The Supreme Court  on Friday removed the Kebbi State Governor, Saidu Dakingari, from office and ordered a fresh governorship election in 90 days.

In the lead judgment delivered by Justice Walter Onnoghen, the Supreme Court set aside the verdict of the Court of Appeal, Sokoto, which had upheld the election of the governor, who is of the Peoples Democratic Party.

The Congress for Progressive change had gone to the tribunal, seeking the nullification of Dakingari’s election on the grounds that he was not validly elected.

The tribunal eventually removed the governor on the basis that the Independent National Electoral Commission’s documents presented as exhibits were not on the prescribed forms. The tribunal nullified his election on technical grounds and ordered a fresh poll.

But Dakingari approached the Court of Appeal, Sokoto, declaring that the tribunal’s verdict was flawed.

Justice Aminu Sanusi of the Court of Appeal, Sokoto on December 28, 2011 upheld his election on the grounds that the INEC exhibits that were not on the prescribed forms did not vitiate the result of the election.

The appellate court also noted that it was empowered by Section 285 of the 1999 Constitution to make a pronouncement on the matter and that based on reasons adduced and oral submissions made, Dakingari’s election was in order.

It therefore upheld his election and quashed the judgment of the tribunal. The court also held that CPC’s cross-appeal that demanded that a certificate of return be issued to its candidate, Abubakar Malam Abubakar, was devoid of any merit and dismissed it.

The court said it would provide other reasons for the judgment at a latter date to be communicated to the parties.

Like Kaduna, Katsina, Gombe, another state CPC bungled due to their lack of organization and improper conduct at the preceding election(presidential).

Why waste money on fresh election when the same guy would be returned? Simply reappoint him after 90days.
