You lack knowledge and comprehension. Did you read the report where some sections of the rules were replaced without due process? Saraki and Ekweremadu might be free from the forgery allegation but not conspiracy

The 2011 senate rule mentioned in that report died with the 7th senate!!! You cannot be claiming the 2015 senate rule was forged and yet keep making reference to the 2011 senate rule.This case is very weak and that was why the FG hesitated taking it to court.

The 2015 senate rule used in the election of the SP and DSP is a new document distinct from the obsolete 2011 senate rule.

There is no forgery here.If they were contesting the validity of the new rule,it would have made more sense.A baby lawyer would win this case for Saraki and Ekweremadu let alone the Experienced SANs that they would deploy

Lolz this case is a very funny one!! You are saying the 2015 senate rule was forged yet you keep linking it to the 2011 senate rule!! I would see how the FG will win this case even with a biased judge.

If you say the current 2015 senate rule was forged then you must produce the original 2015 senate rule shikena.It is not by lining up witnesses.The CCT case comes to mind.After all the initial gragra is the case not already collapsing?

You should follow the procedure by amending the 2011 in order to get the 2015

a forged copy is gotten from an original... since there is no original 2015 Senate standing rule, Saraki's own stands...especially since each senate rule dies with that administration.

The original 2011 is suppose to produce the 2015 after amendment if any.

I hope you have been seeing "as amended" attached to the year. 2011 was supposed to be amended to get 2015, the due process for amendment was not followed. I am not a lawyer, so any baby lawyer can win this case for FG

this is pure executive rascality, our dear senate president saraki has no hand in this forgery case, that its an order from the leadership of 7th senate as been practice since 2003, 2007, 2011, and 2015 according to the Deputy Clark of the senate MR. Ben Efeturi. so tell me how will the 8th senate get in touch with what is yet to be given to them. this is just equivalent to waec student coming into exam hall with the exam question paper before being serve by the invigilator. pls the 8th senate knows nothing about this and should be leave alone. angry angry

Each senate rule is unique and dies with that senate.Since the inception of the fourth republic,we have had the 1999,2003,2007,2011 and 2015 senate rules all unique and differant.

You cannot try forcing an obsolete 2011 senate rule on the 2015 senate.If the senate bureaucracy has prepared a 2015 senate rule,you must work with it andnot coming to claim it was forged.

The only way you can prove forgery is by tendering the original.The stupid witnesses are expected to tell the court that there was no amendment to the 2011 senate rule forgetting that senate rule is now obsolete and cannolonger be used for the 2015 senate.

So unless the prosecution can produce the original unforged 2015 senate rule,this case is dead on arrival.

Well, a new senate uses the amended version of the last senate rules for inauguration, after which they can do their own amendment. In this case, this 8th senate would have used 2011 senate rules as amended for inauguration. After that, they could have then gone through the normal process of amendment to produce their own 2015 senate rules. It means that the last senate rules of the last assembly should be the exact document that will be used to inaugurate the next senate.

Section 110 of the Senate Standing Order 2011 provides that “(i) any senator desiring to amend any part of the rules or adding any new clause shall give a notice of such amendments in writing to the president of the Senate, giving details of proposed amendment; (ii) the president shall, within seven working days, cause the amendment to be printed and circulated to the members. Thereafter it shall be printed in the Order Paper; (iii) the mover or movers of the amendments shall be allowed to explain in details, the proposed amendments; thereafter the Senate shall decide by simple majority votes whether the amendment should be considered; (iv) if the decision is to consider the amendments, then another date shall be set aside by the rules and Business Committee, whereby an opportunity would be given to senators to further propose amendments, but must strictly be confined to the original amendments; (v) two third majorities shall decide the amendments, and such amendments shall form part of the Rules of the Senate.”

However, speaking to Daily Trust on Sunday via telephone, the leader of the 7th Senate, Senator Victor Ndoma-Egba, a Senior Advocate of Nigeria (SAN), said that at no time did the 7th Senate amend the Standing Orders 2011. He said, “The Committee on Rules and Business proposed amendment, but it was not debated.” He, however, declined further comment as the matter is already a subject of litigation.

Checks by Daily Trust on Sunday showed that the Senate Standing Orders was last amended on May 18, 2011 to provide, among others, Section 3(2) that introduced ranking to the process of electing presiding officers and other appointments in the chamber. The amendment was sequel to a motion for the amendment to the Senate Standing Orders 2007, sponsored by then Senate Majority Leader, Teslim Folarin. It followed all the procedures of amendment laid down in Section 110 of the standing rules.

All that needs to be done to rest this case is to check the amendment history as from 1999. If 'procedure', from the findings, was not followed in most of the amendments, then it means convention and practice can replace procedure. Besides, i understand a section of the existing standing order restricts the affairs of the senate to the senate - this by implication includes fights on the floor, forgeries, accusations,etc.
On this strenght, If the senate leadership is accused of forgery, all the senators need to do is impeach him and end the matter. I see the matter as an intrusion by the executive into the affairs of the senate, which is unfair.

This is what may determine the outcome of the trial: look at the amendment history of the senate standing order as from 1999 to 2011 to determine whether procedure or convention and practice was followed, i beleive precedence is considered seriously in court cases.
Further, i understand a certain section of the existing standing order provides that ALL the affairs of the senate to be handled within the senate - by implication this covers fights on the floor, false accusations, forgeries, etc. If the senate beleives its leadership is guilty of forgery, all it needs to do is impeach its presiding officers. For the presidency and juduciary to take it up amounts to an intrusion in the affairs of the senate. My oppinion.
