Search for Section 84 of the newly signed electoral Act

Why are you bothering yourself. Can't you see you're dealing with an illiterate who can't read and understand anything. Those who are concerned know that it is there, and whatever they do with it is their own nightmare.

Some of you should have better understanding of the section of the act before you can share your thoughts. In a simple term what the section stand to prevents is that you cant not be a government office holder or a government appointee, and still vote or be voted for in any part primaries, or Congress. If you most vote or voted for you have to resign your current position.
My question now is which government office holder or an appointee will like to resign his position because we want to be a delegate in political parties primaries

Section 84(10) specifically mandated govt appointees to resign their positions 3months before the primaries of their political parties, if they are interested in being a delegate or being voted for.
This section of the new electoral Act is inconsistent with the constitution. The grand law of the land says a person shall resign 30 days to the day of his election. The general election is next year. The government appointees still have many months to stay in the office before they resign.

this section of the new act is only dealing with parties convention. And Congress, any government office holder or appointee can stay away from the Congress delegate list

Time frame for primaries (and resolution of disputes arising therein) is between April 4 - June 3. So, if the APC holds its presidential primary in June, then Amaechi should resign this month.

If Buhari want Ameachi to be president then APC primaries will be extended or inec will be lobbied to give one excuse to make everything fall in place.

This is a soft task for Buhari to do...just that buhari want Ameachi to thoroughly finish the railway under construction.

You mean the appointees can remain in office up till a month to election then resign to contest in the general election without participating in the primaries?

According to the section 84(10) of the new Electoral act recently signed into law, act which any government appointee interested in contesting or voting for any candidate in Party primaries must resign their positions 3 months ahead of such primary elections.

Now according to the recently released INEC time table. Political partiers have between April 4 to June 3, 2022 to conduct their primaries and ensure resolution of disputes from the exercise.

It means, going by the above provisions in the act and INEC time table, any government appointe who may be interested to participate in his or her party primaries and didnt resign by at least March 3rd, 2020 stands disqualified..

The political appointee must have resigned before he can be voted for….which means they must ALL have left their jobs before the dates of the Convention or Primaries!

they will surely do that, either by themselves or proxy but i dont think they can be successful in challenging the act.

They can also lobby inec to readjust its timetable.

They can also give up the idea of contesting altogether…if they do not want to resign.grin You cannot eat your cake and have it!

They have to resign before the actual date of the Primaries…that’s all. The Primaries must be completed well before June 3rd….according to INEC timetable.

This is very simple nau. Ask Okoricha...if I remember, he did abrakataabra with his son in-law Uche Nwosu as a governor and contested for presidential primary. This law is not new. Meanwhile, who will resign...just to be a delegate.?

I have searched too and couldn't find three months to convention

What it says is a political office holder must not partake in convention or be voted for, they can basically resign a day to convention
