Hello,
Pls come to my aid.
My Mum died in 2009 and she has money in Skye bank.
Before she began the sickness that eventually led to her death I remember vividly that she sent me to deposit #50000 for her.
Since her demise none of us talked about it until very recently when the four of us met during Christmas.
We are sure she has money there, but we don't know her account details except the account name which is certainly her full name.

I was told if an account is not used for six years, it will be blocked.
Please is there a way we can get her account number, and the balance of the account. also what are the requirements to collect the money.
Thanks.

The bank would not release any confidential information to a third party and in this case you're a third party.

There are ways you can get the account number but I won't go into that detail here.. .just apply street smart sense. If you're lucky, you could also get the balance from that account.

The bank can't touch your money until I think 10-15 years or even more. In fact, if am correct they are now required to remit that money to the CBN. Can't say though.

If you guys - the estate - haven't obtained Letters of Administration from the High Court, now is the time and please state all estates your had, even if you remember the 'flesh' without the details, just state it.

But if you already have it just go back to the high court and do a corrigendum to add this new discovery and then head to the Bank. The bank will take it from there.

Big lie! all you need to do is prove that your mother is dead, as it is the account I dormant. You now need a lawyer to do the legal details. If you are the next of kin, it makes the job easier, otherwise you need some other details which only a lawyer can do.
Talking about lawyers now, you only need a young lawyer to do this, it is not a too technical or detailed job. So with this you can negotiate a good price
In this case, you and your lawyer needs to be very careful as not to present to the bank you are totally naive of the amount in your mum's account- I cannot couch for the level of ethics and professionalism of the bank.
You will also need to ensure you collect transaction statement of the account to confirm at least ni withdrawal after her death.
All withdrawal close to the time of death should be closely monitored and investigated with full details
Penny wise pounds foolish mate. You know how much it will cost to hire a lawyer? For just 50k.? Let him just forget it.

Re: Help, My Late Mum's Money Is Stuck In Bank by bikefab(m): 8:11pm On Jan 11, 2017
Its quite simple. Get her certificate of death, u can get it from the local government area. Where u reside, head to a magistrate court and get a letter of administration. These two documents can be gotten at a token fee. Head to the bank with them and they'll give u some forms to fill, it signals the closure of that account. Thank me later with a #1500 airtime. Goodluck and may her soul rest in peace.

U can get it quite alright if u can go thru d process. Get a lawyer or go to Arbitration section of Local Govt. U need a particular letter from the Government which wl empower u to have access to the money. The process seems cumbersome bt wt such money like this it Worth's it.Make that move

If there is no co-signatory to the account, you guys have to submit some documents to retrieve the funds but it's possible to get the money back

After obtaining the probate letter,in which u have been assigned as the next of kin, attach the death and take it to the bank branch where your mum has an account.
you will be asked to come back in a few days for them to confirm the authenticity.
After that they are obliged by law to give u details of the account

Pls don't approach the bank without facts, if you have a church member or a close relative that works in that bank who can give you details of that account including your late mums next of kin to that account, that will be better. Even if the account is dormant, it will cost you #500 and your utility bill to activate it. The Bank will require her certificate of death or any tangible proof of her death.

Go to any high court nearest to you. Ask of propate dept. Go there and lay ur complain, they will issue you a letter of administration which U will use to get ur mums bank details and account balance. But bear it in mind that it will take U above one year b4 U can finish the processing. If the amount is less than 50k I will advice U to leave it for them bcs the process will cost U above that. Sorry for the death of ur mum

My condolences over the death of your mum. Since you don't have the account number, go to the bank with the full names which you have. Remember to ask for the branch where the account was opened. This is necessary because an account can only be closed by the branch that opened it. Once the account number is given to you, proceed with her death certificate and family resolution letter to the high court for a letter of administration to be drawn up. The court will give you a cover note, authorizing the bank to disclose the account balance to them and to you. With the certified bank balance, the court will prepare and serve a letter of administration to the bank after collecting 10% of the account balance. This amount, you pay upfront, before they serve the bank.
Once the bank receives the letter of administration, they will conduct a search on it. This is to certify its authenticity. Once the report comes back authentic, the bank will notify you and you have to complete an indemnity form. Completing this form means, you cannot hold the bank liable for any wahala that might arise after the letter of administration has been executed. The bank charges between 5k to 11k for search, depending on the bank. This amount is debited from the account. After executing the indemnity process, you will have to provide the bank with a photocopy of a valid means of identity (any of driver's license, voters card, international passport or national ID card). Where you do not have any of the following, get someone who has, so that he/she can complete the bank's 3rd party identification form. Also, go along with a passport photograph.
Once, they will raise the necessary banking entries, pay you and close the account. This is just a rough idea of what to expect before you can claim the money. However, if at the first approach and the bank refuses to give you the account number upon presentation of the name, please employ the services of a lawyer. Also note that, probate matter na plenty money matter so if the amount you are pursuing is less than 150k, please think carefully before you embark as you are bound to encounter court, lawyer and bank bottlenecks
Cheers and all the best.

first of all, you are in Nigeria therefore follow it with wisdom. is likely you won't get anything if you go to the bank with a name with an explanation that the bank will provide you with account number that carries the name, hence first use an insider to get the account number then find out the status of the the account before you approach the bank officially.
with the insider, you could get to know the next of kin to the account and the actual name(your popular name maybe Nkechi while your mom used Zeinab, your village name to tag you as her next of kin) of the next of kin.

If the account is domiciled in Ibadan, reach me on 08182106124 to help you with the court process of recovering the money but if it is in Lagos, you can still call me to link u up with some Lagos lawyers who will not charge you much. Sorry dear, but dat money is a gonner. The a/c is probably dormant now

Account been dormant does not mean that the money has gone. In fact you can pay in money into a dormant account but you can't withdraw money from a dormant account unless you reactivate it and to do this, it will cost you #500 and your utility bill and the account will bounce back to life.

OP you don't need any lawyer, what you need is death certificate then take it to magistrate court obtain a letter of administration take it ot the bank, you will also give a copy of the death certificate to the bank, the bank will write to the balance in the account and details to the bank the the court will write agains to the bank demanding the money, the bank will then issue a draft in favour of the court, the the court will share the money base on your mother will if nonne according to law governing inheritance among her family.

Don't mind those saying the money is too small for the wahala, I bet you can 80% of it that is 40k, the only charges are by bank which no more than 2k and the court may charge you 10% or 5% of the amount.

Am a retired banker

Hope this helps

What is the best practice for this situation in saner climes? In, say the USA or Europe for instance?

We all know that Nigeria is a hopeless jungle, but what happens elsewhere in this kind of circumstance?

Very correct.
Well to add to it, the court will after you have filed the above stated docs issue an order to the bank asking for details of the account, statement of the account. Based on this, Withholding tax will be caculated and you would need to pay the WHT upfront to the court. Then you would be given a final order to go and claim the funds from the bank.
