Court Grants Order Of Mandamus To Sack Amaechi, Onu As Ministers by ayindejimmy(m): 10:36pm On Dec 08, 2016
THE Federal High Court in Abuja has granted an order to commence action by way of judicial review seeking an order of mandamus to sack Rotimi Ameachi and Ogbonnaya Onu following allegations by two Supreme Court justices.
Amaechi is the Minister of Transportation and Onu is in charge of the Federal Ministry of Science and Technology.
The plaintiff in the matter, the Human Rights Foundation International, in its substantive suit, is asking the court to make an order of mandamus compelling the Department of State Services and the Economic and Financial Crimes Commission to “perform their statutory obligation” by immediately arresting and prosecuting the two ministers.
The group also sought an order of mandamus compelling President Muhammadu Buhari to immediately sack both ministers “in public interest and public morality” based on allegations of attempts to influence court decisions as recently alleged by two Justices of the Supreme Court.
A copy of the enrolled order made by Justice Ahmed Mohammed on December 1, 2016 granting leave to the plaintiff to go ahead with the suit, and made available to journalists in Abuja is calling for the sack of the two ministers pending when they will be cleared of every allegation of corruption by a court of competent jurisdiction.
The plaintiff further seeks an order of mandamus under the judicial review of administrative action/inaction procedure as required to first seek and obtain the leave of court through an ex parte application to properly commence the suit.
