A follow-up to High Court Judgement: Court Sacks Elisha Abbo From Contesting As APC’s Senatorial Candidate

The Court of Appeal sitting in Yola, has cleared Senator Ishaku Elisha Abbo to participate in the National Assembly election slated for February 25 as the Adamawa North senatorial candidate of the All Progressives Congress, APC.

Abbo’s fate had been in the balance after a lower court upheld his expulsion from the APC as earlier effected by the leadership of the party in his home town of Mubi North Local Government Area.

Justice Mohammed Danladi of the Yola High Court, on January 10, ruled that since Abbo had been expelled, he ceased to have the privilege of membership, including flying the party’s ticket for this Saturday election.

It can be recalled that the Mubi North Local Government Chapter’s Executive expelled him from the party on the 7th of October 2022. The EXCOs cited his Anti-Party activity as reason for his expulsion.

Abbo has been a voiced opposition to the Muslim-Muslim Presidential ticket of his Party, the APC.

Two APC members, Abdullahi Suleiman and Yusha’u Usman of Kolere and Sabon Layi Wards, Mubi North LGA, respectively, sued the Senator and sought for an interpretation regarding his status in APC.

In ruling on the suit, the Court of Appeal on Thursday, however, set aside the judgement of the High Court which affirmed the expulsion of Senator Ishaku Abbo from the APC.

Justice Isaiah Olufemi Akeju CA, who delivered judgement on behalf of the panel, invalidated the lower court’s verdict and vacated all its orders against Senator Ishaku Abbo.

Abbo has been a voiced opposition to the Muslim-Muslim Presidential/Vice-Presidential ticket of his Party, the APC.

The court declared that the trial court had no jurisdiction to entertain the matter as it falls within the internal affairs of a Political Party and affirmed Senator Abbo is a card-carrying member of the APC and is entitled to seek re-election into the Senate via the APC ticket.

The court awarded the cost of N500,000 to the senator against the respondents.
