25% In Two Third Of The States: Tinubu Has Met The Constitutional Requirement by aninibinladen: 3:24pm On Feb 28, 2023
For those troubling themselves over the 25% in 2/3 of the States,

1. 25% in 2/3 of the 36 states and FCT means 25% in two third of 37 states because the FCT is treated as a state and therefore we have 37 states and two third of 37 is 24.67 therefore you have to get 25% in 24.67 states or better put, 24(2/3) states.

2. Tinubu has met the requirement of 25% in 24 states and also got 90,902 in the FCT. Remember he needs 25% in 24.67 states(or 24states plus two third of a state).

3. Per INEC, 478,923 were accredited to the vote in the FCT and we need to get the 0.67 of those accredited voters thus 0.67 x 478,923 = 320,878.41

4. So to fulfil the constitutional requirement, Tinubu needed 25% of 320,878.41 which is 80,219.60 and he got 90,902

If it boils down to the mathematics of it, this will be it.

*Section 299 of the Constitution of 1999 provides as follows:*
*"The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation; and accordingly..."*
*Therefore if the candidate has scored 25% of the lawful votes cast in the election in 24 States of the Federation without the Federal Capital Territory, Abuja he has met the constitutional requirement envisaged by section 134 (2) (b) of the Constitution.*

for the avoidance of doubt on the status of the FCT, the supreme court cleared the air on this.

In BAKARE vs. OGUNDIPE (2021) 5NWLR (pt. 1768) SC. 1., Olabode Vivour-Rhodes JSC read the lead judgement thus:

By virtue of section 297(a),(b),(c) of the Constitution of the Federal Republic of Nigeria, 1999(as amended), the provisions of the Constitution shall apply to the Federal Capital Territory Abuja, as if it were one of the States of the Federation; and accordingly all the Legislative powers, the Executive powers and the Judicial powers vested in the House of Assembly, the Governor of a State and in the courts of a State shall respectively, vest in the National Assembly, the President of the Federation and in the courts which by virtue of the provisions are courts established for the Federal Capital Territory, Abuja; all the powers referred to in paragraph (a) of the section shall be exercised I accordance with the provisions of the Constitution; and the provisions of the Constitution pertaining to the matters aforesaid shall be read with such modifications and adaptations as may be reasonably necessary to bring them into conformity with the provisions of the section.

correction, It is not 24 states plus 25% in FCT, it is two third of the 36 states and FCT. The "plus" and "and" make the difference.
