Section 11 (4) and (5) of the 1999 Constitution (as amended) gives instances the National Assembly can take over state House of Assembly until the challenge facing it is resolved.

Subsection (4) provides, “At any time when any House of Assembly of a state is unable to perform its functions because of the situation prevailing in that state, the National Assembly may make such laws for the peace, order and good government of that state concerning matters on which a House of Assembly may make laws as may appear.”

Subsection (5) reads, “For the purposes of subsection (4) of this section, a House of Assembly shall not be deemed to be unable to perform its functions as long as the House of Assembly can hold a meeting and transact business.”

However, given why the National Assembly cannot act in the crisis and take charge of the House of Assembly for now, Agbese disclosed that the conflict is yet to be presented before the Federal House.

Military has never taken over any state because a state of emergency is declared by the federal government.

That Obasanjo chose to use some RETIRED military personnel to serve as interim Governors, did not mean military took over any function of governance. Instead, the appointed person took over, not any military.

A retired military personnel is already a civilian, hence can function in a civil role just like Obasanjo and Buhari did.

I don't see that scenario playing out. However, calling someone's post about a possibility of state of emergency in Rivers unintelligent, shows you are either ignorant or in your twenties. The constitution clearly gives the FG the power to impose state of emergency on any state in Nigeria. It happened twice under Obasanjo and heaven did not fall. It is just that Yar-Adua, GEJ and Buhari refrained from using that power during their times.

When you finish telling us about APC lead house taking over Rivers assembly, kindly educate the stupid assembly members about the supreme court rulings that when you defects to another political party without reason, you lose your seat.
Tell them also that they will never come back except through reelection. Also tell them, that wike can not give them money no matter what equivalent to what they were getting as assembly members.
Also be reminded that once court case is finished, inec will be directed to conduct fresh election for their replacement.
Lastly, HOR making laws for a state is nothing bad and not the way you think.
