ABUJA – NON teaching staff in the universities on Thursday announced a conditional suspension of the strike they embarked on two weeks ago.
The Joint Action Committee of the non teaching staff made up of National Association of Academic Technologists, NAAT, Non-Academic Staff Union of Educational and Associated, NASU and Senior Staff Association of Nigerian Universities, SSANU said they believed government would keep to the promise on the agreement the parties entered into.
Chairman of JAC of the three affiliate university unions Comrade Samson Chijioke Ugwoke announced the suspension after a meeting with the Federal Government Negotiation Team led by the Minister of Labour and Employment, Senator Chris Ngige.

Full activities may soon resume in Nigerian universities across the country as the non-teaching staff currently on strike have accepted the Federal Government’s proposal aimed at addressing their grievances.
PREMIUM TIMES learnt however that the striking unions have asked for ‘some time to consult before finally returning to the duty posts.’
Officials of the unions – Senior Staff Association of Nigeria Universities, SSANU, Non Academic Staff Union of Universities, NASU, and National Association of Academic Technologist, NAAT – told PREMIUM TIMES off the record that the strike could be suspended on Thursday or Friday.
The National President of the Joint Action Committee of the unions, Samson Ugwoke, spoke after the second open negotiation meeting with representatives of the government.
The second conciliatory meeting which started about 4:30 p.m. on Wednesday and ended at 12:20 a.m. on Thursday is part of the steps taken by both teams to resolve issues involved in the ongoing nationwide strike.
”A three-page agreement was signed and endorsed by all of us,” Mr. Ugwoke said.
“We are taking our (own) document and we will make our pronouncement soon,” he said.
The Minister of Labour and Employment, Chris Ngige, said both parties had come to the end of deliberation on the contentious issues which led to the strike.
The multiple demands by the union include: payment of earned allowances to their members; review of governance system in universities; improved funding of universities in line with UNESCO recommendations; provision of infrastructure in the universities; payment of salary shortfalls being owed; implementation of the National Industrial Court judgement on university staff schools; registration of Nigerian Universities Pension Management Company; NUPEMCO, and the implementation of CONTISS 14 and 15 for technologists.
The unions are also asking for an improvement in the teaching and learning facilities in the universities; stemming the tide of corruption in the university system and ”showing of commitment in the renegotiation of the 2009 FGN/University unions Agreements.”
On the issue of inadequate infrastructure raised by the union, Mr. Ngige said a seven-member committee will be set up to handle the matter promising that the university system will be rejuvenated.
On that of endemic corruption in the universities, he said the government would ensure that the Internally Generated Revenue from universities are put to maximum use.
“Based on these conditions, we have agreed with the joint action committee that they will consult their organs and call off the strike as soon as possible,” he said.
“If you want the proof of the implementation, we will present it to you,” he added.
If the strike is suspended, the unions would be following the pathway of striking lecturers who also recently soft-pedalled on a debilitating strike they embarked upon to push home similar demands.

Francisco who is a medical student at the Ambrose Alli University, Ekpoma, Edo state, maintained that just like him, several students don't want to resume as their tuition fees were increased and the strike has afforded them the opportunity to make extra money to be able to pay the fees.

An annoyed Francisco said:

"What is wrong with ASUU? I beg you with the name of God, don't call off the strike please we beg you. Many Nigerian students are against it because many state universities due to lack of funding they increased their tuition fees....this strike help them to pay their fees... I beg you ASUU tell us you are joking about the suspension of the strike."


When asked if he thinks other students share his view, he said:

"At least more than 65% does...I have friends from 12 universities, the same...go to Facebook, Twitter and some social media, many students are complaining ooo....the suspension of the strike is too early. Please I beg you try to tell ASUU that they have fail us."

The Academic Staff Union of Universities has said it would announce its position on the strike action in a few hours time .
The ASUU President , Prof Biodun Ogunyemi , stated this in Abuja at about 8 .30 pm on Monday , after concluding the final meeting with the Federal Government delegation .
The delegation was led by the Minister of Labour and Employment , Chris Ngige .
The ASUU is presently holding its final briefing to decide on the strike.
Sources told our correspondent that there are very strong indications that the union would call off the strike .

The Nigeria Union of Petroleum and Natural Gas Workers, NUPENG, yesterday said loading of products, including aviation fuel, would stop from today as affiliates of United Labour Congress of Nigeria, ULC, begin an indefinite strike.

Also, electricity workers, on the platform of National Union of Electricity Employees, NUEE, National Association of Aircraft Pilots and Engineers, NAAPE, and National Union of Railway Workers, have also asked members to down tools and join the strike.

