He already has a N/Delta man as his NNPC GMD and doubles him as Minister of State for Petroleum.


I suspect the reason some people want this Petroleum Minister by all means is that they are trying to cover-up somethings in that Ministry, which will be impossible without a supervising Minister ... or when that portfolio is on Buhari's table.

The onus of proof is on u to provide the constitutional sections that grants him the power's of appointing himself a minister.

While u are on it, you can self educate yourself with these sections of the constitution:
Sec 138, Sec 147 (2), Sec 149 and if you don't like what is written on those sections, u are absolutely free to erase those sections from ur own personal copy of the constitution.

Furthermore they can't seem to have the ability to read and understand the Nigerian constitution and can only read meanings to sections of the constitution that has no bearing whatsoever to the topic under discussion.

Please read section chapter 1, part 2, subsection 5(1) which states :-
5. (1) Subject to the provisions of this Constitution, the executive powers of the Federation:
It means that the president will exercise his executive powers as stipulated by the constitution and not according to his own desires/wishes that is why it states " Subject to the provisions of this constitution".


(a) shall be vested in the President and may subject as aforesaid and to the provisions of any law made by the National Assembly,
This also means that executive powers are vested on the president which must be in accordance with the provisions of the laws made by the National Assembly and not the ones he appropriates to himself.

I'm sure they were reading their books and other books (including the Nigerian Constitution) when they came across this. I'll suggest you do the same, the Nigerian Constitution is free online, you can download it and read for yourself.

Obj never appointed any minister of petroleum neither did he at any time appointed himself as the Minister of petroleum rather the Group managing directors of NNPC played those roles while reporting directly to OBJ that was why the then National Assembly couldn't do anything about it because he exercised his discretionary powers by not Making any ministerial appointment on that sector but he delegated some responsibilities of that sector to the Group MD's of NNPC which was still within the framework of the law.

NL resident Touts like you just dabble into issues that are way to complex for your stupidity infested brain tissues and when you get schooled you resort to writing gibberish rather than learning.

The problem with Buhari was his choice of word by saying he will be the minister of petroleum which is alien to the constitution but it is within his executive powers not to appoint a minister in any sector and can also delegate over-site functions on any sector which is exactly what obj did.

It means the executive powers of the Federation is vested in the president and he can exercise such powers directly or though the Vice - president and ministers or other public officers appointed by the president.

Now let me tell you my understanding of Sec 138, Sec 147 (2), Sec 149 of the Nigerian constitution;

It simply means the President cannot hold the office of the President (which is chief executive of all executive positions) with another executive position (especially a paid one). It does not mean he cannot be president of OAU or ECOWAS.

I am really ashamed at the kinds of comments on this forum. It seems they are only inspired by resentment of the Ijaw groups rather than by any logic in response to the group's demands. Nigeria may never move forward if we continue to treat national issues purely out of ethnic or partisan sentiments.

I expect commenters to question the correctness of the claim of these groups: if the constitution actually says the president may not hold another office, why can't we ask him to abide by the constitution? If these guys are misquoting the constitution then we must correct them.

We forget also that this is a democracy. People have a right to air their views. Insulting people for airing their constitutional views is a very primitive act and we need to desist from it.

when you see evil condemn it. A president seeking to control oil revenues in Nigeria is evil. Nigeria is not Brunei. Nigeria is a democracy but Buhari seems to still take Nigeria as an emirate, with he president as the emir. Obasanjo succeeded in doing that because Nigerians were just emerging from long years of military dictatorship.

If there is any Ministry Buhari is needed to assume its headship, it is the Ministry of Defense - given the menace of Boko. But the constitution does not allow Buhari to have any other job except being president of Nigeria.

But if Buhari has common sense, he would not have sounded the idea of being petroleum minister - given that he ousted Jonathan from the Nigerdelta as president and has been tormenting Diezani also from the Nigerdelta. Does Buhari want to show that he is a conqueror of Nigerdelta? Does he not know that people must see him as being very arrogant?
