the 1st witneess Mr. Oladele Ebenezer (3RW10) a farmer from Ibilo in Akoko-Edo LGA, he is to be cross examined
with exhibit PO 4(4).

During cross examination by Onyinye
Anuwonye counsel to INEC, the deponent
affirmed that the entire process of
accreditation and voting was done properly
as reported by his polling unit agent under
his supervision as the ward collation agent
and also that there was no omplain of
improper and lack of accreditation and over
voting.

In addition, when it was time for A. Oyeyeo
(SAN) counsel to the 2nd respondent to
Cross examine, he was given the voters
register used in his polling unit to confirm if
there was any tickings besides his name he
answered that he can only see just one
ticking to the right.

Kemi Pinheiro (SAN), gives the witness
exhibits PO 4(4), PO S(1) to confirm why the
total ballot papers used is 5,052 while the
total votes returned is 4,985 leaving
unexplained 67 ballot papers unaccounted
for.

This question was vehemently objected by A. Akintola (SAN) but after a brief debate between Kemi Pinheiro and A. Akintola (SAN), the judge in a short ruling said the witness already wrote in paragraph 73 of his deposition that he confirmed that all the results are correct and accounted for, so counsel to the petitioner can Cross examine the witness concerning his earlier statement in his deposition.

Back to my question, Kemi Pinheiro (SAN) said ,but in his response the witness affirmed that the result is correct.

The 2nd witness Mr. Maliki Fatai (3RW11) a
businessman and politician from Igarra in
Akoko-Edo LGA, he is to be cross examined
with exhibit PO 4(2).

A. Oyeyepo (SAN) counsel to the 2nd
respondent told the witness to be showed
exhibit PO 197(9) item 756, that is you on the
voters register the counsel asked he
answered Yes,
Was your name ticked, Yes,

was it ticked to the left or right? To the left
and not to the right he replied.

Kemi Pinheiro (SAN) asked the witness if he
still stands by paragraphs 12,13,15,17,18 of
your deposition, the witness answered, I will
haye to see the document,

Kemi - I suggest to you that the actual ballot
papers used in ward 2 was 3,894 and not
4,161 declared by INEC, I don't know he said.

Kemi - The actual used ballot papers in your
entire ward is 40,199 while the total returned
Votes is 39,630, where is 569 ballot papers?
He replied, I don't know about those figures.

What is there to defend? Obaseki days are numbered. Our true governor POI would be declared authentic governor soon.

The 3rd witness Mr. Francis Akpedi (3RW12)
a public servant from Agenebode in Etsako
East LGA, he is to be cross examined with
exhibit PO 4(44).

Kemi Pinheiro (SAN) ,asked the witness to
confirm exhibits PO 45-54(ECBA), PO 4(41
50) and PO 3G, please confirm these are the
results of all the units in ward 2 in your LGA,
is it the results entered into form EC8A to
ECBB to ECBC, yes or no, the witness said
Yes.

Kemi - The actual used ballot papers in your
entire ward is 29,901 while the total returned
votes is 31,914, where is the difference of
2013 ballot papers?
He replied, I don't know.

The 4th witness Mr. Daniel Ogudo, a
businessman from Ekpoma in Esan West
LGA, he is been cross examined with exhibit
PO 4(1,6,7,8 ).

Kemi Pinheiro (SAN) asked the witness if he
Was there when results of unit 5 ward 4 was
entered into form EC8A, the witness
responded by saying l wasn't there.

Would you be surprised that in the entire
Ward PDP is only challenging result in unit 5,
Yes or No? He said am surprised.

Kemi - Do you agree with me that PDP won
and defeated your party in your ward
resoundingly.

His answer was No

but when He read paragraph 16 of his deposition, it Was stated that PDP won in his ward resoundingly.

The judge discharges the witness.

Counsel to the 3rd respondent raised a
motion that their case be adjourned till
Wednesday 15th of March 2017.

In his ruling the judge, adjourned the sitting to resume on the 15th day of March 2017.

This marks thr end of todays sittings.

Tribunal resumed back on wednesday 15th March 2016 when the 3rd Respondent (APC) is expected to call in more witness to defend the election of Governor Obeseki Godwin.
