The Court of Appeal sitting in Port Harcourt on Tuesday set aside two Federal High Court judgments that invalidated the nominations of Action Democratic Party ADP and African Democratic Congress (ADC) State House of Assembly candidates in Rivers State.

The penultimate Court in the appeal marked: CA/PH/480/2022 filed by 12 aspirants from both parties, set aside the High Court Judgements and upheld the appeals.

The Rivers State Chapter of the Peoples Democratic Party (PDP) had challenged the nominations of 12 House of Assembly Candidates of the ADC, citing non-compliance of the Electoral Act 2022. The ruling Party in the State argued that the ADC did not state its mode of Primary with which Candidates emerged.

In October, Justice Adamu Turaki Mohammed of the Federal High Court in Port Harcourt, upheld the arguments of the plaintiff (PDP) and nullified the nominations of seven Candidates. The judge ruled that the PDP could not provide enough evidence to disqualify five other Candidates.

Justice Mohammed in his judgement said the Independent National Electoral Commission (INEC) does not have the legal right again to publish and accept the candidacy of the seven ADC candidates, because the evidence before him showed that the party failed to comply with the provisions of the new electoral act. The affected Constituencies were: Tai, two in each of Ahoada, Etche and Ogba–Egbema–Ndoni (ONELGA).

Similarly, the PDP in the State also approached the Court to disqualify 10 House of Assembly Candidates of the ADP for not complying with provisions of the Electoral Act 2022.

Justice Mohammed who nullified five (5) of the Candidates said it cannot nullify the five other ADP candidates because the PDP did not provide enough evidence to determine that the primaries were held outside the constituencies. The affected Constituencies are: Emohua, Eleme, Bonny, Omuma, and Oyigbo

Dissatisfied with the rulings, the ADP, ADC and their Candidates appealed both judgements.

In a unanimous ruling on Tuesday, Justice Gabriel Omoniyi Kolawole JCA who read the lead Judgement, re-instated the affected Candidates.

The candidates for the State House of Assembly election were validly nominated and could participate in the forthcoming general elections, he said.

"The lower court ordinarily should not have entertained the suit. No political party has the locus to challenge the primaries of another political party," he held.

Recall, the the Rivers PDP had previously challenged the nominations of the House of Assembly Candidates over non-compliance of the Electoral Act and INEC not monitoring the Primaries. The parties are the Accord Party (AP), All Progressives Congress (APC), Labour Party (LP) and the New Nigeria Peoples Party (NNPP).

Justice Phoebe Msuen Ayua of the Federal High Court in Port Harcourt is expected to deliver judgement on the case of the PDP V House of Assembly Candidates of the Accord Party on December 07, 2022.

Justice Turaki Mohammed in October disqualified 16 of the 32 House of Assembly Candidates of the APC and also 14 NNPP House of Assembly Candidates in Rivers State.

He also disqualified four (4) LP Candidates in November. All three cases are pending at the Court of Appeal in Port Harcourt.

Justice Emmanuel Obile, Wike's hatchet judge will be put to shame in the days ahead.

The only institution that can safe guard our beleaguered democracy is the judiciary. But it is unfortunate that we have characters like Emmanuel Obile, Turaki Mohammed and Delop Pam as judges.

Judges should be an embodiment of morality and should at all times live above board. Any judge that is genuflecting to the whims of the executives isn't fit to be called a judge.

Neither Peter Obi, or Tinubu, or Atiku can change the judiciary.

Presidency is not a one man job...it is done in conjunction with others, and sometimes others need to do the jobs they were paid for.

Judicial officers know what they are supposed to do...so let them do the job they were and are being paid for.

Besides the above shows that our judicial system works very well. The sign of a bad judicial system would have been no provision for right of appeal.

You guys should realize that democracy is not just about who gets voted into Aso Rock..

I just hope judiciary would not destroy this democracy.

There's no doubt that Wike is the one in charge in that zone. Wike would not allow APC to have candidates in this election. He might allow ADC, or any other but APC.

even if Tonye Cole is not qualified on account of dual citizenship,APC governorship aspirant should be renominated via another fresh primary, or the deputy to Cole takes over.

But for a judge to disqualify the entire party,plus house of assembly plus Senate is such an absurdity, reckless,and wicked of a judge. That shows the judgement was bought.

If Tonye Cole isn't qualified,what of his deputy,house of assembly member nko? Wike and his judges are bunch of jokers. That judgement won't stand In appeal court

It's gradually coming to the point where we should be clamouring for the scrapping of courts of first instance in this country.

Dual citizenship is not an issue. He's a Nigerian by birth. It was when he traveled out that he got UK citizenship.

Wike is the problem of APC but unfortunately Ameachi cannot stand him. 80% of Ameachi boys are now on the side of Wike.

2023: Court dismisses PDP’s suit against Cross River APC guber candidate

A Federal High Court sitting in Calabar, Cross River State capital, has dismissed a suit filed by the Peoples Democratic Party seeking disqualification of the state governorship candidate of the All Progressives Congress in the 2023 general elections, Senator Bassey Otu, and his running mate, Peter Agbe Odey.

The PDP, in a suit numbered FHC/CA/CS/142/2022, and filed against Otu, Odey and the Independent National Electoral Commission, had contended that the candidacy of Odey was unconstitutional in that he is not a duly registered member of the APC and that he has a dual citizenship having sworn to an oath of allegiance to the United Kingdom.

In the suit commenced by Originating Summons, the PDP, then, challenged Otu’s eligibility and prayed the court to compel INEC to disqualify him alongside his running mate ahead of the governorship poll in Cross River State.

Otu’s counsel, Chief Mike Ozekhome, SAN, had filed and extensively argued the address of Otu and Odey against the PDP and Senator John Enoh.

Delivering judgement on the matter on Thursday, Justice Rosemary Dugbo Oghohorie upheld the arguments canvassed by Ozekhome and dismissed the suit in its entirety.

The presiding judge held that the uncontroverted evidence before the court clearly showed that Peter Odey was duly registered in his ward as a member of the APC.

*On the second vexed issue of dual citizenship, the court agreed with Ozekhome that Peter Odey from the evidence before court, is a citizen of Nigeria by birth and therefore his citizenship of the UK can not vitiate his eligibility to contest for the office of the Deputy Governor of Cross River State.*

The court, therefore, concluded that the suit of the plaintiffs was devoid of any merit whatsoever and accordingly dismissed same.

Addressing The Point after the court sitting, Ozekhome, said, “By the said judgement, Senator Prince Bassey Otu and Honourable Peter Odey remain the validly nominated candidates by the APC to contest the offices of Governor and Deputy Governor respectively, come 2023.”

He would not allow APC to pass like that. We know it and that's what would happen. It's easy to predict.
