treesun: It is still the same courts, that the NBC will appeal to, and it is still the supreme court that will give the final interpretation. NBC has become so draconian that news media are not reporting on other things that are out there with evidence from other media. I foresee a very tyrannical NBC under a Tinubu presidency, especially if Lai is there because the opposition against Tinubu is not going to end IF he is finally inaugurated. |

NBC is an. agency of govt...and they have the arsenal to keep fighting all the erring media. houses and. impose fine on them....they can also lobby the national assembly to amend the NBC act....and increase the sanction... Fighting NBC is like fighting the police boss on some of their enabling laws... |

They can wakeup one morning and place an unguided rules & sanctions indiscriminately. Especially when the intend is to serve the interest of the govt in power. |

If court says "no fine".. NBC should start withdrawal of operating license of erring TV and Radio stations in Nigeria. Once they close down for a complete year, they'll go back to court to beg for fines to be reinstated. |

This is a height of high-handedness, any provision of NBC Act not incongruent with the Nigeria Constitution is null and void because of its inconsistency. The NBC says “The Commission shall have the responsibility of determining and applying sanctions including revocation of licences of defaulting stations which do not operate in accordance with the broadcast code and in public interest.” while the Nigeria Constitution says in section 6(6) The judicial powers vested in accordance with the foregoing provisions of this section - (a) shall extend, notwithstanding anything to the contrary in this constitution, to all inherent powers and sanctions of a court of law (b) shall extend, to all matters between persons, or between government or authority and to any persons in Nigeria, and to all actions and proceedings relating thereto, for the determination of any question as to the civil rights and obligations of that person; (c) shall not except as otherwise provided by this Constitution, extend to any issue or question as to whether any act of omission by any authority or person or as to whether any law or any judicial decision is in conformity with the Fundamental Objectives and Directive Principles of State Policy set out in Chapter II of this Constitution; (d) shall not, as from the date when this section comes into force, extend to any action or proceedings relating to any existing law made on or after 15th January, 1966 for determining any issue or question as to the competence of any authority or person to make any such law. The provision of the Act of NBC was silent about the type of sanction to be impose. It is now left for the court to determine that and not NBC. The only one spelt out was revocation of license. The example of FRSC the man cited, FRSC has played smart on them already, they now have Mobil Court for their operations, that administer sanctions on Road Traffic Offenders. |
