Let me start by quoting the classic philosopher Aristotle- "It is more proper that law should govern than any one of the citizens". Plato on the other hand saw the defence of the Rule of Law as the best possible political order.

The above corroborates the certitude that the notion of the efficiency, competence, and supremacy of the law has been known for aeon years.
Following wicked King John's penchant for bringing disrepute, ignominy and his constant disregard of the rights of the English people, the barons eventually succeeded in creating that single document capable of checking the powers of the tyrant leader; thus was born "The Great Charter" on the 15th of June, 1215.

Since the birth of the Magna Carter, Judicial systems all over the world have been fortified and toughened by the authority and influence of law in society, especially when the law is viewed as a constraint on individual and institutional behavior.

In 1789, In his two Treatises on Government, John Locke disclosed that the impending danger inherently laden in consolidating the three organs of state in the hands of one, might be cataclysmic.
Now to the draconian antics of the Muhammadu Buhari led federal Government.

Throughout the year 2018, on various instances, we witnessed the Buhari led federal government make intrepid attempts to hijack the Legislative arm of Government.
We saw desperate attempts to change the leadership of both houses via the back door; what many will term a "legislative coup".
We saw federal government sponsored lawmakers desecrate the hallowed chambers.

We witnessed the president's seceret police lay siege to the National assembly complex, we have seen the president go after vociferous legislators for mustering the effrontery to speak out against the Govenrment. We even witnessed the National chairman of the president's party publicly offer salvation and freedom from prosecution to corrupt politicians once they joined the ruling APC.

With the legislature failing to cave in, the Buhari led federal government has shifted its focus to the judiciary.
On countless occasions, having flagrantly violated orders of various trial courts, the retired general has constantly shown little regard for the rule of law.

The position of the law regarding the removal of the Chief Justice of Nigeria remains clear; wherein removal could be interpreted as replaced, suspended, fired or whatever choice of word you so prefer.
Section 292 (Constitution of the federal republic of Nigeria, 1999).

“A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances;
(a) in the case of –
"Chief Justice of Nigeria, President of the Court of Appeal, Chief Judge of the Federal High Court, Chief Judge of the High Court of the Federal Capital Territory, Abuja, Grand Kadi of the Sharia Court of Appeal of the Federal Capital Territory, Abuja and President, Customary Court of Appeal of the Federal Capital Territory, Abuja, by the President acting on an address supported by two-thirds majority of the Senate.”
(ii) Chief Judge of a State, Grand Kadi of a Sharia Court of Appeal or President of a Customary Court of Appeal of a State, by the Governor acting on an address supported by two-thirds majority of the House of Assembly of the State, Praying that he be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct;

(b) in any case, other than those to which paragraph (a) of this subsection applies, by the President or, as the case may be, the Governor acting on the recommendation of the National Judicial Council that the judicial officer be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct."

The president and his handlers have not exploited a constitutional lacuna as they claim, but have simply gone against the rules; however since this is not the first, i am far from shocked.

Muhammadu Buhari's despotic tendencies are very well known. With his tacit admission to compromising the integrity of the independent national electoral commission, and now in a despairing attempt to manipulate the results of the coming elections, he has gone ahead to contravene our constitution and to debase the Judiciary by unconstitutionally desecrating the office of the Chief Justice of Nigeria.

This is a wake up call to all lovers of democracy and liberty. There is a shadow of gloom cast over Nigeria's democratic process. These signs are ominous, the future is bleak!

I close by paraphrasing British wartime foreign Secretary "Sir Edward Grey". "The lamps are going out all over Nigeria, we may never see them lit again in our time".

The sooner we dump this 1999 criminal constitution the better for us all, people believe it is some kind of moses law, or it was written by angel gabriel and his angelic legal team, meanwhile it was arranged by abacha's suppreme military council headed by abdulsalam and some corrupt politician to protect massive looting and give them immuinity. Same law that favors the Rich and criminalises the poor, yet it is our tax and resources that made them rich.

Justice Onoghen, for the right of the many nigerians you had setenced to death with your judicial powers after deciding their fate based on available facts... For the sake of Right and Wrong, and for the sake of not further heating Nigerian polity, kindly quickly explain the source of your over 55 houses and billions in .your account. Many youths went to school, shunned, cultism, yahoo yahoo, ritualism and oloshoism for their fate in the system. Believing the court is the last hope of the poor man, Justice Onoghen kindly forget APC/PDP political play and explain to us the few youth that sadly still believes the system. Allow politicians to play their politics. Whether constitutional right or wrong, even if you give a mad man an hoe, he must make ridges for himself first. GEJ did same even though through NJC but it was fraudulent like this cos the allegations do not worth suspension. Snubbing

And so the word ' Suspended ' has been creating problems in our constitutions since 2011 yet our legislooters and selooters never see need to look into the act and do the needful.

