Nigeria's Apex Court, the Supreme Court, will on Wednesday the 3rd day of February, 2016, hear Appeal No. SC/18/2016 & SC/19/2016 between Dr. Okezie Victor Ikpeazu & PDP respectively as Appellant's and against Alex Otti, APGA as respondents as well as the Cross Appeal filed by Alex Otti/APGA against part of the decision of the Court of Appeal, Owerri. It will be recalled that the Court of Appeal had reversed the decision of the Election Petition Tribunal which had earlier affirmed the election of Dr. Ikpeazu. The Court of Appeal annulled Governor Ikpeazu's election on the spurious & perverse grounds that there was over-voting in the three Ngwa LGAs where Ikpeazu hails from (Obingwa, Osisioma Ngwa & Isiala Ngwa North). The CA deducted all the votes massively cast for Dr. Ikpeazu by his kinsmen and pronounced Alex Otti winner of the election based on the results in the remaining 14 LGAs of Abia State. In coming to the unfounded conclusion that there was over-voting in those three LGAs, the Court of Appeal looked only at the figures of accreditation captured by the Card Reader machine while ignoring those captured manually by the ticking of the Voters' Register in respect of voters whose PVC details matched those in the Voters' Register but whose PVCs or finger prints could not be read by the Card Reader Machine. Thus the total number of votes recorded in the three LGAs was naturally higher than Card Reader Accreditation figures because the total votes was for both Card Reader accreditation and Voters' Register accreditation. In fact this was the case in ALL 17 LGAs of the State including Alex Otti's Arochukwu LGA & no one has explained why only the three said LGAs were singled out. The Court of Appeal therefore chose, in the case of these three LGAs, to rely on Card Reader accreditation which the Supreme Court has confirmed in the Zamfara Governorship and other cases, as not recognized by the Electoral Act while ignoring Voters' Register accreditation which is recognized by Section 49 of the Electoral Act as the legal mode of accreditation. More curiously, the Court of Appeal committed Constitutional "Hara Kiri" by declaring Otti winner of the election based only on the results of 14 out of the 17 LGAs of Abia State. When the result of one LGA was cancelled in Kogi, no results were declared until a supplementary election was conducted in that one LGA; the same in Bayelsa State, Akwa Ibom State and in every other State where elections have been faulted in one or more LGAs. This is because of the clear provisions of Section 179(2) of the 1999 Constitution by which a candidate cannot be declared winner of an election unless, apart from scoring majority of the lawful votes cast, he also scored at least one-quarter of the votes cast in at least two-thirds of ALL the LGAs in that State. For Abia therefore, as has been the case for all other States, the results for its 17 LGAs must be in the calculation and not just 14 LGAs. It will be an interesting date at the Supreme Court on Wednesday

Ikpeazu's mandate will be affirmed... Supreme court already settled the card reader imbroglio with the Rivers ruling...

I know so many hearts that rejoiced at the Wike ruling will be beyond shattered that day though, but the law is an as$....
