I don't know yet how this will play out. I'm hoping that wait times will be shortened. But, the wait times aren't just for Nigeria; they're worldwide. So the fact that Nigeria will no longer participate in the DV program may not have an effect upon priority dates.

The effect it will have: When NVC contacts me and says "We have 200 family-based cases if you can schedule them in November," I can say, "Yes, let's schedule them" instead of "I'm sorry, we're completely booked in November due to Diversity Visas." We'll be able to schedule more fiance cases every day, too! It's going to be awesome. smiley

1) I'm very concerned about the ten year wait period cos that's a long time plus the fear of my niv visa not being renewed pending the outcome of my petition.i know a couple of people that have been denied visas cos of a pending petition even though they had made previous us trips. What's the reason for d denial and how do I guard against it?

2) who would you advice to file for me, my mum or sister?

3) as much as we don't pray to lose loved ones, what happens if the petitioner dies in the process?

I solicit your response to assist someone very close......... Mr A got married to Mrs A in 2003 was selected in 2003 for DV 2004, at there interview in 2004 wit their marriage certificate from d registry and photo album... they were refused visas wit d remark "your original DV lottery was not properly filled in comformance with the rules and regulations of the DV program, and is therefore disqualified.You are not eligibile to participate in the dv-2004 program"....note dat mr A was d principal applicant..sadly, they have been separated for some years but yet to divorce officially... ..miss B intends applying for a US Visa, would it be discoverd that she was there 9yrs ago on a DV visa ...can dis jeorpadise her chances as she wishes to apply as an unmarried woman...or does she have to quote the DV2004 application which they were denied...since she doesn't want to bear Mr A's name, so can she use her maiden name?...also she hasn't had any US visa application since the DV2004 encounter...I look forward to ur sincere response,...thanks and stay good.

What will jeopardize her chances is if she attempts to hide her prior visa application, as her photo and fingerprints are certainly in our computer system. She should use the name that appears on her passport, and be prepared to explain that she is separated but not yet divorced.

Sounds like it, yes, sir. But how are you applying for the 2015 lottery? Nigerians will not be eligible in 2015.

Please my visa was approved last week Wednesday and i was asked by the consular officer at the end of my interview to pick up my K1 visa at the collection center today in VI, but i got there and was told it wasn't there yet but i should check back by Friday hopefully,My fiance called the consulate today was told i check back same friday too sad hopefully please i would require your assistance if possible for an expedited process because my flight has been scheduled for this weekend sad ... You are my last hope for a positive outcome on this after God.

No one should ever buy a ticket before the visa has been issued and handed over. All sorts of things can delay printing. It's possible that new information has come to light, or that there is some sort of technical difficulty keeping your case from being printed. Without knowing the details of your case, I can't tell you if we will be able to issue the visa quickly or not.

1. There are many reasons for denials and I really can't tell you, based on the information you've shared, how I think things would go in your case. We often issue non-immigrant visas to people with pending immigrant petitions, as long as we believe they will abide by the terms of the visa. Every case is different.

2. It's faster if your mother files for you.

3. Unfortunately, when a petitioner passes away, the petition is usually rendered invalid. There are a very few exceptions but none that would apply in this case. Here's hoping no one reading this ever has to confront that situation. If your mother and sister have the financial means, I suppose each of them could file an I-130 for you; that way, if, heaven forbid, one of the petitions become invalid, the other would still be active.

@VO welldone good work here..pls my problem is this : an agent register for me he change my DOB to 28/06/1989 and my Real DOB is 04/02/1988 and this is what is in my SSCE .... But now i want to do my passport which DOB should i use .... Thanks

Good Job so far VO. Please I want your advice on this; my son is an american citizen but he's still a baby. Our intentions is for him to go back to the US when he's ready to start a prep school and at least I will like the mother to be able to stay with him over there to cater for his needs. In my opinion, I don't think she can do that with a non-immigrant visa. What in your opinion do you suggest we can do to achieve this? Anything you advice is alright by me. Thank you so much.

