Court Bars NDLEA, Others From Arresting Kashamu by DhimxyMaxwell(m): 12:23pm On May 27, 2015 |
A Federal High Court in Lagos on Wednesday restrained security agencies in Nigeria from arresting and transporting the Senator-elect for Ogun East Senatorial District, Mr. Buruji Kashamu, to the United States to stand trial on drug- trafficking offences. Justice Okon Abang, in a judgement on Wednesday, declared as illegal, the arrest and extradition of Kashamu in relation to drug-trafficking allegations from which he had been exonerated by two British courts. Abang granted Kashamu’s prayer that having earlier obtained a judgment in Nigeria in January 2014 barring his arrest and extradition and the judgment having not been set aside, he could not be arrested and extradited. The judge awarded a cost in the sum of N20,000 against the National Drug Law Enforcement Agency, the Attorney General of the Federation, the National Security Adviser to the President, and the Nigeria Security and Civil Defence Corps. www.punchng.com/news/court-bars-ndlea-others-from-arresting-kashamu/ |

Ok, good for him... The NDLEA should however have mentioned the case of James Ibori who was cleared on all counts of money laundering in Nigeria, but later pleaded guilty to a court in The UK 1 Like |

socialmediaman:You didn't see this paragraph below from the article/judgement. Justice Okon Abang, in a judgement on Wednesday, declared as illegal, the arrest and extradition of Kashamu in relation to drug-trafficking allegations from which he had been exonerated by two British courts. |

IsraeliAIRFORCE: I saw the paragraph, he was exonerated in Britain but the US has new evidence that he deceived the UK courts, which is a valid reason to order a retrial. In the case of James Ibori, he deceived or bribed the Nigerian courts and was exonerated, but was later found guilty in a UK court, the UK judge completely ignoring the Nigerian courts because they believed Ibori may have tricked his way to avert Justice in Nigeria |

socialmediaman: The Americans should come to Nigeria and present this "new evidence" of theirs to our court. If the trial judge founds it worthy and convincing, am sure the extradition request will be granted. |

seunmsg: The U.S. has an extradition treaty with Nigeria. The crime was committed in the US, not Nigeria, he committed no crime in Nigeria that the law knows about |

socialmediaman: Extradition treaty or not, you can not extradite a Nigerian citizen without a court in Nigeria sanctioning it. The country requesting for the extradition must prove to the court beyond reasonable doubt that the said person has a case to answer in there country. In any case, a federal high court already ruled that arresting and extraditing Kashamu is illegal. NDLEA and other security agencies involved should simply respect the decision of the court of appeal the judgement if they are not satisfied. |

seunmsg: They'll appeal the case, no doubt. He might be suspended from the senate also pending the outcome of the case |
Re: Court Bars NDLEA, Others From Arresting Kashamu by seunmsg(m): 1:58pm On May 27, 2015 |
socialmediaman: Suspended from the senate for what offence? Kashamu has never been found guilty of any offence whether in Nigeria, the UK or US. So, why should he suspended? He won a competitive election and he will represent his people in the senate until a court decide otherwise. We ready need to purge ourselves of this jungle justice mentality. |
Re: Court Bars NDLEA, Others From Arresting Kashamu by socialmediaman: 2:07pm On May 27, 2015 |
seunmsg: No, this is not jungle Justice, in a normal situation, when someone is under investigation for a criminal case, he might be suspended, though in the case of Senate under David Mark, these practices were shielded, but if the NDLEA furnishes the senate with evidence regarding his ordeals with the court in Illinois, the senate might suspend him so as to prevent him from influencing his own case as a political office holder |
