Was exaggerating when I said "smashing his phone". But the point is that the man was clearly invading another person's privacy. No crime in recording a person in public, but you have to keep a reasonable distance. That man was literally in Aregbe's face and following him around.
You do not understand the legal concept of privacy. There is nothing like privacy in public places. Again when you are saying "he was clearly ......" that is bias.
Nothing is clear. You are just forming an opinion.
My opinion is that his behaviour was annoying and obnoxious period.
You say following him around. really? Was the distance reasonable ? That is debatable. It depends on the context. When people queue up behind you, you cannot dictate how much distance there should be between you and reasonable distance depends on context etc. Even on crowded trains buses etc people touch each other . There is no legal definition and arm's length is reasonable. I mention arm's length because when Aregbesola moved close to block the recording he did not touch the camera
However the nature of the encounter is changed by one fact. Aregbesola INVITED the man to sit with him.. Did he withdraw the invitation?

That doesn't change the fact that the guy does not have the right to record aregbesola without permission, Nigerian are our own problem ! Why would you disgrace and publicly disrespect a minister representing your own country just to chase clout on social media and then we ask why other countries don't respect us? This Is a big shame!

He had every right to record him without permission. No one in America that isn’t Nigerian knows who this politician is and if he doesn’t want to be disgraced or publicly disrespected then he should act in a manner that commands respect from constituents. Any Nigerian has every right to be angry at Nigerian politicians.

Nigerians deserve their leaders. I didn't see an invasion of private space here. Aregbesola is a public minister in my country Nigeria, I have every right to record him in public spaces. It isn't a big deal here and not an infringement of right. I wish he broke the guy's phone as some of you suggested, baba will vomit sma of the Nigerian money he had stolen. Awon mad people. We are here, sweating our butts out in strange lands because fools like these and their supporters will keep dragging Nigeria backward. We should harrass these corrupt leaders wherever we see them lipsrsealed lipsrsealed
no, if he withdraws consent, then you have no right to record him, and post it on the media. The key is that he withdrew consenst. This hold if the camera is directly aimed at capturing his face.

Consent cannot be withdrawn from a video recorded in a public space because consent isn’t required in order to record it.

Yes. It’s doubtful that the person recording would ever be arrested because he committed no crime however the person who smashes the phone will be treated as the criminal.

You guys keep trying to put conditions on the law. “Acting Provocatively” is subjective.

My brother there is limit to freedom, you can't invade on someone's privacy and you are claiming is permitted, that is why fans of sport men or celebrities always ask for permission to take photos with them, even if they take photos without the persons consent, they do it politely not in a stupid way.

Hmmm.... upworkwriter! Bro .... how many more people have to tell you consent for filming is not needed to record anyone in a public space?.... whole person... feet... hands.... face....doesn't matter. Consent is no key. Shut up! There’s no harassment there because you don’t know how pissed most of us are about Nigerian politicians who mess up our Country.
If you want to express your piss"ment", do it in your own country not in a neutral ground. You're harassing him in America because it's America. If he harasses you in Nigeria because it's Nigeria then don't complain.

In Nigeria but not in the US. If you’re in a public space then others have the right to record and/or photograph you without permission. Joe Biden is recorded without his permission almost daily.

Because of where you live, especially since it contains many movie sets, actors, athletes, and celebrities, I laugh at how familiar you probably are with this type of situation.

Stop arguing with those illiterates. They don't deserve your time. I hate Nigerian politicians with passion and I'm not even a fan of aregbe but this was to extreme, he asked you to stop recording him, you continued, he offered you a sit , you said no blabbing with fake accent that this is America. Public recording may be allowed fine but it should be done reasonably without causing nuisance. The moment aregbe several times asked him to stop and he continued then it was becoming something else.

In Nigeria. Not in America. Presidents, governors, actors, athletes, policemen, and everyone else are constantly being recorded in public and the people recording them are at liberty to do so. A politician from another country isn’t immune to the law of the land.

Mr Man , kindly shut up and keep quiet. The moment you are recording someone in public , straight into his face for that matter and he asked you to stop yet you refused, you're already constituting public nuisance and harassing him . Recording is permitted but it should be done reasonably without the intent to bully or harass the second party (which he did). He simply bullied and harassed aregbesola. If you're recording someone , he noticed it and he asked you to stop then you refused, then you're already breaching is privacy. He can sue you on many grounds.

He dey America dey form this is America with fake accent. Let him try it with someone in the streets of Brownsville or Chicago and see if he won't be shot dead. Very irritating human.

I’m a woman and don’t you ever approach me in such a disrespectful manner. In fact, do not engage me at all.
I’m not boasting but I have a law degree and practice in the US and here you are, attempting to educate me on US law, something you know NOTHING about. He can’t sue him for a damned thing. Do yourself a favor a find someone else who will entertain your fugazi logic and antics. And it’s BRONZEVILLE, not BROWNSVILLE. Two different cities, two different states yet you know everything.

Go and throw away your law degree, you know nothing. Infact you'll make a very poor judge because of your sentiments.

Fact is if aregbesola wasn't a politician y'all hate, if he was a neutral citizen, I'm sure you must have supported him that the other dude was indeed breaching his privacy since he asked him to stop.
But because it's aregbesola, a Nigerian politician you hate and have scores to settle with (if he even knows you exists) then it's fine to record him right?

You can record but you have absolutely no right to put your camera in anyone's face, even in public. There's a fine line between recording and harassing someone.

To those saying the young man should’ve sat and asked him questions in a reasonable manner, I ask you this:if the politician was in Nigeria and the guy would’ve approached him reasonably seeking answers and explanations, do you think the politician would’ve treated him with respect and entertained his questions/concerns?
I doubt it. From the outside looking in, Nigerian politicians appear to have a culture of treating their constituents as their subjects, making themselves unapproachable unless it’s election time. Once again, they work for the people, not the other way around.
This is what I'm telling you, you're just being too sentimental because a Nigerian politician is involved. If this is what you're saying then nobody has a decision right? You're doing something to me which I don't like , I asked you to stop and go away, and you still continue . Then it's fine right? It's not breach of privacy coz it's a public space? Meaning my own decision on what you're doing to me is meaningless and holds no weight?

Typical Nigerian, resorting to insults when they are challenged and their fallacies are rejected by others.
I didn’t even know who the politician before this story so stop it. No one except Nigerians know who this man is. I have no scores to settle with him because I was born in America and his actions don’t sweeten my tea. Under US law, his privacy wasn’t breached. He won’t even attempt to sue because he knows the shit he gets away with in Nigeria will not fly on US soil.
Now run along and argue with someone that you can convince because I am not the one. Refrain from attempting to engage me.

The law is simple
Anything that is in public which I can "record" with my eyes I can record with my phone.

If I can see you I can record you.

If I can see you it is a public place and so talking about "Privacy" is moot

So the question is
What is a public place as defined by law?.

That is why we were able to get the video of the police killing leading to the black lives matter issue

Even the police cannot tell you not to film them

Once you step out of your house you can be filmed
