antiaqueen: One good thing about reading this thread from the very beginning is that, it will help you to make accurate assessment whether you are in a good position to apply or not, whether to wait, what to add or what to remove innyour application. To me, I see it as a eye opener. Reading the entire thread will help you to know to a very large extent if your application will be successful, if you are on the right track or not. Areas to make the necessary adjustments. So it is a time well spent |

Hello Everyone! I have been reading for sometime now and I have learned a lot. I and my husband made a spouse visa application about 15 months ago which was rejected and we appealed. We only just won our appeal about a week ago after it got to the tribunal. The judge allowed the appeal on the grounds of human rights seeing as we have a 2 year old daughter who is British and has never been to the uk. My question now is how long does it take from when your appeal is allowed till when u get your visa? Would I have to send my passport to Sheffield? What is the procedure? Please Justwise and all the gurus in the house, would really appreciate any help given at this time. Thank you |
Re: UK Spouse Visa/Appeal Process-part2 by Lexusgs430: 8:51am On Sep 22, 2017 |
MrsElendu: UKBA would be allowed an appeal process, if they decide to go down that route......... If they do not appeal the decision, they would send you an email to submit your passport at the office you originally submitted your documents to. It could take as much as 2 months, depending on how many cases they are dealing with and how happy or sad they are........... |
Re: UK Spouse Visa/Appeal Process-part2 by MrsElendu: 9:11am On Sep 22, 2017 |
Thanks so much @lexusgs430. The letter we got gave them 14 days to appeal and that time has elapsed now so we are waiting fingers crossed for the email. Thank you again for the prompt response. |

Hello guys, reading this thread and the previous one and I am amazed by your kind gestures and information. |
Re: UK Spouse Visa/Appeal Process-part2 by justwise(m): 9:48pm On Sep 24, 2017 |
MrsElendu: I hope your case will be different but after the 15 working days given to home office to appeal or issue you a visa, they can decide to delay the process for up to a month or more, yes you will be asked to submit your passport for visa then that is when the delay game starts. 1 Like |

Sholeola23: Sorry for the late response as I have not been here for weeks. I note you also sent me an email but I don't know how to access it. Does anyone know how to access emails here? I have a question, the Home Office stated that your visit visa was not in your identity. Can you explain? Your situation is more complex as you have aggravating circumstances under 320 (11) |

Applied 29th June non priority Bio metric 4th july Got my visa today. Yippee. Thanks to God. I was required to leave the UK few months back. I opt for voluntary exit. Applied for a spouse visa. Got it in 12 weeks. This can only be God. Tried to use a lawyer but i changed my mind because all the while i used them in the UK, it never worked. I opt for absolute dependency on God and it paid. Advice Be honest with your application however meet the requirements Then trust God you will never be denied. All the best. 4 Likes |

Hello Everyone, its a very good job people are doing here which actually help built families, and generally peoples lives. My question if anyone can help me is; How does one deal with payslips for zero hour contract payments paid in arrears? eg Start work on 1st Jan and becouse you are paid in arrears, you get paid at the end of Feb for work/hrs worked in Jan. Come End of Jun (6 months in paid employment), you are paid for work done in May, BUT REMEMBER, you have worked for 6months though you have 5 payslips and have only been paid for 5 months and the hours worked in Jun will be paid End of July. How do you deal with that? In summery, you have worked and earned for 6 months and are earning way above 18,600 required for sponsorship BUT because of the zero hour contract payments in arrears, you only have 5 payslips and 5 payments at the end of June although you have worked and actually earned the 6th month although not paid yet. Please advise. Thanks |
Re: UK Spouse Visa/Appeal Process-part2 by Lexusgs430: 3:33am On Sep 28, 2017 |
cornea03: Include 6 payslips in your application + bank statements + brief explanation of situation. Ensure you submit your P60...... NB : To be on a safe side, submit 10/12 months bank statements with explanation... I hear zero hour contracts are the norm now, so the case worker would understand your explanation. Explain very clearly, regardless.......... Ensure your financials meet the '28 day rule'....... |

Good day house . I got to find out about this group after submitting my spouse visa. However, I've been following silently and reading all post. I was refused. Below is the refusal letter. Please I need advice on how to go about the next application. My husband is an IT contractor. He earns above the minimum requirements. But as every other IT contractors he pays himself about ££900 monthly from his company account. Which is less than the minimum requirement. Do we print out his company's bank statement alongside his personal bank statement or just his company's bank statements. I submitted everything on the refusal letter except for his company's bank statement and evidence of ongoing employment. Please I need all the gurus in the house to advice me. Thanks

CAT22: Why did you not submit this ? The omitted forms a core part of the application process (financial requirements)? |
Re: UK Spouse Visa/Appeal Process-part2 by Lexusgs430: 1:55pm On Sep 28, 2017 |
Isommex: That IHS payment is a bit expensive. How many applicants on your application ? |
Re: UK Spouse Visa/Appeal Process-part2 by Lexusgs430: 2:03pm On Sep 28, 2017 |
CAT22: In this rejection appendix, they have dropped all the expo to pass the examination nah, wetin remain ? Simply repackage & include all the requested documentations ............... You have 2 routes, either appeal or reapply ........... Reapplication -: Shorter route - Appeal -: Expect about a 2 year wait............ |