However, leaders of the National Union of Banks, Insurance and Financial Employees, NUBIFIE, said members may not effectively join the strike today because the union just concluded its delegates conference weekend, warning, however, that members would fully join should the strike persist.

But the Nigerian Labour Congress, NLC, and Trade Union Congress, TUC, insisted yesterday that the ULC was fake, since it was not recognized by government, and urged Nigerians to ignore the group.

Similarly, the Federal Ministry of Labour also held on to its earlier position that the ULC was not recognized by the Federal Government.

The Presidency, through the Senior Special Assistant to the President on Media and Publicity, Garba Shehu, said last night that the Presidency stands by the Labour Minister’s position that the ULC is not recognised by the Federal Government.

However, leaders of Steel and Engineering Workers of Nigeria, SEWUN, Iron and Steel Senior Staff Association of Nigeria, ISSSAN, National Union of Lottery Agents and Employees,Nigerian Union of Mine Workers, Association of Nigerian Aviation Professionals, Private Telecommunications and Communications Senior Staff Association of Nigeria, Metal Product Senior Staff Association of Nigeria, Fitters Senior Staff Association of Nigeria, National Union of Shop and Distributive Employees and Academic Staff Union of Research Institute, among others, said their members would fully comply with the strike directive by the national leadership of ULC.

Speaking to Vanguard yesterday, Lagos State Chairman of ULC and Lagos zonal chairman of NUPENG, Tokunbo Korodo, said though there was skeletal loading of products weekend, there will be total shut down of all loading activities by members today.

“What that means is that we are not going to load products across the country, including aviation fuel, from today until there is counter directive from the national leaders of our umbrella body, the ULC,’’ he said.

Similarly General Secretary of NAAPE, Ocheme Aba, said members will fully comply with the strike, noting that that the strike would be handled strategically.

“We are not going to confront anybody, but I can assure you that you will definitely feel the impact of the action,” he said.

In the same vein, Delta State Council of ULC has directed all affiliates in the state to immediately commence total withdrawal of services from today, in compliance with the resolutions of national leadership of the labour centre.

Chairman of the council, Comrade Williams Akporeha, said : “We are not deterred but only very worried to hear this sort of comment from respected government officials who allowed undemocratic forces to corrupt and cripple the NLC.

“On behalf of the national leadership of congress, all our members in Delta State are hereby directed to proceed on an indefinite industrial action with immediate effect without fear of intimidation and harassment.

“We shall continue to monitor compliance and effectiveness until the Federal Government meets our demands already sent to the appropriate agents of government.”

No joining issues with Labour minister — ULC boss

Meanwhile, dismissing comments attributed to the Minister of Labour and Employment, Chris Ngige, that ULC has not been registered and is therefore an illegal body, President of ULC, Joe Ajaero, said:  “ULC does not have any intention of joining issues seriously with the Minister or any other persons but the only thing we can tell them is that they should wait till when the strike commences, for action speaks louder than words.

“He (the minister) has unfortunately not realised that we have to save him and his Ministry which he has allowed to be rubbished by interest groups averse to honest engagements in the sector and the freedom of Nigerian workers by this action.

“We are sure that the minister must have been misquoted.We are not surprised. Let it be placed on record that the laws of our land – the Constitution and the Trade Union Act are on our side and fortunately, Ngige holds no judicial powers which he pretends to wield and cannot pontificate on the legality of ULC.

“He cannot be the person saying this because he knows what the law says on this. Nigerians should remember that TUC operated without certificate for 27 years and that was within the ambit of the law and Ngige knows this, unless he is saying this tongue-in-cheek.

We, therefore, pronounce his comments as not only unfortunate but also illegal and should be ignored by all Nigerians.

“This strike on Monday must, therefore, go on, no matter their shenanigans. We must join hands to make it compelling! Don’t allow the ATMs to work, let the banks be closed and let us demonstrate the collective strength of Nigerian workers.

“Let us show once and for all that we can neither be intimidated nor purchased! Let us show them that it is only by meeting our demands that we can back down.”

It will be recalled that the ULC had earlier issued a 14-day ultimatum and and another seven-day notice to the Federal Government over an 11-point demand, threatening a nationwide strike should government fail to address the demands.

The seven-day strike notice which was termed “Final Notice”, expired last Friday. The group is demanding, among others, ‘’that the Federal Government bans the stationing of the soldiers and Policemen  in our workplaces and factory premises.

“This will stop employers who are now colluding with the Army and other security agencies from setting up garrisons in our factories for the purposes of intimidating and harassing workers in order to deny them their rights and privileges.

“The Army and the Police should immediately withdraw their garrisons in the different workplaces where they are currently stationed.

