The Nigerian Bar Association is just like the Nigerian Medical Association and Nigerian Society of Engineers . By making it compulsory to every lawyer to join they have violated the Nigerian constitution which speaks about freedom of association . to practise as an engineer you need Coren certificate license, stamp and seal as a doctor you need a license from the Nigerian medical and dental council . Over the years alot of lawyers have challenged the legality of the seal issued by NBA because they are not the regulatory body for law in Nigeria they are just an association we need to start asking questions why will government give its power to regulate to an association. The seal should be handled by the regulatory body not by the association as it is in Coren and Nigerian medical and dental council associations can only make suggestion to the regulatory body the final decision comes from the body.

Prior to this time, can a Lawyer who is not fully registered with NBA without Stamp and Seal operate in Courts? Can a Lawyer who is not a bonafide member of NBA votes or be voted in NBA election?

The fact that an Attorney General unilaterally introduced it means it can also be unilaterally cancelled. During the last NBA election, there were voters who are not bonafide members of NBA but allowed to vote. These groups of voters have no NBA Stamp and Seal but allowed to vote, then, there is no need again for any NBA Stamp and Seal.

The 2007 amendment followed due process as same was duly approved by the General Council of the Bar.


This is not the case with this 2020 purported amendment.