If an NPC birth certificate is available, that is what you should bring.

Use your real DOB! You can explain what happened with the agent, but you would have a hard time explaining why you procured a passport with an incorrect date of birth.

Unfortunately, there's no visa category for mothers who want to stay in the U.S. while their sons are in school. She could apply for a non-immigrant visa and plan to visit him frequently, but I don't believe there's a way to accommodate the plan you currently have.

Dear VO, appreciate your good work here. I have a question. I am married, I did the wedding in a church where I was issued a wedding certificate. It's the official certificate from the Federal Republic of Nigeria. The issue here is that, I have seen other wedding certificates from friends which is also the same with mine, but mine does not have a stamp from the court, because they did court marriage. Is mine valid? Although, my spouse and I have every prove and can convincingly defend our relationship as a bonafide one. I am just worried that mine doesn't carry stamp. What do you think? Thanks.

Getting a CERTIFICATE OF CLEARANCE (COC)

Hi

I am Dilan from Sri Lanka and i have applied for Diversity Visa Program 2014 and i got a confirmation saying that i have been randomly selected for further processing in the Diversity Immigrant Visa Program for the fiscal year 2014 (October 1, 2013 to September 30, 2014).

and i went through the instruction and found out that , if i had been in another country more than six month , i should have to get CERTIFICATE OF CLEARANCE (COC) from that country.
and i had been in Singapore more than six month and i went there website to see how to get a COC. but i found out that they only issue it to CITIZENS OF SINGAPORE. and also they need a documentary of proof? please can some one tell me what to do

"SINGAPORE POLICE FORCE CERTIFICATE OF CLEARANCE (COC)
Certificate of Clearance (COC) is issued by the Criminal Investigation Department of Singapore Police Force to CITIZENS OF SINGAPORE to certify that a person has no criminal conviction in Singapore. Applicant must show documentary proof from the relevant consulate/immigration authority/government authority which clearly indicates that the production of the COC is required. All applicants must pay attention to the following application procedure and documentation requirements: "

No VO she is a new applicant for graduate studies.and when she visited the embassy on monday with her husband,she was told that the documents she submitted for verification has been termed as fake until proven otherwise hence the administrative processing.she's really worried since the dv 2013 season has ended and wonders what her future chances are with respect to her education plans

You should file form I-485 to adjust your status while in the U.S. Here's the information from USCIS:

The Immigration and Nationality Act (INA) permits the change of an individual's immigration status while in the United States from nonimmigrant or parolee (temporary) to immigrant (permanent) if the individual was inspected and admitted or paroled into the United States and is able to meet all required qualifications for a green card (permanent residence) in a particular category. The common term for a change to permanent status is “adjustment of status.”

Depending on the category you wish to adjust under, you may be eligible to have the petition filed at the same time that you file your Form I-485, Application to Register Permanent Residence or Adjust Status. This is called “concurrent filing.” Immediate relatives of a U.S. citizen may be able to file concurrently. Also, other certain classes of individuals who have a visa immediately available may be able to file concurrently. Most categories, however, require that you first establish your eligibility for the immigrant category by having an approved petition before you are allowed to file Form I-485, for these categories you will not be able to file concurrently.

The lack of a stamp will make us ask more questions, but as long as the relationship itself is genuine and you're really married, there won't be any problem.

You can get a COC from Singapore even if you're not a citizen. Take a look at the instructions at http://travel.state.gov/visa/fees/fees_5455.html?cid=9732 .

Well, if we believe she submitted fake educational documents, she may face a challenge in qualifying for a student visa. She will need to be prepared to explain herself very well to the interviewing officer.

It sounds like it might be a scam. No one can give you a visa without putting it into your actual passport, and you shouldn't be able to get a visa at all without walking into an Embassy or Consulate yourself with your passport in your hand. I advise you to Google the name of the recruitment agency and the word "scam" to see what comes up.

Greetings! Do I recall correctly that your wife is the one who filed for you? If so, and if your wife is an LPR and filed before September 8, 2013, or if she's an American citizen, your case is current.
