dis itself can be argued all d way to sc and meanwhile 84 stays. law na ass o no be maths cheesy

This is important to the 2023 elections and so will be given priority hearing.

Don't be surprised if the Court of Appeal releases judgment on this by April, and the Supreme court by May.

Why Federal High Court Umuahia in Abia State because Portharcourt Federal High Court is known for this kind of court pronouncement.

Maxymilliano:
The section can only be removed by an act of parliamentary amendments and not by judicial pronouncement
This is very false....

Section 140(2) of the Electoral Act 2010 was invalidated by a Federal High Court Judgement that was never appealed.

It has stayed till date. A Court can invalidate or void any Section of any Act, Decree, existing law that is inconsistent or conflicting to the Constitution.

ivolt:

This is not true until the supreme court determines the constitutionality of such law
or absent of appeals.
The law stands.
It takes effect immediately.

It is declaratory.

This judge must be drunk on everything but legal and logic.
The rights of those concerned to vote or be voted for has not in any way been infringed upon.
Simple
Step down and contest if you desire so. It's not any violation of any law

They have a good case. So they will just take their chances and participate.

By the time the case is concluded in their favour, status quo is maintained.

Yes if you want to contest but if you're not contesting you can be a delegate to convention or Congress that the bill err
Parachoko:
But, the law was so clear, if you want to contest, resign as a Commissioner or minister

I wander why this law is so hard to follow.

Malami couldn't find any judge in Abuja to do his bidding and had to run to Abia.
BTW, the AGF cannot delete any part of our law as instructed by the illiterate judge. It is beyond his power.

A judicial pronouncement can render a law null and void.

History is replete with such.
This is not true until the supreme court determines the constitutionality of such law

The law stands.

Malami has done nothing.. That section contravene the provisions of the Constitution which gives 30 days to the election for resignation

They are presently tinkering with the constitution, let them just put it directly in the constitution

I was arguing with some neophytes earlier that the section 84 (12) of the new electoral act violated our constitution, positing that any court can easily throw it out.
Yes but a political appointee is a civil servant and civil servants must resign before running for office. Ministers must let this sink into their head.

It is worrying. When people like you begin to posture and position as learned.. Very worrying

Courts have always declared laws illegal when it infringes on the supreme laws of the land

Go to Google and type... Can court declare laws illegal