The timing may be wrong, but Onnoghen is guilty as alleged

Is anyone in Nigeria closely following what is going on in Venezuela?

And if you are following, what does it tell you?

Ok. Let me give you an inkling of what will likely happen in Nigeria if Buhari and APC rig the 2019 election.

You have read the statements put out by the United States and the United Kingdom earlier on Thursday the 24th of January where both countries specifically warned against the rigging of the election and promised visa sanctions and even international prosecution for those who will be caught or indicted in the rigging of the election. Those who don't know or those who are so blind that they can't see, think that the statements by those countries are empty boasts. Let anyone in INEC, the security agencies and in the federal or state governments even try to rig this election and see. The international observers are coming in huge numbers more than ever before after reading the reports of the shame and sham in Osun State. The word has spread round and they are coming with a large delegation to observe the elections.

It's such a shame that the perceived gains of our electoral advancement in 2011 and debatably in 2015, have been eroded by the selfish and evil machinations of a desperate self-serving cabal.

With the US and the UK releasing warnings to Nigeria about electoral malpractices, it doesn't take much to look at what has been happening in Venezuela in the past three days or so.

In Venezuela, the leader of the opposition party ran for the Presidency with the incumbent President. The election was heavily rigged in the incumbent's favour and the international observers from the European Union and other countries, including the USA, reported the malpractices in that election to their home countries.

And what has happened?

President Trump of America a few hours ago duly recognised the opposition party leader as the President of Venezuela. Trump says the election was rigged and that the incumbent has to leave. What has followed? The European Union, Canada and other countries have also recognised the opposition party leader as the rightful President-in-waiting. Trump and the other countries have directed that all oil proceeds due to Venezuela be kept in a special account and will not be sent to Venezuela till the opposition candidate is rightfully sworn in. Trump has also agreed that the opposition leader can form his cabinet which the international community has agreed to recognise.

This means that the Venezuelan opposition party leader is now a President in the eyes of the world, while the incumbent president in his country is screaming blue murder. The opposition President will be given the status of an international Head of State and will be thus recognised. It's only a matter of time before the incumbent in Venezuela either accepts defeat or is removed by the people's protest when biting economic sanctions hit very soon.

How does this relate to the February election in Nigeria? Only the discerning can see what will happen.

If Buhari and INEC and the security agencies attempt to rig the election and results which do not reflect the will of the voters are declared, Nigeria should prepare themselves for the Venezuelan treatment.

Every Nigerian should be asking for right now is for free and fair elections in Nigeria. Let the people's will prevail.

It won't take one month of sanctions on us before the reality of what the effects of a rigged election on our economy and national psyche hit home.

Buhari respect the constitution when it comes to Ganduje. He should do same for all. Impunity and Nepotism are another forms of corruption. CJN cannot be removed in such manner, simply follow due process.

It has been under molestation and assault in the last 3yrs by the Buhari led APC government, but he not only decided to brutally rape her this time around, but strangle her afterwards.

She was only aged 19.

Most Nigerians don't understand this case.

Having an account with dollars is not

Corruption or neither is it a crime.

Not declaring is an error the CJN has admitted which by precedence (TINUBU vs CCT)

All he needed to do is to correct the anomaly and case closed.

If you re investigating the source of wealth? That is a different matter entirely.

The Judiciary and Legislative should heat the polity so hot for the next three weeks either on protest or impeachment, lets see how much publicity Buhari would have left.. atleast study has shown the FG write-ups and messages associated with Buhari dont receive attention and not even marketable to social media online/offline.

This shouldn't be a PDP or APC thing,but simply the respect and obedience to a constitution,believe me ,every lawyer I've spoken to ,wants the CJN in jail,but their main issue is that a lot of serving members of the ruling APC have pending cases with the EFCC and are walking freely.....while this very case was done and dusted in less than a week.

No one is saying the CJN is not guilty,at least we are all Nigerians ,we know what's up with government officials and kick backs,but let the law ,which we all respect,take it's course.


What everyone is saying is simply if Peter is punished for stealing a meat ,punish also his brother Paul for stealing the cow that produced the meat.

