Osun Assembly Amends LG Administration Law by MidasTouche01(m): 8:43pm On Dec 04, 2016
Osun State House of Assembly has on Thursday approved an executive bill for the amendment to the State Local Government Administration Amendment Law No 5, seeking the reduction in number of caretaker management committee.

According to the statement from Chairman House Committe on Information ,the bill, passed by the parliament on Thursday, has sought the reduction in number of management committee in the Local Government, Local Council Development Authority and Area Council from ten to not more than five. The passage of the amendment followed its first, second and third reading through a motion by the leaders of the house, Honourable Timothy Owoeye at the plenary on Thursday The original amendment law, being re-amended had empowered the governor to appoint caretaker management committee of five persons to administer the council pending the election of democratically elected management.

Announcing the passage of the amendment which reduces the numbe to five, the Speaker, Honourable Najeem Salaam said, the passage of the bill would guaranteed reduction in the cost of governance in the local councils. He said, according to the bill, management committee would be headed by Executive Secretary and the management would administer the council for a period of six months.

Noting that it has become impossible to conduct election into the councils now due to the economic recession, Salaam said, the new amendment would enable the governor to appoint caretaker management into the council.

According to him, by the passage of the bill, the governor could go-ahead to appoint the management committee to administer the councils after assenting to the bill. Describing the appointment of caretaker committees to the councils as abberation and not in tandem with democratic system, he said, it was the economic situation that has forced the state to resolve to the option. He expressed optimism that by 2017, the state government would have the wherewithal to conduct council polls.

Five and half years before recession when AriGBESEsola has been the Governor, did he make any provision or intention for organizing any local government election!

Before, the excuse was Goodluck Jonathan starving Osun State of allocation, the new excuse is recession!

Caretaker in the first place is illegal

National Assembly should spend up the law on LGA. I wonder why government is not obeying the laws of the land.

THere was a court ruling which stated that "Any Local government without a democratically elected chairman should not benefit from federal allocation"

LGA should have autonomy, joint accounts with state government should be removed, tenure should be fixed, INEC should be empowered to state level to conduct LGA elections

if he actually comes to the media to say he spend some amount of millions to conduct elections at the local government level, nah pple like you will say "How can he spend so much money just to conduct election" Ogbeni is saving money by doing all this, and he is pushing hard to provide basic amenities.

Account to Political science, local Government is another tier of Government and the constitution does not allow the governor to appoint or select any LG chairman or caretaker committee what so ever.

Nigeria Governors behave like the lords i their state, they control all the arms and tiers of government in a country where we have separation of power.

They controls the states and can never allow the federal might to control them.

i fear for democracy in Nigeria

Is there any sufficient excuse for any illegal act? Caretaker committee system is illegal and the State or Osun should be even ashame of not following the letters of the Constitution.


Where are the federal allocations to the local governments in state of Osun going all this while? Oh! The pocket of the state government....

The poor rural dwellers in Osun continue to wallow in the pit of poverty while the state government grows increasingly distances away from them. Local government which ought to fill the lacuna of government anchored development activities have been crippled...


Only God can save the rural dwellers...

But aren't we running a federal system? The last time I checked, a federation has only 2 federating unit, n d local government is a subset of d states n dat is why dey use a joint account n it's only d state house of assembly dat can make law 4 dem n dat is why it is d state electoral commission dat conducts their election.

what do u expect from the house filled with a political party that has Lie (Muhammed) as one of the key party figures. it's six years now that Ogbeni came on board, neither do we have councelor nor chairman in 0sun state. May Almighty God save us from Ogbeni (amen)!

You are not far from the truth albeit forgoing the letters of the 1999 Constitution of the federal Republic of Nigeria as amended. According to Section 7. (1) The system of local government by democratically elected local government councils
is under this Constitution guaranteed; and accordingly, the Government of every State
shall, subject to section 8 of this Constitution, ensure their existence under a Law which
provides for the establishment, structure, composition, finance and functions of such
councils.

Going by the provisions of the section quoted above, the state government is outrightly mandated to conduct local government elections and not replace it with caretaker committee system. Even in the United States where local government was not mentioned in their constitution, local governments were made affairs of the state government and elections hold regularly.

Let's say the comparison is way too far as the United States is more developed. The Constitution is clear on the nature of local government and the role of the state government in ensuring its existence.
