Nigerian legal system frustrating –Sanusi, Waziri


The Governor of Central Bank of Nigeria (CBN), Malam Lamido Sanusi and the Chairman of the Economic and Financial Crimes Commission, Mrs. Farida Waziri, yesterday lamented the unenviable state of the criminal justice system in Nigeria and called for its reform.

The duo stressed that the existing state of affairs is affecting their respective works and called on the stakeholders to initiate the necessary reforms to improve the system. They made this disclosure at the ongoing Criminal Justice Reform Conference holding in Abuja, which entered the second day yesterday. Presenting a paper on the theme: “Criminal justice reform and economic development” which was presented on his behalf by Mrs., Sarah Alade, Sanusi lamented that many of Nigerian laws on criminal prosecution are outdated.

He said this fact had not only made recovery of debts owed to banks difficult, but also made it possible for financial crime offenders to escape even when banks had genuine, water tight case against them. Sanusi particularly fingered the Evidence Act as a law that had stood in the way of justice in criminal prosecution of offenders because of its outdated provisions. He also condemned the attitude of some lawyers who aided financial offenders through undue prolonging of court proceedings. Sanusi said: “When banks bring a case to court and the matter go on and on without end, a bank may get frustrated and choose to write of the debt. “Unless the criminal justice is improved upon, we are not likely to achieve much.”

The defense party could end up being the victim if we are to go very strict on law like that,

The fact that Nigeria has chosen to infuse Moral into law has made our laws static hence the outdated thing Sanusi is talking about,

We can not have a legal system that only evolves when a top official is involved. Law should be allowed to evolve no matter what.

Law is an entity on it's own and doesn't require an enforcer to be valid. Law is law whether an enforcer likes it or not,

But a situation where a judge is saying "he can't try" someone is based on Moral ground ( former chief justice or is it current one on Pedo zamfara gov) and that is why our laws will remain static,

Judges and cops are all agents of law and are subject to law and they answer only to the law not statutes. But in Nigeria where Law is subject of judges and enforcers, law won't be free.


I agree with Sanusi but the reason for his conclusion is utterly wrong, Law, whether criminal law or whatever, doesn't evolve to make prosecution easier; Law evolve to make law better not to make it easy for anyone to go to jail!!!!

Did you bother to read the article at all? He's complaining about laws on criminal prosecution only.
Law should evolve to enable justice to be carried out swiftly and efficiently. He has been involved in several criminal prosecutions recently that have dragged on interminably due to loophole exploitation. How many cases have YOU been involved in? What's your own involvement in legal matters?

I wonder what the Nairaland reaction would be if Sanusi remarks that air contains about 70% nitrogen. People would still find a way to crucify the fellow grin
