Good evening. I want to say u r doing a good job here. I’m new here and I need help and advice.
I bought a Plot of land from Adron homes through their installment payment plan. I was told by my marketer then that if I buy for investment purpose, when I need the money, they will get a buyer and sell at the current price and remove their cut. Now that I need my money I am being told that I will have to get a buyer myself. My marketer has left the company so I’m on my own. I was told that if I request for a refund, I will lose 20%. Please advice me on what to do so I do not lose out.

Question 1 have you finished the payment?
I manage a branch of DPKAY HOMES AND PROPERTY LIMITED. my branch is at the trade fair complex in case you want to see me face to face. But I digress, what I suspect here is that you were not given the full/true picture when the person sold you the land.

Whatever the purpose you buy the land for, it is not compulsory that adron should sell the land for you. You can sell the land by yourself..when you get a buyer all you need to do is take your buyer to adron, submit any copies of your land titles, then adron should do a new deed of assignment for the new buyer. This is as simple as I can make it. Given that I don't want to type for a long time. Go back to adron and ask what is their procedure for transfer of ownership. That will guide you. You will still pay to have new title documents drawn up for the new owner. That is if you sell by yourself.

Adron could sell for you, u don't have to stress to look for buyer but you will have to take a hit on the price. Lose some percentage to pay for their help and office logistics.

I hope this is clear enough. You will not totally lose out sha. Remember my first question have you finished paying for the Land?

Hi I spoke with the in house lawyer of DPKAY HOMES AND PROPERTY and I got the following info for you:

1. Anyone that has a lease hold is most likely NOT THE OWNER OF THAT PROPERTY.
2. Someone who is not the owner cannot sell you property.
3.if you buy, you are on your own.
It is likely to be bad market..please exercise caution.

I still advise proceed with caution. Better still involve a lawyer. Omonile lawyer that started this thread is a good start. But as an estate person, my advice is this: document all your communication. Send an offer letter to those who want to sell you the property. That letter must state details of the transaction like property location. State of the title, any commissions, percentages, sharing formulas make sure its stated in black and white.. Let them also reply you with letters o. These are your evidences in case you have to go to court for any reason. Make sure your communication is written as much as possible. Don't say its my friend/uncle/ brother. Do the needful. Like I always say I am just a humble marketer...see your lawyer for legal advicr

1. Dear married couples, there is no such legal personality known as "Mr and Mrs Okoro". You can only have "Mr Kenneth Okoro" or "Mrs Patricia Okoro". You might just be creating a legal problem for yourselves when you use "Mr and Mrs Okoro" to buy those goods or properties.

2. Dear married couples (especially those who are married under the Act), all things been equal, it is adviced that you change your next of kin to your spouse after wedding from your sibling or anybody else you used before wedding. Making your spouse your next of kin makes it easier for them to process any accrued benefit especially if either of you die intestate ( without leaving a will).

3. Dear intending couples, there are only two types of marriages recognised in Nigeria; 1.Marriage under the Act (Matrimonial Causes Act and Marriage Act), 2. Marriage not under the Act (Marriage under Islamic Law and Marriage Under Customary Law). The first is monogamous in nature while the latter is restricted polygamous and unrestricted polygamous in nature. For intending couples of the christian faith, there is no such thing as "church wedding". If your church is a "licensed place of worship", what they conduct there is a "Marriage under the Act". If your church is not a licensed place of worship and you only conducted customary marriage without going to the marriage registry, what they would have done in your church may just be a celebration and the blessing of your customary marriage.
If your church is a licensed place of worship, wedding in church and also going to the marriage regisrty are one and the same thing (Marriage Under the Act). Meaning a waste of resources and duplicity of purpose.

4. Dear Boyfriend and Girlfriend, promising your partner that you would marry them when you know you have no intention of doing so may give rise to a civil action of breach of promise to marry resulting in damages (compensation) and the restitution of all monies spent and gift given. It may also give rise to a criminal action of obtaining by false pretence.

In Nigeria, one of the means by which a person can get a proper title to land is by obtaining Governor’s consent in respect of the land. The Land Use Act is the statute which regulates land and any transaction relating to it in Nigeria.

