Hi ,

I feel members of the learned profession need to have a forum where they can share knowledge of the practice of law.I was stranded recently when i had to prepare a process and i couldnt find any precedent anywhere.Such a forum will help in getting quick tips and advice on law as it is practised in Nigeria.It will also greatly enlighten the public.So ,i expect that experienced and young lawyers will sign up

Why are lawyers not enthusiastic about this thread.. Just perused d the doctors thread and they are heartily contributing the growth of their online community here on NL. It would be of immense assistance to upstarts in this noble profession if we collectively discuss challenging issues of our practice.. Merci!!

Please, dear friends.. I have a challenge and I'll need your opinion on it. I move into an apartment a year and six months ago. When I was paying the first one year rent in Abuja, there were things the Landlord didn't fix which he agreed to fix as soon as I pay him. E.g, the flour of the compound, the security wire on the fence. These he didn't do until my one year rent expired, I payed another six months rent but stated clearly that if he doesn't fix the security wire, I will be moving out. A month ago, he came with his lawyer to my house and asked me if what I told him about moving still stands, I told him yes except he will fix the fence. He left with his lawyer and that same week, Local Robbers came through the fence in our absent and broke in to the house and went away with 325,000 Naira and things worth 300,000. I sent message to the landlord and he refused to come, he told me he was sick. A day to the expiration of my six months rent, he came to the house to say sorry for what happened. I asked him how do we share the losses since the robbers came in through fence he refused to wired, he told me there was nothing he could do, I told him to give few months to gather myself and move out from him compound, he said no way. A day after my rent expired I saw his lawyer in my house telling me that he's giving me 7 day notice to evacuate the premises. Pls I need your opinion on this matter, this happen in Abuja today. Hello,

I shall address your concerns below:

1. Robbery Attack - The criminal act of robbery against you is a crime against the state. That is an aspect left for the police to investigate and prosecute whosoever they suspect. You should make a criminal complaint at your nearest police station ASAP. Although your landlord has the obligation to maintain the exterior parts and structures of his property, a neglect to do so does not automatically make him liable for your loss to an armed robbery attack, unless you can be able to establish negligence on his part, because he owes you a duty under law (this can only be arrived at via a civil suit instituted against your landlord). Again, this option is not water tight as your landlord can rely on several defenses available to him - such as you should have been able to mitigate your own loss by working on the fence yourself (after proposing it to your landlord and he accepting same) and seek to recover what you might have expended on the fence by deducting it from your next rental. However, since you intend to pack away, a civil suit in court against you landlord is best for you, but if you intend to renew your rent, then I would advise you simply cut your losses and enter into negotiations about how the fence can be fixed by either you (including how you would be reimbursed - ensure it is in writing) or your landlord.

2. Ejection - From you story line, since your rent has expired, you are no longer a tenant. Thus you become a tenant at will or a statutory tenant and can only be ejected by serving a 7 day notice to quit. Thus, your landlord acted legally. However, since you request for more time, you can have a lawyer do a letter to your landlord's counsel, requesting for more time, with an undertaking to move out on a given date. This can buy you time. Fear not, for your landlord is not allowed to rely on self help (forceful ejection). he can only do this by obtaining a court order (that also takes some time) which would be enforced or carried out by court sheriffs with the assistance of the police (where necessary).

When we critically look at the recent judgements of our Judicial courts, one is poised to ask; why the contradicting judgement from the Sheriff/Makarfi PDP chairmanship lead judgement, to Ikpeazu/Ogah led battle for the Abia State Governorship seat unto Giwa/Pinnick tussle for the NFF presidency?
The answer cannot be far fetched. They are the scapegoats of the politicking that goes on in the executive and legislative arm of government. Come to think of it, are they not the only arm that was not duly elected by the electorate? Every other arm was elected by the citizenry, why not the Judiciary? Well, lawyers will say theirs is a defined field where integrity is the order of business. Why does it still hold that a law degree is a prerequisite for astute foray into politics?
Forgive my questions, am not a lawyer. I just want to be enlightened. The NUJ recommends qualified individuals to the president to appoint and most times these appointments are politically motivated by party affiliation. So here goes my question again. If you can see my worry, is not possible for a man who is appointed by party affiliation, by the same man, who pays his salary to be influenced? The odds don't seem to favour him to perform his duties without bias and this same analogy goes for both the state Justices.
Don't get me wrong am not advocating for Justices to start soliciting for votes in other to be named Chief Justice of the federation. I just feel their hands are tied when it comes to putting their primary objective at the forefront of things.
A bill should be sponsored by the house revoking the power of the President to appoint the CJN. That is my humble opinion.
