You need to understand the origin of the agreement, remember he sent Mohd Abacha to prison.

An irrevocable trust is usually secret and only known to the owner and deed holders/offshore bankers. It's very hard to access the money without the owner's cooperation. For example Jeffrey Epstein moved his money to a trust in his brother's name before he died so it can be difficult for the people suing him to get much

So in order not to lose everything they had to go into that agreement so the money can come out. That act alone released hundreds of millions to the FG and led to Mohd's release and Bagudu signing off the monies. The usual thing to do now is charge him with new corruption charges and seize the money

Kindly follow that link. It was a plea bargain. Under it, he was supposed to continue his trial in Nigeria after he was repatriated back in 2009. That's why Jonathan's govt tried to start the case in 2012. So, the question now is why Malami the Kebbi state charge and bail lawyer is trying to cover up his brother with a 2003 agreement.

The argument here would be that it won't be in the interest of the common man in Nigeria that is ravaged by poverty illiteracy and disease to be so shafted by their elites. Another argument would be that the point needs to be made to aspiring looters that crime doesn't pay. The government should look at trail of the cash, over-invoicing, direct fraudulent transfers, illicit cash movements, etc may be uncovered. This could help the case. Even if it fails, the government may have convinced its citizens it has tried its best to fight their corner..

Even if the FG is 2 challenge the court, shows how foolish we are, because dis is a court of another nation wit no history of corruption, mind you it is only a corrupt court dat can b challege, and moreover they re doing us a favor, because if nt they can shelve up the money themself.

Thought you said it's not a plea bargain. The Buhari govt is standing by that settlement to say it can't enter a case against a sitting governor who has gone to court to claim a part of money being repatriated as Abacha loot. If Trump calls Buhari lifeless and Nigeria a shithole now, zombies will start crying. By suing Nigeria to court, as Bagudu himself not committed treason and broken the terms of the settelement?

Buhari’s administration reached a new agreement with him in October 2018, according to the court filings. They missed the part where their PDP uncles shielded Bagudu with the settlement and OBJ AMNESTY, tied our hands and set the trap against Nigeria.

With that settlement engineered by OBJ, Bagudu is free and can walk into any court and continuously win against Nigeria.

This is one of the sad many legacies of the PDP and institutionalized corruption.

When I won’t blame Buhari entirely rather, Buhari played Bagudu. Buhari knows if the money is signed to be released to FG, America will oblige and once that happens, Bagudu will file a lawsuit against FG for the transfer of the money to him basing his arguments on the 2003 agreement reached with OBJ administration. So to avoid all that, FG told America that the money should released directly to Bagudu (knowing fully well that America won’t accept that), the result is what we are seeing now which is good for the country. Otherwise, what stops FG from getting the money directly and then transfer same to Bagudu, of course after some egunje must have exchanged hands?
