Just like I said in the other thread about this controversy...

You guys don't understand the point Mao Ohuabunwa was trying to make and I am with him on this. The letter is ambiguous and open to various interpretation.

Yes, we all know what the constitution says and in view of that, Osinbajo is the acting president. But look at it from this perspective: He may give an order or sign a law or budget and someone somewhere will go to court challenging him on the signed law insisting that he was not the acting president and lacked powers to sign such all in a bid to buy time. Please note that the person challenging this knows the outcome already but would want to buy time. He will seek interpretation from the lower courts, then appeal the judgement, and later head to the supreme courts with various court injunctions inbetween and before you say jack, 2 years has elapsed and the culprit is still free because while he is at the courts, all actions will be pending awaiting the court verdict.

This is the lacuna Mao is trying to bring to light. After Osinbajo signs the budget, someone somewhere will spend above the budget next year or next 2 years and when EFCC wades in, he will go to court to buy time, hinging his case on this same thing.

Do not forget that Ngozi Okonnjo Iweala was coordinating Minister under GEJ and we know theirs no powers attached to such portfolio.

The letter could have been innocently scripted, otherwise, it could have been crafted by some mischievous powers surrounding the presidency. Mao is not ignorant of what section 145 says so he knows exactly what he is saying; we call him "Ancient Mao" in Abia North and we have a saying that what an elder sees while sitting down, the youths will not see even if they climb the iroko.

Oga, pakweh!

Buhari referred to the section of the Constitution that defined Osinbajo's role and status, in his letter.

Any fool can go to the court to waste his money. it's not an issue.

I tire oo,What is the noise all about, the opening paragraph said "in compliance with section 145 (1) of 1999 constitution......". Let's step back and see what does the section say before we start yelling and shouting. The section stated that once the senate receives a letter from the president informing them of his vacation or leave, the Vice President will henceforth serve as the acting President, until the president returns.

My question, is buhari not referred to the section that empowers osinbanjo as acting president??

These fools need to see the copy of the letter b4 yearning gibberish here and there....

Section 145 :
‘Whenever the President is proceeding on vacation or is otherwise unable to discharge the functions of his office, he shall transmit a written declaration to the President of the Senate and the Speaker of the House of Representatives to that effect, and until he transmits to them a written declaration to the contrary, the Vice President SHALL perform the functions of the President as Acting President.’

Buhari cited that section of the constitution that mandate him to transmit the letter

The section does not even empower him to mention anybody as acting President if not he could have nominated his wife or mentioned any other person.

As soon as that letter was read on the floor, the VP becomes the acting President AUTOMATICALLY until another letter comes indicating that the President is back.

The reason Jonathan had issues was because such letter does not exist and it led to a constituional crisis hence DOCTRINE of NECESSITY was invoked to be able to recognise the then VP as Acting President.

First and foremost.

The constitution of our great country does not give room for coordinating president.

When writing the letter to the Senate. PMB quoted section 145 of the constitution which says

"145.- Acting president during temporary absence of president

(1) Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, untill he transmits to them in written declaration to the contrary, such functions shall be discharged by Vice-President as Acting President. "

Look at the heading of the section 145

" Acting president during temporary absence of president"

Its quite clear that VP osinbajo is Acting President..

And please recall that the presidency has said that he will sign the budget and swear in the two new ministers.
Those are functions of the president either acting or substantive.

Its funny how nigerians can make a fuzz about nothing..

Please lets put an end to this controversy

It is a wonder that this orangutan called Omokri is still walking around, a free man.

He is proof indeed that Nigeria is a failed state and "democracy a la Nigerian style" is an albatross on the Nigerian people.