Section 22 of the Act provides that “it shall not be lawful for the holder of a statutory right of occupancy granted by the Governor to alienate his right of occupancy or any part thereof by assignment, mortgage, transfer of possession, sublease or otherwise howsoever without the earlier consent of the Governor first obtained. Usually, it is the duty of the holder of the right of occupancy to get the consent, but in practice this is left to the buyer. In Lagos, Nigeria, the country’s commercial nerve center, this practice has been embraced over the years. A burden usually conveniently passed to the buyer.


Obtaining Governor’s consent is a way of complying with the provisions of the statute and a way of protecting the legitimacy of the purchaser’s title to the land. Failure to get this consent can make the transfer of interest in the land null and void.


In conclusion, when the Governor’s consent is duly obtained by the seller after a transaction, it will serve two main purposes; as evidence of ownership, and there will also be security of his title.

Remember, that Governor's consent is not necessary in a situation where the land is not situated in urban areas. If it is in rural environment, the consent of the Local government is essential.

Hi Everyone! 2009 and 2010 was great for so many reasons because i made people finally realise they have the power to determine how they buy property before throwing away their hard earned money. Personally i feel very very fulfilled that i did my best to help a lot of Nairalanders search properties and recommend the ones that are valid and the ones that have so many hidden problems that by the time you purchase it, you end up having more headaches than when you previously didnt buy any land. I was doing my calculation yesterday and i realised i have turned down almost N165Million worth of properties that were advertised to be sold to intending purchasers that had so many hidden scruples that the agents and omoniles wont tell you till you commit your money and then its from frying pan to fire. smiley

For the avoidance of doubt for First Time Property/Land Buyers or New Nairaland Property Viewers and Readers  who dont know what a property search is, it means before you buy any land or property whatso ever in any form or shape where ever, you have to know the validity of it.

Lagos in particular is so notorious when it comes to sale of property or land that have so many fraudulent defects surrounding that land/ property that you wont even know what has hit you. These set of people are known as the Omoniles, land grabbers or land touts.

Omoniles naturally should mean owners of the original land which includes the original family that truthfully inherited the property from their fore fathers that has passed down to them. But the real problem comes when there are so many members of the family that are divided in terms of claiming ownership of the lands and how the land truthfully devolved to them. Before you know it, a property that is meant to be shared by a family of 3 to claim ownership is now being contested by the brother in law, the aunty, the great grand uncle relatives etc and thats when they begin to employ touts going around to masquerade as the original owners with the right to sell and after you fall victim of their sweet tongues and coercion, you realise that you bought from the wrong family or the wrong set of people who have no right to sell the land to you and you would be confronted by the original owners  when you have started building half way and forced to cough out another payment to the real owners or be thrown out of the land. Trust me this scourge is very very real and 65% of lands in lagos have this problem one way or the other.

The other way your being decieved is by telling you the genuiness of the property comes from a set of documents. Those set of documents include either a survey plan, a deed of assignment, a certificate of occupancy, government allocation letter, government gazette or governors consent.

They will show you all manners of papers to make you believe them instantly and start pointing to different houses around there that has been built by one commissioner or one Minister or one big man and that their houses are still standing without any government wahala. What they want you to do is to instantly believe them and pay money to them immediately. One thing you can be rest assured is that, once you pay money to an Omonile, you will never ever ever get a refund of that money. Its gone and in some cases its in your front they will start sharing the money.

Dont ever ever fall for that trick. Always demand for what ever documents they have. I will point out the importance of each document to know the relevance of it and why it shouldn't be taken for granted.

First, congrats on getting a genuine land. Now if you are surely sure, when you purchase your land, you for starters you should get a contract of sale and a deed of assignment. These documents mean that the land has been sold to you, and any title to the land has been assigned to you (I don't know what title the previous owner had). A lawyer should guide you through .This deed transfers all the pervious owners rights to you. As soon as you do that, go back to the abuja land registry/AGIS quickly and begin the process of registering the land in your name (find someone to show the step by step until its complete) The earlier, the better and will definitely help secure your land and prevent sales to multiple buyers.
