Do u know the reason why the supreme court did not waste time on Osun election despite APC winning at the centre. They know such nullification cannot hold cos PDP swept every available post in osun with one mind. They have no reasons to give governorship to APC.
The same scenario is playing out in Labour party. No court of law will give positive judgement or mandate to divided house even if they truly win. It's what we called common sense.

Does a courts ruling on an electoral matter depend on whether the political party involved is a divided house or not?

The Judge who even presided over the nullification needs to be banned or suspended or warned about such error!
The window of opportunity to contest an election is 14 days after the primaries which is now a year old!
What sort of schoolboy error is this?

Now that one of their members has been nullified by a Federal High Court judge, series of analysis has begin to be published. Some says is too late, some says it's out of the court jurisdiction, some says it cannot stand etc......but they themselves has been going about like an headless chicken that the elected President should not be sworn in come May 29th.
Hypocrisy of the highest order.

What a joke taken too far. How would a FHC seating in Kano nullify a candidates of a party in another state? The joke was too much and should be a scene in a comedy series. Is there no FHC in Abia again, that one joker will go and file a case in Kano? The judge need be punished for his jankara judgement.

Secondly,the state from which the nullification is emanating from has no jurisdiction over a preelection matter!
However,I am willing to be educated if you show me the constitution where a pre election matter can linger after the window of 14 dats have expired!

what he meant by it's too late is that the court has no jurisdiction to entertain such case, there is already an election petition tribunal.

These are pre-election matters. There is a 14-day window after the primaries for such cases to be filed in court. The window has elapsed. Any case should be taken to the tribunal. It's too late already

Below is the CTC of the judgement, read paragraph 9 after that, eat corn and agbado in peace

Not everything you flex your muscle at. What you don't know you don't know. Many things are involved and let me bail you out.
1. For any court process, court jurisdiction is number one. A case that happened in Abia, cannot be taken to Kano for determination. That's tantamount to abuse of court process. Is just like taken an election case in Abia state to Kano state. Common sense. You don't need to be a lawyer to learn all these simple things.
2. Who instituted the case, does he has locus standing to do so? In a preelection matter, it is only a candidate that participated in the primary that can institute a case against the winner of the primary.
3. Another important criteria is the window period. When the cause of action took place and when the case was instituted. The electoral Act gives 14 days window period to institute a case in a primary election, counting from the day the cause of action happened. Any case instituted outside that window period is an academic exercise, futile.

If I didn't know much about who instituted the case and the time the case was instituted but number one has failed his case, for instituting the case against Otti outside Abia, where the cause of action took place.

Meanwhile, Tinubu case is not the same as this. This is more of preelection matter while Tinubu own is post-election matter. You're comparing the incomparable.
