Human rights lawyer, Mr Femi Falana (SAN), has accused President Muhammadu Buhari of promoting illegality by allowing his 100 aides to remain in office despite the expiration of their tenure.

He noted that the President’s Chief of Staff, Abba Kyari; the Secretary to the Government of the Federation, Boss Mustafa; his media aides, Garba Shehu and Fem Adesina; and others had continued with their official duties without being re-appointed.

Falana said this in a message he sent to our correspondent on Thursday.

The activist said, “Like ministers, special advisers and other political appointees were appointed by President Buhari for a four-year term of office in 2015. Consequently, the tenure of all the political appointees expired on May 29, 2019 by effluxion of time. Hence, the federal cabinet was dissolved while all ministers were relieved of their appointments at the end of the four-year tenure.

“In the same vein, all other political appointees ought to have been asked to relinquish their positions. Since President has not sacked them or renewed their appointments there has arisen the urgent need to avoid a constitutional crisis whereby the actions of such persons who have continued to occupy offices illegally may be questioned or declared illegal by a court of law.”

Falana urged the President to do needful by immediately sacking the aides he no longer needs or re-appoint them so that they can remain in office as dictated by the constitution.

Another human rights lawyer, Inibehe Effiong, had a few weeks ago threatened to approach a Federal High Court for interpretation and enforcement of Section 151 and 171 of the 1999 Constitution following continued stay in office of Buhari’s 100 aides without being re-appointed.

Intresting.... this is what happens when we just pick up other peoples constitution and make it ours without even understanding it, No constituitional confrence, no input from the people who would end up using the law., other attempts at amendments by the senate has been flawed one way or the other.

A constituition that create vacum in governace couple of hours before swearing in, same way nothing is stated incase Governor Elects dies before swearing.

State Governor Elects also announcing Apoinments before inuaguration of state assembly, or sacking LGA Boss unilateral without recourse to the assemblies

I've been thinking about this too. Garba hasn't been reappointed, but he has been functioning as if he has. It clearly shows how very daft Buhari's administrative and governance skills are, for him not to know that it's not just the ministers alone whose tenure have expired.

Judges Now Afraid To Perform Their Duties, Says NBA President

Paul Usoro, president of the Nigerian Bar Association (NBA), says judges in the country are afraid to perform their duties as expected due to fear and intimidation from the executive arm of government.

He spoke while delivering an address at the association’s national executive committee (NEC) meeting, which held at the NBA secretariat in Abuja, on Thursday.

Usoro also spoke about the high level of insecurity and poor state of the rule of law in the country.

He expressed worry over the “intimidation of judges by members of the executive arm and security operatives”, saying that judges now “operate under an oppressive and pervasive climate of fear and insecurity.”

“Our Jjudges are threatened, intimidated and blackmailed mostly by the executive arms of government and their agencies both at the federal and state levels,” he said.

“Our judges cannot deliver justice under a climate of fear and intimidation. Justice thrives where and when there is an independent judiciary. There can be no such independence when there is no security of tenure for our Judges. There can be no independence of the judiciary when our judges are intimidated, threatened and blackmailed by state agencies and their officials.

“There can be no independence of the judiciary when our judges are actively coerced by state officials to think and reason only in the manner that those officials and, presumably, government want them to think.”

The senior advocate of Nigeria also lamented over how some members of the association were victims of the high rate of insecurity in the country.

“My dear colleagues, as you would observe, I have given you three illustrative instances of the insecurity that pervades our land from the three NBA Nigerian Zones – East, West and North – and that, by itself, makes the point that no part of our country is safe,” he said.

“No region is safe, and no tribe is safe. No one indeed is safe. And yet, we have governments in place, at the federal, state and local government levels and the primary business of governments is the protection of lives and property. Indeed, without security of lives and property, everything else grinds to a halt.”

He called on the federal government to address the security challenges in the country and urged public officials to adhere to the rule of law.

Its not the fault of the constitution abeg. Yes we need to tailor the constitution to our peculiar needs but in this case the person causing the vacuum is the president himself.

He had 4yrs to choose his aids for a 2nd term and yet he cannot. Well am not surprised for someone who had contested for 4times before becoming president still took 6months to form his cabinet in his first term.

If we had an intelligent person at helms most of these type of unnecessary complications will not arise at all.

Its a shame!
