Arrested because people sued the state? All Ihedioha has to do is file an appeal. The state has an entire Ministry of Justice for this. So why all the hullabaloo?

Thanks bud, there’re a lot of kids on nairaland, every government worldwide inherits debts, including the “almighty” usa. This is not even “proper” debts (money borrowed), it’s court judgements against the state which can be appealed up to the Supreme Court. Can someone tell Emeka Ihedioha and his team to stop witch hunting and focus on the task of governance.

It’s up to the Ihedioha government to determine, they are the ones raising the issue.

I raised the option of appeal b/c they’re moaning about the court judgements, you moan about a judgement if it’s unfair and unjustified. What do you do in that scenario: appeal.

There are many possible grounds for the government to explore. Like:
- Does the applicant (individual or persons) filed the original suit have grounds to do so?
- Was there any legal faults omitted or misrepresented in filing the case.
- Are the claims proper, a representation of the facts. Etc.

The State's legal team assigned to each case can find legitimate grounds to have the judgement nullified. Even out of court settlement can be considered in some cases.

Ihedioha should sit up work and stop acting as if he's on the floor of the green chamber.

The extracts below shows that there are multiple court judgements which is also a possibility that the previous government may have appealed these judgments but lost out and the Attorney-General of the state whom I presumed is very knowledgeable on the law and knows all the legal grounds to explore in other to get these judgments set aside is the one that is issuing the statement which also could be a possibility that the previous administration has exhausted all those legal grounds but still lost out which is why the state has no choice but to comply with the court judgements by asking all parties involved to come with the valid copies of their claims so they can resolve these issues without hurting the creditors and the debtors.

It said the debts, which had almost collapsed the government, arose from subsisting court judgments, Orders, Garnishee Orders and Proceedings for Execution of judgments and orders of courts against the state.

Imo State Attorney-General, Ndukwe Nnawuchi, SAN, made the claims in a statement to The Nation yesterday.

You just don't appeal for the sake of appealing and if all legal remedies has been exhausted and you still lost out, then you have no where else to run to but to pay up

As long as the Supreme Court has not ruled on each of the cases, there is room for appeal.

Out of court settlement is also obtainable in some of the cases.

Do you know cases can be won through appeals and strenuous injunctions? The complainant once drowned in legal expenses may opt to accept out of court compromise he was offered earlier.

If the State can't afford to pay, there are several options available. Gov. Ihedioha should concentrate more in working, the welfare of Ndi Imo depends on it.

Your assertions are very valid if and only if all legal remedies have not been fully explored.

We both don't know the extent to which all legal remedies have been explored and if some of these judgments where gotten through court of arbitration where judgements are final without room for appeal then the state is bound to pay up.

I'm very sure that the state AG along with the myriad's of sound attorneys within the ministry of justice must have looked up at their options and knows what is best for the state.

We both don't have the facts, rather we are both stating our legal opinions based on what should be done only if they haven't been done.

Oga lawyer, why didn't Rochas file an appeal?

They should appeal court rulings that took place years ago? How possible is that? Okorochas should have done that but he wasn't interested in appealing or obeying any court order.

We are our own problems in Nigeria, worse of all are the leaders.

Nigeria will never be better as long as we continue to sabotage and create difficulties for each other especially in positions where things can be changed for the betterment of the masses.

I didn't read anywhere in the article that the judgements were unfair or not justified. I however read that Okorocha did not pay judgment debts amounting to 20 billion naira. There is nothing to appeal if the judgements against Okorocha's government were all fair. Or you want Ihedioha to appeal for the sake of appealing? That will only amount to delaying the inevitable, incuring extra legal fees, incuring more judgement debt. Penny wise pound foolish.
