The Presidency has reacted to the viral Ganduje video, in which the Kano State Governor was allegedly spotted receiving bribe from contractors in the state.

According to Garba Shehu who spoke on behalf of the Presidency, President Buhari is aware of the video but there is little or nothing he can do about it. Garba Shehu stated that the Governor Ganduje was not accountable to the President. He added that the Kano State House of Assembly, that is constitutionally empowered to handle such cases, had already started investigating the matter.

“We all know that the governor is not accountable to the President. The House of Assembly is empowered by law to handle the case and we are all aware that the assembly has started investigating the matter.

“If we were in the military era, a military Head of State could question a military governor on matters like this. But it is not applicable in a democracy.

“The growing concern by some people has been that the anti-corruption fight at the federal level is not getting to the state and local government levels.

“But the President is helpless as far as the two other tiers of government are concerned. The President can’t force the state and local governments. He has no such powers under the constitution" he said.

It was further gathered that attempts to get the EFCC to speak on the matter since Wednesday up till Friday, have proved abortive. Punch reported that the Spokesperson for the EFCC, Mr. Wilson Uwujaren, who was contacted on telephone said he would find out if the matter was under investigation and respond appropriately.

“I will find out and get back to you,” he said.

However, subsequent calls put through to Uwujaren were not answered while a text message sent to him was not replied to as of press time on Friday.

The real reason Buhari can't do anything about Ganduje is because of the 5 million votes that will come from Kano next year.

All men of good conscience can only demand for the resignation of Ganduje on moral ground if the Kano state house of assembly refuse to impeach him. EFCC, police or any other security agency cannot arrest and prosecute him because of the immunity he currently enjoy. The same reason why Fayose couldn't be prosecuted while in office is the same reason the president can do nothing about Ganduje.

The president is helpless My God! So why is he the commander in Chief? And EFCC have developed cold feet again? Same EFCC that have been harrassing the governors of Benue, Akwa Ibom, Ekiti even when immunity still cover them but Ganduje, Aregbesola, Yahaya Bello, Rochas, Abdulaziz Yari are untouchables.

Here is the honest truth

Buhari can do nothing about Mr Ganduje case....

He cannot remove Ganduje from office, or suspend him (unless there is a serious crisis.) or touch him.

The onus lies on the State House of Assembly.

Take Alams of Bayelsa. The EFCC could not touch or harm him until he was removed/impeached by the State House of Assembly...then they could move in.

It has to do with the immunity clause....which was put into our constitution, and which might have gotten removed back in 2007...if it was not for the issue around Obasanjo's third term show...that made 149 other good reforms to the laws removed.

So, the ball is in the State House of Assembly...till they remove him, EFCC can do nothing.

After all, EFCC could not go after Fayose until he had handed over to Fayemi.
