in the judiciary against President Muhammadu Buhari over his continued flouting of court orders and ‘treating the third arm of government as an appendage of the executive arm’ The Whistler has learnt.

A judiciary source told our correspondent that judges are getting embarrassed daily by the abuse of the rule of law by government agencies like the Economic and Financial Crimes Commission (EFCC), Department of State Security (DSS) all allegedly acting on the orders of the president to continue to detain accused persons granted bail or not arraigning others within the 48hours legal window.

The Whistler further learnt that the dissatisfaction with the executive was what informed the Chief Judge of the Federal Capital Territory (FCT), Justice Ishaq Bello, to order magistrates in the FCT to desist forthwith from granting remand orders to the EFCC.
The EFCC had always relied on FCT Magistrates’ Courts for remand warrants to justify its continued detention of suspects being investigated for corruption and other economic crimes.

The commission said last week it had obtained a detention warrant from a Magistrates’ Court in the FCT to enable it keep the National Publicity Secretary of the Peoples Democratic Party (PDP), Olisa Metuh, in its custody pending the conclusion of its investigation.

Justice Bello at a visit to the Keffi Medium prison in Keffi, Nasarawa State, on Tuesday, read the riot act to magistrates in the FCT who this medium gathered are corralled by the anti-graft agency to issue warrants they have no authority to order.

In December 2015, Justice Ahmed Mohammed of the Federal High Court excused himself from hearing the treason case against Radio Biafra Director, Nnamdi Kanu, after the accused objected to the trial due to the Federal Government’s repeated disobedience of court orders relating to the case.

“If any of the parties has no confidence in the court, he has the right to say so. Assuming it was the prosecution, if they had no confidence in the court of jurisdiction; would they not have done so?

“I hereby remit the case file to the honourable Chief Judge of this court to reassign it,” Justice Mohammed said.

So far, ex NSA, Sambo Dasuki has been granted bail twice but was still being held by the DSS on the orders of Buhari.

calm down everyone
so soon, the EFCC and DSS wont be getting remand orders from courts? this sounds interesting o because they wont be able to detain even CRIMINALS for more than 48 hours.
now, they will see that the court got dignity afterall
but wait o, since bubu is now a judge, who needs the courts?
ha ha and finally, the world will understand why NNAMDI KANU called him a terrorist and rightly so
then the will get angry against buhari
and it will happen just like NK predicted it
i see IPOB grand plan still playing out here but in another way..................... plan B if you ask me

This story makes absolutely no sense and is all over the place. Why would the Chief Judge instruct the Magistrates not to issue warrants/remand orders? Also how are "judges getting embarrassed daily" if the only two cases giving corrupt people heart attacks are those of Messrs Dasuki and Metuh ( and maybe Mr. Kanu), Who else has been arrested "everyday" so we can lend some credibility to this story?

This article is crap and seems to me like it's attention seeking with hopes of making a payday from the allegedly corrupt individuals in custody.

Not surprised s the article is making no sense to you. Why wouldn't the chief judge instruct the magistrates not to issue warrants /remands orders when Buhari himself has shown lack of respect to the court orders then why rely on same courts to get remand orders you keep detaining s suspect??

Op ur news is fake. Below is chief Justice position according to vanguard. A pro PDP newspaper

A top source in the judiciary told Vanguard, last night, that contrary to claims in certain quarters that the CJN was furious with Buhari for allowing EFCC to ignore court orders freeing the Dasukigate suspects, Mohammed had nothing to do with the issue.

The top official noted that though there were concerns among judges that some of their orders had not been carried out to the letter by some government agencies, there was also fury in the judiciary that many judges had aided and abetted top government officials to loot the treasury with impunity through frivolous orders and injunctions which were against the interest of the country and its people.

The senior official close to the CJN said: “I don’t think that the CJN has issued any statement on any court order relating to the investigation of the arms cash, individuals or groups since he believes that the courts are well able to discharge their duties as enshrined in the laws of Nigeria.

“Again, the thinking in the judiciary seems to be that some judges misused their offices to encourage some corrupt key government functionaries to slip away to foreign land with huge public funds under the guise of seeking avant-garde medicare.

“If the question may be asked, was it the CJN that ordered those judges to work against the interest of Nigeria by granting frivolous orders that enabled corrupt Nigerian public officers to make away with public funds?

“Let it be known that the CJN does not and will never encourage any form of misdeed having taken the oath of office to remain incorruptible, just and firm in the discharge of his duties to Nigeria and its people.

“I can tell you that the CJN is aware of the frivolous orders being issued by some judges and he cannot, therefore, sympathise with people who threw their integrity to the winds when they should have done the right thing at the right time.”

Yesterday, the media was awash with claims that the CJN had fallen out with Buhari over his refusal to obey court orders granting bail to some suspects implicated in the sharing of $2.1 billion meant for arms procurement.

In particular, the commentators said that the CJN was upset that the President had not released the former NSA, Col. Sambo Dasuki (retd), and the leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, from detention after being granted bail by courts.

How can it be fake when it was awash in the media? It could be a matter of action and reaction. Whether the CjN is annoyed is one side of the story, another side of the story that interests Nigerians is the impunity and disrespect to the law of the lands as exhibited by the executive. Good governance and economic driven government is what Nigerians want not propaganda and vendetta driven government.
