Can we all pause for a minute and ask ourselves some questions? Is this fight against judges a fight for the masses? It is not all about rising in our voices in appraisal to the executive for extending the fight against corruption to the judiciary. The question is, is the fight for the masses? Buhari is fighting judges because outcome of election tribunals didnt favour APC/APC candidates. How many poor men in the street have been denied justice and no one ever confront the judges for upturning judgment? This is just a political fight/tussle between the executive and the judiciary... the elites.

They just want to silent this arm of the government but
There is nothing that is unconstitutional about the raid of the residences of the judges by the operatives of DSS. This raid should have happened about five years ago.

The corruption in the judiciary has got to a condemnable level. We lawyers know that something like this was bound to happen. It is happening rather too late. No law says a criminal cannot be dealt with. The NJC cannot even say that the DSS should not make arrests in the midnight. It is only when one has committed an offence or suspected to have committed an offence that such a person can be arrested. You can even be arrested on a Xmas day or New Year day.

A lot of terrible things are happening in this country. One would have expected the NBA to have intervened and cried foul. When a judge was attacked in Ekiti some years ago, what did the NBA do? What could be more humiliating than a governor going to a courtroom to attack a judge? The same governor is the one leading those who are condemning the DSS. This is the same governor that beat up a judge. Then the NBA was silent. Why are they talking now?

How can anybody defend a judge that money was found in his residence? Nobody keeps money at home. The monetary evidence is suggestive. The DSS simply acted on the petition received. The DSS acted based on the evidence. It was as a result of complaints. I don't think those condemning the DSS got it right.

The DSS only went ahead to procure evidence. If they have told the judges they are coming, the judges would have cleared their houses and kept the evidence. Imagine a judge going to the supermarket to take money. Sometime ago, one of the judges collected N200m, the NJC only told him to pay it back in instalments. Is that not a pact? If you have been found to have collected a bribe, is the punishment to merely pay it back in instalments? It is very wrong.

Whoever is found to be a corrupt Judge, let him be arrested and prosecuted, simple. Even if it's vendetta, so far the judge is corrupt, let him dance the dance of the spirits. What some people don't know is the fact that the judiciary is more corrupt than the twenty naira police man we see on Nigerian roads daily

odiks:
Two more judges were yesterday arrested by the Department of State Services (DSS), taking the number of judges so far picked up to nine.

Justices Bashir Sukola and Ladan Manir of the Kaduna State High Court, were arrested in Kaduna and taken to the DSS Headquarters in Abuja at about 8.30pm.

A top source said they were immediately taken in for interrogation.

Six other judges are under probe.

The DSS, it was learnt yesterday, has frozen the accounts of some of the judges under investigation.

In some of the accounts are “huge lodgments”, a source said yesterday.

The agency has received more petitions against the judges. Many of the petitioners, it was learnt, are willing to testify against them.

There were strong indications last night that the judges might be arraigned in court next week because the DSS has set a deadline in order not to extend the investigation of the judges beyond this week.

All of them are to face trial, the source said.
Under probe are two Supreme Court Justices – Sylvester Ngwuta and Inyang Okoro – the suspended Presiding Justice of the Court of Appeal, Ilorin Division, Justice Mohammed Ladan Tsamiya, who was picked up in Sokoto; Justice Adeniyi Ademola (Federal High Court); the Chief Judge of Enugu State, Justice I. A. Umezulike; Justice Kabiru Auta of Kano State High Court; and Justice Muazu Pindiga (Gombe State High Court).

The source, who spoke in confidence because he is not allowed to talk to the media about the investigation, said: “Some accounts have been frozen through orders of the court. This affects some of the judges. Not all of them.

“We found some huge lodgements that are questionable in some accounts and in addition to that we also observed the inflow of their salaries over a long period without them making any withdrawal at all.

“What that means is that they don’t live on their salaries at all. Those accounts have been frozen but as I said not all of the judges are affected.”

On why the judges were yet to be charged to court, the source added: “We are waiting for the action of the NJC. We expect the NJC to suspend them, otherwise it’s like taking a sitting judge to court.

“In the Service, when anybody is being investigated for any serious crime, the first thing we do is to place such a person on suspension.

“After the investigation, such a person would face trial and get dismissed from service on conviction and later face prosecution in the law court.”

Asked what will happen if they are not suspended, the source quipped: “The NJC does not have the luxury not to suspend them.

“We wrote the NJC on Monday but we haven’t received any response.”

There has been a rumour of a hot exchange of words between the Chief Justice of Nigeria, Justice Mahmud Mohammed and the Director-General of the DSS, Mr. Lawan Daura on Monday during a session with the President. “There was no such meeting,” the source said.

The secret service is said to have discovered that a governor, who is sympathetic to the judges, was behind the online publications against the DG of DSS.

The source said: “There is no truth in that at all. There was never such a meeting. The President does not even have such luxury of time.

“Maybe what they are referring to was the visit of the Chief Justice to the DSS headquarters on Sunday afternoon.

“The CJN paid a solidarity visit to the detained judges and expressed some concern. He probably saw the DG too when he learnt that he was in his office at the time of his visit.