The sooner we dump this 1999 criminal constitution the better for us all, people believe it is some kind of moses law, or it was written by angel gabriel and his angelic legal team, meanwhile it was arranged by abacha's suppreme military council headed by abdulsalam and some corrupt politician to protect massive looting and give them immuinity

Bro, it is the same constitution Buhari swore an oath to protect. He should not act against the law. Instead of fighting the member of National Assembly he could have use the fatherly wisdom to woo them to his side and do some serious work on the constitution, rather he is playing the integrity game whereas he surrounds himself with corrupt people who he has repeatedly turn blind eyes on.

I repeat, those PDP are a fraudsters that know how to play their game very well than other political parties because they are very matured in criminal activities,.. So,Europeans,US or UK shouldn't interfere in our issues, they are the ones that started this mess a century ago. Besides,what is the essence of gaining independent?, they have many issues of their own, so they should face it, there are many dictators in Africa here and around the world whos has been ruling for the past 3 decades,they have nothing to say to that.... ONNEGHEN, WIKE, PDP AND THE BURDEN OF CURRUPTION

Former Chief Justice of Nigeria, Justice Walter Nkanem Onnoghen GCON did not only admit his false assets declaration, he amusely told belwidered Nigerians that he "forgot " to declare his assets. My goodness! Forgot to delcare your assets. A chief judial officer?

Huge deposit of foreign and local currencies was traced to secret accounts of the highly respected former CJN. Monies running into millions of Dollars, Pounds Sterling, Euros and Naira was discoverd in secrets accounts of Justice Onneghen. Over 50 choice buildings and properties was also traced to the Justice Walter Onneghen.

The matter was reported to Code of Conduct Bearue. The CCB quikcly reported the matter to Code of Conduct Tribunal. Justice Danladi Umar of CCT requested the appearance of Justice Onneghen. But instead of responding, Justice Onneghen used his influence and position to obtain ridiclous injuctions against the CCT. Justice Onoghen has descerated the temple of Justice, wherein he is expected to be protect.

Justice Onneghen has a nagative history of setting free most corrupt PDP goons. Most walk free with our stollen wealth. Perhaps, his account is loaded with bribe colleted to free such corrupt individuals.

THE WIKE/CJN CONNECTION

When these sturning revelations was made last week, Governor Nyesom Wike quickly mobilzed all the PDP governors from South South to an emergency meeting in Rivers State Goverment House. The ridiculous agenda is better imagined than expected. Wike secured the consent of the visiting governors to ask the corrupt Justice Onneghen to never appear before any Court. He was mandated to disobey the court. Impunity. CJN also surprisingly obeyed.

Basically, Wike was instrumental to the several ridiclous injuctions against CCT. He masterminded the open and brazing disobedience by CJN not appear before CCT. Governor Wike provided the backbone that energized the CJN to disobey the CCT.

PDP AND ITS FRATANAL ALLIANCE WITH CORUPTION

It is very surprising and shocking that the PDP members have not learnt their lessons. It has been proven that the name PDP is synonymous with corruption. PDP is corruption and corruption is PDP. No wonder, the PDP and its hoodwinked membership naturally gravitate towards defence of corrupt people and systems.

It is dangerous how a struggling opposition party will naturally allign with obvoiusly corrupt and stinking situation.

I think the PDP has become the proverbial vulture that naturally and instinctively fly towards the dead. PDP has become a "union of vultures". It flies towards rottenness and stinking environments. It takes joy in swinmming in the pool of feaces, decayed abjects and evil.

One may want to ask if the former Justice Onneghen is a card carring member of PDP. Or is there a pact we are unaware, which is planned to be executed after the general elections. Was PDP planning to launch back through the back door, using the Supreme Courts? Was the huge deposit of funds in Justice Onnoghen accounts bribe money meant to deliver injustice? Was the CJN an accomplice of a gangup? Beyond the discovery of this questionable funds, the authorities should investigate the reson behind such huge deposits.

The removal of the CJN is timely. He is considerd a zeus or Pope in the temple of justice. He is not expected to be any less an angel. He must be holy at all times.

The CJN criminal kiss of the forbidden fruit is both an abomination and abberation. He pleaded guilty before his arraignment, by conceeding commiting the crime. I think the most honurable thing that CJN should have done to escape the hammer that has befallen him would have been to resign.

Now that he has been suspended, let his celebrated prosecution begin. If he is innocent, he will be reinstated, otherwise If he is found guilt, I wish him cool time in Nigerian prison system, where he has sentenced most innocent Nigerians over and over again, perhaps with blood money as a motivation.

Weep not for the Justice Walter ONNEGHEN, former CJN.
