The Action Congress of Nigeria (ACN), on Monday, instituted a N50 billion suit against Senator Iyiola Omisore over allegation that the party bribed its way to get victory in Ekiti and Osun states gubernatorial election petition.

The party filed the suit before a Lagos High Court sitting in Ikeja, asking the court to award general damages to the tune of N50 billion against Senator Omisore for alleging that the party in connivance with the Justices of the Court of Appeal, secured victory in Ekiti and Osun states without any evidence to that effect. The suit was brought pursuant to Order 3, Rule 3 of the High Court procedure rules.

Apart from the N50 billion damages, ACN is also asking the court to grant an order directing the senator to publicly apologise to the party by publishing his apologies in five widely read newspapers and also pay for the cost of its litigation in court.

ACN averred that the publication was “defamatory, maliciously and falsely accused the claimant of being in collusion with the justices of the Appeal Court, particularly Justice Ayo Salami and other justices who sat on some cases in which the claimant candidates were the petitioners/ appellants by bribing the said justices of the Court of Appeal in order to secure victory, particularly in the case of Aregbesola vs Oyinlola, judgment in which was delivered on 26th day of November, 2010.”

The party further stated that “it had never attempted to bribe or actually bribe or partake or involve in any bid to bribe any judge whether serving or retired, and did not bribe or attempt to bribe the justices of the Court of Appeal, who sat in the election petition appeal case of Aregbesola vs Oyinlola leading to the declaration of the petitioners/ appellants in the case and in all the cases referred to by the defendant or any other case whatsoever.”

It further submitted that it is of the view that since the allegation of bribery was leveled against the party, it was exercising fear that it would affect its political fortune, especially when Nigerians are seriously preparing for a general election in the country.

It added that Omisore has been making such statements regularly to the members of the public at different fora, all in a bid to malign the party in a case, which it said put a permanent seal on Omisore aspiration to contest the governorship of Osun state in April.
