Atiku can still win as there is one Court he has not taken the case to. If he can drag Buhari to that Court he ( Atiku) stands the chance of winning. And that Court is in Nigeria . It is the Tennis Court of his choice.

Leaving Justice Mary Odili behind is understandable because of what PDP did during the time of Appeal court's president time. But leaving justice Ngwuta is a slap on the face of Nigerian judicial system

I beg to differ, becos we had GEJ losing court case and similarly we heard of a certain Chief Justice allegedly killed by OBJ.

Wednesday, October 30, 2019, the Supreme Court of Nigeria, in a unanimous decision, dismissed the appeal filed by the Peoples Democratic Party and its presidential candidate, Atiku Abubakar, challenging the victory of President Muhammadu Buhari and the All Progressive Congress in the February 23, 2019 presidential election.

The seven-member panel justices that gave the judgement was led by the Honorable Chief Justice of the federation, Justice Muhammed Tanko with honourable Justices, Rhodes-Vivour, Amiru Sanusi, Uwani Abaji, Ejembi Eko, John Inyang Okoro and Olukayode Ariwoola making up its members.

The apex court did not state reasons for the judgement, it however left the camp of the president and ruling party in celebratory mode, while members of the camp of the appellants left the court room sadder than when they came for hearing.

Notwithstanding of the feelings of the interested parties, there are some issues that need to be discussed, these issues bothers on discarding traditions of the court by the CJN Justice Muhammed Tanko.

Firstly, the noninclusion of honorable justice Mary Odili and honorable justice Sylvester Ngwuta as members of the panel of justices that heard the appeal raised concern as both justices are senior members of the Supreme court bench, and the CJN, by so doing, discarded the age long tradition of having the most senior seven justices to hear presidential petition appeals at the Supreme court.

Secondly, composition of members of panel that heard the appeal did not reflect national spread as it excluded justices from the southeast geopolitical zone in the seven justices that heard the appeal. The panel has two justices each from the northwest and southwest geopolitical zones, one each from northcentral, northeast and south south zones and zero from the southeast zone. This is also against the age-long tradition of the apex court. More worrisome is the fact that justice Sylvester Ngwuta, a senior jurist at the apex court from the southeast zone was excluded.

Thirdly, the speed at which the appeal was heard and discarded left observers worried. This is because the names of the seven-member jurists that heard the appeal were only unveiled few minutes before commencement of hearing and the verdict was given less than thirty minutes after conclusion of hearing- all these happened same day and it is unprecedented in the history of presidential appeals in Nigeria. This left Nigerians to wonder whether the whole process was mere academic exercise as the court seemed to have reached a verdict even before parties argued their briefs.

Though the public await the reasons for the decision of the apex court, the question on the lips is of everyone is whether justice was dispensed or miscarried. This can only be answered by the conscience of the seven justices that heard the appeal.

I don't know why we like creating issues where there is no need to do so...First judiciary is governed by constitution not TRADITION.The constitution states that the CJN has the right to constitute the SC judges for the case.The selection is not determined by tradition nor according to geopolitical zones in Nigeria. So issue 1 and 2 are baseless and do not have any merit.Your issue 3 does not hold water too...The SC had received PEPT judgement, appeals iof PDP and the counter appeals of the APC and taken a decision on the case as it was .Oral presentation is just to hear what you have said in written documents orally.The SC can decide the matter same day if your oral presentation is illogically .repetitious ...After oral presentation the SC can go in for deliberation and decide if something NEW has arisen in oral presentation. If none their judgement can be given same day.It is still in order .There are cases like that in the SC. So nothing new in Atiku s case .... It is still in order.

Oga, go and get yourself informed about supreme court decisions on political cases. This is in no way the 1st, 2nd, 3rd, 4th or even 10th case they will first give judgement and then give another date where they will release the written report of the basis of the judgement.

Most times they usually give a date like say 1 or 2 months before releasing the reasons for their judgement.

@ OP, I partially agreed with you that both Justices Mary Odili & Sylvester Ngwuta should have been among the Justices that ought to have heard the case filed by PDP but including would have ended up been a waste of time & days because APC would have resisted both of them the same way PDP resisted the President of the Court of Appeal from hearing the election petition at the Court of Appeal especially Justice Mary Odili because her husband is a well known person in PDP.

They eroded the personality of the judges and it makes the judges in a way, ineligible to sit on the panel

Nah the judges probably already gave them intel about their exclusion. What PDP did was a desperate cry because they knew those judges would already be excluded.

Its better & proper you look at issues properly before commenting without a bias mindset. I am very sure you were ono of those shouting then that President if Court of Appeal should among those to hear election petition but now you are not happy that the same was done to Justice Odili

2. Why will PDP insist on having a Mary Odili sitting on a panel in one breath and in another protest the Justice Zainab's sitting on appeals tribunal. Oh! "age-long tradition" was not your criteria then?
3. The shameless brevity of wanting to pick and select judges who should hear cases is another down-low. You later now talk about compromise of the judiciary. What special interest in Mary Odili? Prior to the judgement, the PDP went to the media creating unnecessary tension, attempting to dictate composition of judges. Who does that?

See you twisting facts and logic

1. The NJC had communicated that they will not make public the names of judges that will sit for the Supreme court hearing. This obviously did not mean they were chosen at the last minute or not prepared. All the facts at the tribunal was already at their disposal and what they heard were arguments.
2. Academic exercise? appealing to public sentiments are not pursuing the facts and quality of your defense betrays your capabilities for quality opposition. I have watched court cases both home and abroad when judges did not even bother to hear the defense, as the prosecution's case was weak, watery or useless.

The case had no merit (even in the eyes of a layman). What exactly were you expecting the Supreme Court to crack their heads over? That Buhari doesn't have educational qualifications, or that INEC transmitted results to an imaginary server? The speed with which a case is decided depends on the complexity of the issues raised.

Sentiments aside, the case didn't hold water.

As for the process of picking members of the panel, I think the discretion rests solely on the CJN. You wouldn't seriously expect him to appoint people he knows to have some kind of vested interest or the other in the case to serve as Judges on the same case.

One would have expected that the OP knows this obvious FACT, but decided to be twisting issues and logic

Leaving Justice Mary Odili behind is understandable because of what PDP did during the time of Appeal court's president time. But leaving justice Ngwuta is a slap on the face of Nigerian judicial system

So Buhari left out Odili & Ngwuta? hmmnnn..... see reasoning grin
