National Chairman of the All Progressives Congress Adams Oshiomhole said ousted Imo governor Emeka Ihedioha did not win the 9 March 2019 election and that the Supreme Court judgment was a remedy for the fraud.

Oshiomhole made the startling revelation while addressing party members in Auchi, Edo North.

He claimed Ihedioha did not meet the constitutional provision of scoring 25 percent in two thirds of the 27 LGAs in Imo state and said it was fraudulent for the INEC returning officer to have declared him the duly elected governor.

“Everybody knows that you need one quarter of the votes in at least two third local government (areas) in a state to be declared a winner or governor, but INEC recruited a Professor of crook who declared Emeka Ihedeoha of the PDP who scored one third in 12 local government (areas) out of 27. So, if the Professor go free with his loot, another person will try it again.

“That was the mischief that the Supreme Court corrected that they are hiring people to come and make noise. We don’t steal votes, we win votes. So I congratulate the Supreme Court for upholding the constitution of the country.”

Oshiomhole, who also spoke about the imminent reforms in the electoral process, said APC will push the President and the National Assembly to insert in the electoral law that any INEC official who deliberately declared a loser as the winner of election should be charged to court, after a fraud had been established.

After the election of 9 March, in which 70 candidates took part, the PDP candidate, Ihedioha, was declared the winner, with INEC returning officer, Professor Francis Atunta claiming he scored 273,404 votes. Uche Nwosu of the Action Alliance had the second position with 190,364 votes. The candidate of the All Progressives Grand Alliance (APGA), Ifeanyi Ararume came third with 114, 676 while Hope Uzondima of the All Progressives Congress (APC) polled 96,458. Accord Party candidate was fifth with 6,846 votes.

INEC Imo State Returning Officer and Vice-Chancellor of the Federal University of Agriculture, Umundike, Abia State, Francis Atunta, put the total registered voters at 2,221,008 and the total accredited voters as 823,743.

Atunta declared 25,130 votes cancelled across the state and valid votes as 714,355 while the total votes cast was 739,485

Uzodinma vowed to challenge the results. While addressing supporters at the party’s secretariat in Owerri, Imo State,on 14 March, he claimed that there were some forms of injustice that occurred during the results’ compilation, vowing to challenge the INEC’s declaration in court.

“We are going to challenge the result. We will be very resilient. We will address it and God willing, justice will be done,” he said.

Uzodinma went to court to claim that he won the poll because the results from 388 polling units were excluded. He lost at the both the Governorship Election Tribunal and the Appeal Court. However, he got a dissenting judgment in his favour at the Appeal Court.

At the Supreme Court, in the unanimous judgment of the seven-member panel, read by Justice Kudirat Kekere-Ekun, the court agreed that results in 388 polling units were unlawfully excluded during the collation of the final governorship election result in Imo State.

Justice Kekere-Ekun said with the addition of the results from 388 polling units, Mr Uzodinma polled a majority of the lawful votes and ought to have been declared the winner of the election by the Independent National Electoral Commission, INEC.


The judge did not provide the details of the new votes scored by each of the candidates after the addition of the results from the 388 polling units.

She voided and set aside the declaration of Mr lhedioha as the winner of the 2019 governorship election in the South-East state.

The court also ignored Uche Nwosu of Action Alliance (AA), who polled a total of 190,364 votes to clinch the second position, because, it had declared Mr Nwosu an invalid

So, even to start with, the former governor did not even score the required 25 percent in two-thirds of the 27 LGAs in Imo state?

Apart from the fact that INEC rigged for him with stolen votes, they even bypassed the constitutionally required 25 percent in two-thirds of the 27 LGAs in Imo state.


I hope all the crooks involved are sent to jail.

I'm grateful to God for humbling Ihedioha.

Bad precedence for my nation's judiciary but God just had to use someone to remind Ihedioha not to take his place in Imo state.

No sane human will justify the destruction he carried out in Owerri out of personal bitterness.
Rochas was a horrible leader, but dude facelifted Owerri....you'd never take it away from him.

For Ihedioha to destroy those new landmarks and leave those areas in ruins show he deserves the mercy of no one. I pray the new administration charge him for destruction of State property.

This people need to know that babaric illegalities are not accepted in the law.

Why is this news coming out piecemeal. These journalists need to quit milking this event. If none of the candidates achieved the required majority it's supposed to go a runoff election constitutionally. This whole election is questionable when you look at house assembly. After all the fraud how can you trust it. This imo election is going down in infamy.

The judge did not provide the details of the new votes scored by each of the candidates after the addition of the results from the 388 polling units.

This information should be released.

There was nothing wrong with the election when the former governor was rigged into office, there wasn't any call for a runoff even though the 2/3 issue was raised on top of the other illegalities like unlawful taking away of votes by INEC in favor of the former governor, now that the ruth is out in the open and the Supreme Cout's verdict, they want rerun, they want runoff.

Talk about medicine after death.

Supreme Court's decision is final.

Justice prevailed.

I guess you read what you see then argue from there. If he won in the first round there's no need for the run off. It's only if none of the candidates won you need a runoff. The courts already said the APC governor won with the other wards included. The only question is was more fraud in the other elections handled by the same guys.

Other than that the courts should release final official results for the public. There's no reason not to. If INEC has it I'll email them about it

INEC did the "right thing in a wrong way " by refusing the voting of 388 polling unit by it's Returning Officer that lack power to do so. The results from these units were full of irregularities though, but the officer who rejected it had no such power to do so under electoral law. That was just the simple prayer requested by Uzodimma legal team which was simply granted by the SC. Court judgement is simply based on what the law say, not what is good or bad.

2. Who is the custodian of election materials, authentic result forms and documents? INEC

3. Who unlawfully and unconstitutionally removed votes from Uzodinma? INEC

4 Who illegally called the election for Ihedioha even though he did not score 2/3 of the votes? INEC

6. Who was in the position to disprove and negate Uzodinma's court arguments, the results and INECevidence he tendered before the SC? INEC

7. The SC did not organize the election, they did not supervise the election and they did not keep election results and records, INEC did.

8. Why are we asking the SC to release election results when in fact INEC as the custodian of the results refused to tender the results?

9. Why are we asking the SC to release election results when in fact Ihedioha and his lawyers refused to release and show the SC the results and documents than put him in office to prove that he actually won and INCE rightfully removed votes from other candidates?

10. By refusing (INEC and Ihedioha) to release records needed to prosecute their case before the SC, what were they hiding?
