The FG through the office of the AGF went to court not to proscribe IPOB but to get a ruling on who the final authority lies in proscribing a group.

Note: The court did not declare IPOB a terrorist organization. The court only affirmed that the constitutional ruling on the President having the final say on which group to ban.

It is important to state here that the court was approached not to make a ruling on IPOB being a terrorist organization but to weigh in on who has the final say in banning the seccionist movement.

No court can declare IPOB a terrorist organization because none of its members have been convicted or facing terrorist charges in any competent court.

Nnamdi Kanu was facing Treason, Sedition and defamation charges and NOT terrorism charges and so he or IPOB can not be labelled as terrorist.

The inability of the last adminstration to tag Boko Haram a terrorist organization early when the latter began their reign of terror was because Nigerian senate was yet to pass the anti-Terrorism bill .

This legislative loop hole was what made northern senators oppose the tagging of Boko Haram as a terrorist organization.

The Terrorism bill which was passed early in 2011 was copied from that adopted by the United States and it requires congressional approval to also proscribe the group from which the President of the United States will ascent to it.

During the congressional hearing on the activities of Boko Haram, the then SoS of the United states, Hilary Clinton was invited to testify and shed more light on Boko Haram and to give both her honest and professional opinion on Boko Haram. Hilary Clinton refused to categorize Boko Haram as a terrorist organization but claimed the violent Islamic organization was an armed insurgency fighting against wide spread corruption of the Nigerian govt. Barack Obama will reiterate this view afterwards and refused to designate BH until the UN headquarter bombing in Abuja.

A serving senator in the US will later begin investigation on wwhy Hilary Clinton refused to aknowledge BH for what they are - a violent radical Islamic terrorist organization. And so far his findings have indicted both Clinton and Obama's initial hesitation based on their connections to opposition elements in Nigeria and their foreign backers (notably Saudi Arabia) towards effecting a regime change.

The only reason the FG went to court was to make a ruling demanding who had final authority to ban any organization and this was coming after the Senate President faulted the pronouncement of the FG through the Minister of Information banning and categorizing IPOB as a terrorist organization .

However much the current useless jihadist govt wants to manipulate the law, they should be reminded of a pending civil suit initiated by IPOB in the US where Buruntai and other top ranking security officers are being sued for terrorism, torture and extra judicial murder

Once that court rules in favor of the plaintiffs , the likes of Buruntai will effectively be declared a terrorist and will be banned from entering the US or other western nations.

With that proscription, the next stage will be the ICC .

Treasonable felony is not also the same thing as Terrorism.

I believe that the treasonable felony they are talking about is because NK said that Buhari is a paedophile. Which is true! But overthrowing a DEMOCRATICALLY elected government is treason.

Why did the AGF not file terrorism charges against KANU?

Because the anti Terrorism law specifically defines who and what a Terrorist is .

To tag IPOB and KANU terrorist only shows their desperation in getting international support in bannig the group worldwide.

The level of disgrace and shaming IPOB rallies are causing this govt plus their civil suit against the likes of Buruntai is causing them sleepless nights .

No. That is defamation of character to which the President can not initiate a criminal or civil case against KANU because the President by virtue of his immunity can not be called to testify or provide evidence.

One thing is certain. The labelling of IPOB a terrorist organisation cannot and would not stick.

@ op thank you for this eye opener

You are welcomed .

The FG put the cart before the horse by invading Kanu's home and killing IPOB members in Abia.

The proscription ruling they got was not to ban IPOB but to ask if they can ban IPOB

No court has ruled IPOB as a terrorist organization.

They then used that vague ruling to ban IPOB and also tag them a terrorist organization to justify their criminality and have started pressurizing the Intl community to go along with their illegality .

charge and bail analysis is what led a London gay club stripper terrorist to zombiefy so many people. IPob is terrorist and the court's ruling says much

In Europe merely belonging to a group that burns public building for political gains will earn you a terrorist label.

And if I may ask ; why did the FG not file Terrorism charges against KANU ?

Why are they yet to file additional terrorism charges on KANU?

The biggest sin that kanu committed which Nigerians tell themselves which they now equate to terrorism is hate speech.

Adeyinka Grandson's known location is in London from where he threatened to unleash chemical and biological weapons against northerners in their region .

This is not hate speech but an open declaration and intention to carry out an act of terrorism and mass murder using banned weapons.

Iraq was invaded and its then supreme ruler toppled on the pretex of stockpiling weapons of mass destruction and for an alleged chemical attack on Kurdish civilians in northern Iraq.

If you weigh the statements credited to Adeyinka Grandson and compare with that of Nnamdi KANU, who will you categorize as a terrorist?

Instead of trying to shut down IPOB rallies in Europe and America by getting the Intl community to go along with their terrorist tag on the group ,why can't the FG begin extradiction process to have Adeyinka Grandson face criminal trial for his reckless terrorist threats?

Not stopping there... how about fishing out the composers and distributors of the anti-igbo song which called explicitly for the murder and rape of Igbos residing in the north?

if the military are challenged on their declaration of ipob as terrorist. They will refer to the judiciary if the case is challenged on what base do the court legalised the declaration. .

I wonder how the court will legalise what they do not know about

First the military made the declaration before going to court, after finding their errors they quickly run to the court for help. ..

oh we find our selves in a country were by the court is a shade for lies

A competent court of law declared IPOB a terrorist organization. Anyone wishing to overturn this verdict must approach the court of appeal. Opening all these useless threads cannot save Kanu from the doom he brought upon himself, and if he knows whats good for him, he should remain in hiding for as long as Buhari is president.

No court declared IPOB a terrorist organization .

The FG went to court seeking a ruling that gives them the final say in banning IPOB.

Ask yourself why the AGF is yet to amend the charges KANU is standing trial for to include terrorism ?

Think!