“That the Government should demand that the Federal Ministry of Labour set up a task force immediately to carry out factory inspections as most of our factories are death traps.

An immediate review of the privatization of the Power Holding Company of Nigeria (PHCN) to save Nigerians the agony of suffering under the suffocating darkness which the GENCOs and DISCOs have foisted on the nation.

“The government should immediately prevail on AMCON and Barrister Nwaobike (SAN), the receiver-manager of Delta Steel Company, Ovwian-Aladja, who short-paid workers by 75% to quickly rectify it and repay the deficit.

“The immediate payment of all the arrears of salaries owed Nigerian workers at all levels of Government without exception.

“The Federal government honours its 2009 agreement with university lecturers under the umbrella of ASUU quickly and commence negotiations with them on new issues so that our universities will re-open.

“The roads leading to all the petroleum refineries and depots nationwide be repaired by government to avoid the present carnage of lives, wastage of products and properties on these roads.

“That the proposed Bill at the National Assembly seeking to control free speech couched under the guise of the Bill against hate speech but has the real intention of protecting the ruling elite from being held accountable by the citizenry. We, therefore, demand the discontinuance of that obnoxious Bill by whoever sponsored it.

The withholding of registration certificate of the ULC be stopped and the certificate released forthwith so that the nation’s industrial relations clime will be made more inclusive and robust.

“The immediate inclusion of all representatives of labour in the various committees, agencies and directorates of government and not singling out just one centre for these purposes, negating the tenets of the nation’s laws. Any of such appointments that have been done contrary to this, we demand an immediate reversal.

“The immediate inauguration of the national minimum wage negotiating committee in line with the above so that it can commence sitting instantly.’’

ULC is illegal, says NLC, TUC

Reacting, General Secretary of Nigeria Labour Congress, NLC, Dr. Peter Ozo-Eson, said NLC had made its position known on Friday, adding that its position in asking Nigerians to ignore it as an illegal union subsisted.  The Trade Union Congress, TUC, reacted in a similar manner.

It will be recalled that at a joint briefing in Abuja last Friday, President of NLC and its TUC counterpart, Ayuba Wabba and Bobboi Kaigama respectively, had contended that ULC and its affiliates are fake unions that had not been registered, and will not be registered since all their areas have effective union coverage that were currently affiliates of the NLC and TUC.

They claimed the promoters of ULC are “trying to take advantage of the unstable security and industrial relations situation in the country to increase the tension and give a bad name to trade unionism.”

Efforts to speak with officials of the Federal Ministry of Labour and Employment were unsuccessful as several calls put across to their GSM phones as well as text messages were not answered.

However, the Ministry on Thursday,  through a statement by the Permanent Secretary, Ministry of Labour and Employment, Bolaji Adebiyi, had declared the group illegal, warning that it would not fold its arms and allow an unrecognised group to hold the country hostage.

ULC violating the law — Labour Ministry

The statement read: ‘’The attention of the Federal Minister of Labour and Employment, Senator Chris Nwabueze Ngige has been drawn to several media publications and statements signed by Mr. Didi Adodo on behalf of the association, the United Labour Congress, ULC, as its Secretary-General.

“The statements gave the false impression that this association is a government-recognized federation of trade unions. The statement and letters issued in the last few weeks include those that gave the Federal Government a 14-day ultimatum stating that some trade unions it “claims” as affiliates will go on strike over some issues which are of national importance.

“The issues include that the Federal Ministry of Labour and Employment should set up a task force immediately to carry out factory inspection; that government should review the privatization of Power Holding Company of Nigeria, PHCN, and that the Army and Police should withdraw their men in different work places where they are currently stationed as they intimidate and harass workers in such establishments.

“Also the ULC demands the immediate release of her “registration certificate”. Our immediate reaction is to remind the promoters of this association that they are not yet a Federal Government-recognized Federation of Trade Unions and cannot speak on behalf of any trade union.

“The Trade Unions Act, CAP 14, Laws of the Federation of Nigeria (LFN) 2004, is explicitly clear on how a group of trade unions can coalesce to form a Federation of Trade Unions. Section 35(1)(b) states inter alia:

“A Federation of Trade Unions may be registered by the Registrar if … it is made up of 12 or more Trade Unions, none of which SHALL have been a member of another registered Federation of Trade Unions.”

“The promoters of ULC should fulfill this requirement to qualify to be registered. To call out workers on “essential services” for a national strike without any major trade dispute with their direct employers will be tantamount to blatant violation of our extant labour laws and international labour standards.

“Nigerians know that the Nigeria Labour Congress, NLC, the oldest Federation of Trade Unions in Nigeria, has been factionalised since after her elections in 2014 and the government, through the Ministry of Labour and Employment, had been making efforts to resolve the controversies that arose from the disputed elections. This, to government, is democracy in the practice of trade unionism in Nigeria.

