The provisions of the constitution is final, that section 4(5) & (7a) of the Constitution makes any Law inconsistent with the Constitution void.

The judge noted that sections 66(1)(f), 107(1)(f), 137(1)(f) and 182(1)(f) of the 1999 Constitution already stipulated that government appointees seeking to contest elections are only to resign at least 30 days before the election

Tinubu was not a governor for the elite. That’s why you never felt his leadership. I lived long enough to see colonial relics in Lagos. And I witnessed all the other governors. Only Jakande stands out apart from Tinubu. Other governors after Tinubu are using the already laid out template to further develop Lagos. I know that he employed many street sweepers etc. as I said, he did not have anything to do with VI and Zikoyi. But you will remember that your people almost ran out of VI when bar beach was almost claiming your houses and land. Tinubu solved the problem.

This is dangerous for the Apc if they allow people like malami and Amaechi to use their desperation to participate in the process.

For me I don't think political appointees are public servants. I think the appeal court will upturn that judgement. Any party or aspirants caught in the middle is on his own.

That's by the way and I'm sure you never bother to ask about the followings,

1. On March 18, 2022, a Federal High Court sitting in Umuahia, Abia State, declared Section 84(12) of the newly amended Electoral Act, 2022 as illegal and a violation of the provisions of the 1999 Constitution of the Federal Republic of Nigeria (as amended).

2. This particular Section of the Electoral Act states that “No political appointees at any level shall be a voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election”.

What this means in simple terms is that a political appointee (like ministers, commissioners, special advisers, personal assistants, etc), be it at the federal or state level is not allowed to be a voting delegate or be voted for in a political party primary. And since such an individual was not allowed by the provision of Section 84(12) of the Electoral Act to be a delegate or be voted for in the political party’s primaries, thus, he/she cannot be a candidate for an election.

I understand you're a respectable elder statesman therefore, you should be free from assumptions too.

Appeal or no appeal, case is already decided. All political appointees wil resign one month to election. Primaries are not general election.

please kindly read the law again....

" They can not be a delegate or voted for at congress, convention or primary election", why did you think apc barred political office holder as delegates during his last convention?

the laws you quoted were talking about public servant, the new law is about political appointtees which is totaly different from public servant.

There is no where in rhe constitution where provision was made regarding political appointtees.

The case was taken to court and judgement was delivered speedily without the knowledge of interested parties like inec, the legislature etc

i believe that the decision will be overtuned, the section 84 is here to stay.

Malami is a national disgrace, to the public and the legal profession.

The constitution clearly defines what is public service:

"public service of a State’ means the service of the State in any capacity in respect of the Government of the State and includes service as:

(a) Clerk or other staff of the House of Assembly;

(b) member of staff of the High Court, the Sharia court of Appeal, the Customary Court of Appeal; or other courts established for a State by this Constitution or by a Law of a House of Assembly;

(c) member or staff of any commission or authority established for the State by this Constitution or by a Law of a House of Assembly;

(d) staff of any local government council;

(e) staff of any statutory corporation established by a Law of a House of Assembly;

(f) staff of any educational institution established or financed principally by a government of a State; and

(g) staff of any company or enterprise in which the government of a State or its agency holds controlling shares or interest;
