A state High Court sitting in Abeokuta, the Ogun State capital, has said that it cannot proceed with the trial of a former Governor of Ogun State, Otunba Gbenga Daniel, because the Economic and Financial Crimes Commission did not follow due process in the amendment of the initial charges brought against him. The court, presided over by Justice Olanrewaju Mabekoje, in declaring Daniel a free man, said that instead of seeking the leave of the court in amending the charges, which were initially 15, the EFCC rather relied on the Ogun State Attorney General and Commissioner for Justice, Wemimo Ogunde, SAN. The judge held that the court cannot proceed with the trial of Daniel based on the new 43-count charge except the EFCC decides to file the case afresh and follow due process. After the ruling, which lasted for about an hour, Daniel's lead counsel, Taiwo Osipitan, SAN, said that he was set to confront the EFCC again if the commission decides to file the charges afresh. Justice Olanrewaju Mabekoje of the Abeokuta High Court disappointed many citizens of ogun state and beyond thru his verdict,discharging the lion of asoludero court despite the overwhelming evidences which proves dat otunba daniel misappropriated the funds belonging to ogun state and its people.But its not coming as a surprise,since 1999 till date no serious prosecution$convictions of ex-govs. have been achieved.Though he may be a free man today courtesy of a jankara judgement,tomorrow might hold a surprise package for him. #Like Ibori,like Ogd# |

He probably appointed the judge when he was the Governor. He will never be convicted in Ogun state, just like Ibori was not convicted in Delta state. The judiciary is our biggest problem in the fight against corruption. |

We are usually quick to put the blame on the judiciary, especially when our expectations are not met, and this inspite of the fact that our expectations may not be proper or legit and if legit, the process of meeting those expectations are flawed. In the extant case, defence counsel only exploited the loophole provided by incompetent prosecution. it is elementary knowledge to most (if not all lawyers) that there are processes for amending charges. If there is a flaw in the process, it becomes a technical basis for the court to throw out that case. However, we must note that because it is a curable flaw, EFCC can (and should) redraft the charges and then file them again so that the matter can be heard on its merits. The truth is we should be blaming the EFCC lawyers for either doing a shoddy job or having been settled to ensure they do not do the right thing. Naturally if the same set of mistakes are made in an english judicial system, the same results will be achieved, this is not a Nigerian factor except to the extent that the prosecutors need to do a lot more to tighten all the knots so that the defence team of lawyers do not explore a technical flaw. Indeed, even if a man was to be charged for murder and there are overwhelming external evidence tying him to the act, if the legal process of trying him is flawed, he will be exonerated. And that right can be explored up to the supreme court (the final arbiter). I am sure we have all heard at some point in time or another that the law is an 'as.s'. The judge did what he was bound at law to do. In criminal cases, you have the obligation to get it right on your own, if it were a civil case, the court could try to help a perceived wronged party.