“A group of trade unions is free to ask for registration as a federation if they are dissatisfied with their present federation. However, they must satisfy the conditions precedent of having 12 new trade unions that were not previously affiliates of any of the existing federations. In this case, the Nigeria Labour Congress, NLC, and Trade Union Congress, TUC,

“For the avoidance of doubt, the government will not fold its arms and allow any group of persons take the law into its hands by brazenly threatening to commit economic sabotage by shutting down essential services in the oil and gas, power, and aviation sectors as threatened by the promoters of ULC.

“Members of the trade unions who are sympathetic to the ULC mentioned in the press statement are advised to go about their duties in the interest of a peaceful industrial relations environment and for the good of our national economy.’’

Reacting to the development last night, Senior Special Assistant to the President on Media and Publicity, Malam Garba Shehu, said:  “Our position is that of the Minister. Nobody will disagree with the Minister. Once he has spoken, nobody can contradict him. The Minister is still in-charge.“

Lagos – The Academic Staff Union of Universities ( ASUU) says it is looking forward to a fruitful deliberation with the Federal Government on Monday, Sept 18, in an attempt to end the ongoing strike embarked upon by university lecturers.


The union’s National President, Prof. Biodun Ogunyemi said this in an interview on Sunday in Lagos.

The lecturers in the nation’s universities had on Aug 13 embarked on what they described as comprehensive, total and indefinite strike.
The lecturers are protesting against the non-implementation of 2013 Memorandum of Understanding (MoU) as well as the 2009 agreement they entered into with the Federal government.
“We are going into another round of meeting with representatives of the Federal government tomorrow, Sept. 18.
“We are still on strike. However, we are hoping that we will sort out all the grey areas and hope, too, that the Federal government will show sincerity and commitment on their own part.
“We have done our own part and we expect them too to do their own with all sincerity.
“Should both sides settle whatever issues that have been brought before the house, we will consider putting the crisis behind us and move forward.
“So we are indeed looking forward to a fruitful deliberation tomorrow in order to move forward, for the benefit of all the stakeholders and the nation at large,” the unionist told NAN

The fate of university students now hang in the balance as the Academic Staff Union of Universities (ASUU) has directed its various branches to put on-hold the proposed emergency congress today meant to take final position on the strike.

The various branch congresses were scheduled for Monday to decide on the on going five-week-old strike after the National Executive Council (NEC) in Abuja on Thursday and Friday.

The national body of the union at the weekend sent signals to branch chairmen to put on-hold the proposed meeting thus prolonging the industrial action.

On Wednesday, University of Lagos, Lagos State University, University of Ibadan, Ekiti State University, Ado-Ekiti, Federal University of Technology Akure, Nnamdi Azikiwe University, Awka, Abubakar Tafawa Balewa University, Bauchi and Federal University of Technology Minna voted for continuation of the strike
The following institutions voted for suspension: Olabisi Onabanjo University (OOU) Ago Iwoye, Ogun State, Adekunle Ajasin University, Akungba Akoko, Ondo State, Usmanu Danfodio University, Sokoto and University of Port Harcourt.

Governor Nasir El-Rufai led administration has declared the strike by the Academic Staff Union of Universities, ASUU, as illegal.
The government also said that it will not pay for days lecturers of the state owned university did not work.
El-Rufai’s spokesman, Samuel Aruwan, in a statement lamented the ongoing action, noting that there was no dispute between the government and the striking lecturers.
“The Kaduna State Government is in receipt of communication from the Kaduna State University, KASU branch of ASUU, confirming that the branch has joined the nationwide strike because they are full members of the national union”, he said.
“This is unacceptable to the state government. It is an anomaly that employees can be on strike without declaring a dispute with their employer.
“It bears restating that Nigeria is a federation of states, and no trade union can alter this federal reality by imposing on an employer state government the terms that federal employees have agreed with the Federal Government.
“The Kaduna State Government is not affected, or bound by any dispute, disagreement or agreement ASUU may have with the Federal Government. As a sub-national entity, the Kaduna State Government is separate from the Federal Government of Nigeria. The Constitution of Nigeria clearly attests to this.
“It is the considered view of the Kaduna State Government that the KASU branch of ASUU has embarked on an unlawful strike. Therefore, the Kaduna State Government is not liable for salaries and allowances for the period of the unlawful strike.
“The government shall proceed to initiate the necessary disciplinary steps in accordance with Kaduna State Public Service Rules with respect to the individual acts of commission or omission of those that choose to join or persist in an unlawful strike”, the statement added.
