The issue is the arm and ammunition meaning you have tendency to kill a person.An attempt and intention to do something is a crime on its own.

This is robbery for goodness sake...it means he went armed, he would have hurt someone if he wanted to. If it is stealing then it wont be death. Plus he would have taken more than that amount if he had met a richer person. The judge is not stupid.

An Osun State High Court ‎in Osogbo has sentenced a 40-year-old man, Kayode Adedeji, to death by hanging for robbing a woman of N3,420.‎

The sentence was handed down to Mr. Adedeji on Wednesday although the crime was committed on April 25, 2009.

The prosecuting counsel from the state ministry of justice, Elisabeth Alabi, had told the court that Mr. Adedeji robbed one Omowumi Adebayo at Bolorunduro area in Ilesa of the money armed with a knife at midnight.

The prosecution also claimed that the robber also had other dangerous weapons during his attack on Mrs. Adebayo’s residence.

Mr. Adedeji was said to have fled the scene of the robbery but was trailed and arrested by some members of the Oodua Peoples Congress in the area.

He pleaded not guilty to the one count charge of armed robbery when he was arraigned about eight years ago and was granted bail.

According to Mrs. Alabi, the convcict abused the bail privilege by committing another offence which led to his remand in Ilesa prison.

She ruled that the offence ran foul of the law and punishable under Section 11(2)(A) CAPR II, Laws of the Federal Republic of Nigeria, 2004.

The presiding judge, Kudirat Akano, found Mr. Adedeji guilty of the crime and convicted him.

The defence counsel, Tunde Adedokun, prayed the court to be lenient and merciful in her judgment, but she ordered that Mr. Adedeji be put to death by hanging.

The penalty for armed robbery in Nigeria is death. This is a just sentence.

but that's the law. it doesn't matter how much you stole as long as you threaten your victim with a weapon or attacked him with a weapon the penalty is between death and life imprisonment.

it's not burglary he was armed with a weapon. it doesn't have to be a gun. knife, dagger etc is still weapon.

The money is not what got him the death penalty, it is this: "he attacked his victim at her house in Illesa armed with a knife at midnight on the day"... making it an ARMED ROBBERY and NOT just stealing!

Once you attack someone with a weapon during an armed robbery to the extent that the person has to go to the hospital, life imprisonment or the death penalty can be awarded.

NOTE: UNDER THE NIGERIAN LAW A THIEF IS DIFFERENT FROM AN ARMED ROBBER THAT INJURED HIS/HER VICTIM!!!

armed robbery is armed robbery regardless of the type of arms used. Whether he came with a stick or nuclear bomb, invading someones home, carrying away their property by threat of force is armed robbery.

Armed robbery is death penalty. The idea is he could have killed the victim. Out of panic, if victim hesitates/unco-operative or whatever reason.

I think the law is too strict. Armed robbery could be 21 years. If injury caused, it could be 25 years to life depending on severity. If death caused in the act then death penalty.