“The CJN did not even know that they would be released on bail later that Sunday evening.

“We know it is the handwork of a governor to launch vitriolic media attacks on the DSS. We also know those being used. But Nigeria is greater than all.”

The source gave insights into more petitions being received against the judges by those described as “victims” of bribe.

He expressed confidence that the trial of the judges might begin next week because the DSS has set a timeline to conclude the investigation on or before the end of the week.

The source said: “We are almost through with investigation. The ongoing investigation is not supposed to go beyond this week.

“We have written the NJC about what has happened and we expect the NJC to take some decisions about the affected judges this week. Once that is done, hopefully by next week or thereabouts, we should arraign them in court.

“For now more facts in the form of petitions are coming in about the judges. It’s like everyone who has had cause to go to court for one reason or the other has been a victim.

“Some victims have even indicated their readiness to testify in court.”

The source added that contrary to insinuations, steps were taken to accord the seven judges arrested at the weekend the desired respect before their arrest and while they were in custody.

The sourced added: “Justice Ademola Adeniyi requested that his lawyer should be present before his residence could be searched.

“The counsel came, examined the search warrant and confirmed the validity of the warrant. He thereafter asked the judge to cooperate with the DSS team.

“Some of the judges also allowed their lawyers to witness the search of their homes.”

The Chief Justice of Nigeria, Justice Mahmud Mohammed met with president Muhammadu Buhari at the presidential villa on Sunday night by 11pm, a Source has told LeadersNG.

It was revealed that the main reason why the CJN met with the president was the arrest of two Justices of the Supreme Court by operatives of the Department of State Services (DSS) over allegations of corruption.

We were told that a furious Justice Mohammed wanted to know why the president sanctioned the abduction of two justices of the Supreme Court in the middle of the night from their homes. It was also learnt that the CJN confronted the president about the motive of the arrest since he had earlier reported to the president about an attempt to bribe the two arrested Justices by one of his ministers, Rotimi Amaechi sometimes in January, 2016.

According to the source, sometime in January, 2016, the Minister of Aviation, Rotimi Amaechi in the company of a serving Director of the DSS had approached the two arrested Justices of the Supreme Court – Justices Sylvester Ngwuta and John Okoro at the home of Justice Ngwuta at the Judges’ Quarters in Abuja to help compromise the Election Tribunal Judgement before his Lordships. They brought the sum of $2million dollars to achieve this. After speaking with both Justices for over an hour on the matter, they called the de-factor president and childhood friend of the president, Alhaji Mamman Daura on the phone who pleaded with the Justices to help as Mr. Amaechi was representing the president on the matter.

It was also revealed that after going back and forth on the matter, the Justices refused to collect the money and later reported the matter to the CJN. The source further stated that the Chief Justice of the Federation that same week reported the matter to the president. Although we learned that president Buhari denied ever instructing Mr. Amaechi to approach any of the Justices and assured the CJN of an investigation into the matter, no investigation was ever carried out to the knowledge of the CJN.

The CJN was heard to have told the president in a very frank manner that all Justices of the Supreme Court know why Justices Sylvester Ngwuta and John Okoro were arrested and that they believe the president wants to undermine the judiciary.

The source also added that president Buhari was on the defensive throughout the meeting claiming he was not properly briefed by the DSS and that he didn’t know the identities of the Justices involved. The president promised the CJN that the Justices will be released by the DSS.

The National Judicial Council is currently meeting now on the matter.

You will recall that on Saturday, the DSS in what it called a “sting operation” in five states across the country, arrested seven judges, including two Justices of the Supreme Court, and five judges of the Federal High Court.

If they have other sources of income, its left to them to come out clear on this...you taking medicine upon another man's headache...do you think you can defend a judge more than he can defend himself its very funny non of those judges has denied any of the accusations, its we the hungry looking zombies that are acting their advocate...there is no way you will earn a honest income from a legitimate source without tax deductions...Been it investment income or otherwise...

That's the difference between these Judges/law and the way the DSS is going about this. Have you noticed that the Judges haven't said anything? Have you noticed the trend of the allegation being one sided and thus aimed at painting the judges as guilty in the court of public opinion?

Law however doesn't work like that. The court /NJC won't listen to the allegations of the SSS alone. They won't behave like you or me and make definitive statements with only half facts. They will listen to both sides.

Till they do, keep an unprejudiced mind my good friend. The judicial system is corrupt, yes(heck, everything about us in any sector reeks of corruption), however, a lot of the things we term corruption is actually lazy and incompetent prosecution.

All the above are conjectures, it is an offence to be in possession of unearned wealth, if earned legitimately the paper trail will show the source, value added by the judges and taxes paid etc. If the security agencies can't prove the source is illegal, tax evasion charges can brought against them.
The fact such amount is kept at home is reasonable ground to suspect money laundering, tax evasion, and criminal intent. Are judges legally allowed to engage in active business? eg soliciting for contracts, buying and selling etc. by the codes and ethics of their profession? Even if they are able to prove trhey earned the money found by obtaining contracts, they may still be charged for infractions especially if such contracts came from sources that could be deemed conflict of interest.
