The media as been on fire since the suspension of the CJN . A quick flash back will remind us about similar circumstances happened in the heat of the preparations for the 2015 general elections when the the CBN governor was "suspended" from office after blowing the whistle about mind blowing corruption in the NNPC. Though the then president gave other reasons for the suspension, it was widely believed it was in connections to the 2015 elections. The then opposition APC, threw several attacks at the ruling party.

It should be noted that there are guidelines according to the constitution of the Federal republic of Nigeria on how both the CBN governor and the Chief Justice of Nigeria can be REMOVED from office. This guidelines are similar in nature with both requiring two third of the senate's resolution.

However the Law was silent about SUSPENSION which is a very different case from REMOVAL. Seeing technical this loophole, the then president exploited and defended his action by claiming the the CBN governor was only SUSPENDED and not REMOVED from office.

A quick look at the dictionary defines SUSPENSION: the temporary prevention of something from continuing or being in force or effect.
while REMOVAL: the dismissal of someone from a job or office.
By this simple definitions, Suspension is seen as TEMPORARY while removal is seen as DEFINITE

Going by technicalities, the constitution only stated how the CBN governor could be Removed (permanent) and not Suspended (temporary)


Fast forward 2019, the technical loop hole in he constitution is being exploited by the sitting President. Going by the concluding part of statements announcing the suspension of both parties , I can conclude that the suspension politics was learnt from events of 2014 suspension of the CBN governor.

President Jonathan:
President Jonathan has further ordered that Mallam Sanusi should hand over to the most senior Deputy Governor of the CBN, Dr Sarah Alade who will serve as Acting Governor until the conclusion of on-going investigations into breaches of enabling laws, due process and mandate of the CBN.

Accordingly, I hereby suspend the Honourable Mr. Justice Walter Nkanu Samuel Onnoghen, GCON as the Chief Justice of Nigeria pending final determination of the case against him at the Code of Conduct Tribunal.

or wait for you case to be concluded, if not guilty my able president will reinstate you.

There are too many lacuna in our constitution, same thing happened when Audu of Kogi died before being declared as the winner, the constitution was silent on on what to do. The National Assembly is expected to collate all this grey areas and lacuna arising from either outright constitutional gap or discrepancies in sematics (removal/suspension) and fix them ASAP. This will safe Nigeria from the constitutional crisis that we presently finds ourselves.

we can't afford to allow the Executive trample on the other arm of government simply because the NASS are not rising to their responsibilities hence giving the Executive the legal leeway to have their way.

I respect you for putting sentiments asides. The bolded is very valid....at least u understand the fact that the constitution is really a flop.

U know there are still some crimes where fine is just 2 naira. Like wearing a camo for impersonation.

No wonder khaki boys beat the he'll out of defaulters...

As for Pres Buhari s action, me I support am. Too many flops from the judiciary lately. At least this will send a string signal to them..
