Any state has the right to ban Nomadic cattle rearing. It's a dirty, crude, unhygenic and conflict-fostering way of animal farming. It should be banned nationally.

The movement of property and belongings by persons must be categorized under shipment and haulage. You transport belongings from one location to another for commercial gains. The fulanis are in this case suppliers to a market. Therefore these movements have commercial values. The choice to transport these cattles by foot instead of over the road trucking or rail is the individual supplier choice. Whether transported over road, rail or by foot, the goods will arrive in the market. By making the choice to transport by foot does not in anyway absolve the suppliers of responsibilities towards the states and domains and territories through whih their cargoes are transported.

There is no restriction of movement by any state.....but there is protection of state's rights. The state and its citizens have rights of domain first and above the right granted to shipment and haulage of market goods.

You would not expect trailer drivers to run their vehicles through farmsteads because the road has potholes and is not good for their tires or to drive through cornfields because it cuts the distance in half and saves them on gas....or would you? There is a standard rule for operating shipment and haulage and while it may have been ambigous in the past in its application to herding cows rather than trucking cows.......it is now time to study it for review and clarity and to impose new standards that protect the rights of states and their citizens above that of shipping, hauling and herding of market goods.

I support this move by Ogun.

I can most definitely cite the constitution as a basis of defense especially when there is no ambiguity in the cited provision. The dismisal of the same as inadequate to address ancient customs of the herdsmen, as you put it, is also in order. You should know that the constitution is under review as we speak to address some of these issues.

Ogun state cannot impose laws or rules which are unconstitutional, willy nilly.

The constittional review is not on account of fulani. The constitution speaks for all, not fulani. Fulani is a subset of "all". Therefore what is applicable to Obi, an igbo trader in Kano is applicable to Hassan, a fulani herder in Ogun.

In as much as the commercial interest and way of life of Obi in Kano is not violated by a state that says he cannot sell beer in the state serves to protect the traditions and interest of Kano, whatever those interrsts may be.....and the provisions of the constitution are not violated, then it is legitimately applicable to this position where Ogun state has said the traditions and interests of its domain are not in harmony with the transport of goods by fulani and by extension it posesses the sole right to bring about a harmony and order on its land in the best way possible.

What Ogun has done and what Kano has done are rights which the Federal Constitution reserves to the states, so far it does not counter any Federal law to the contrary.

It's a welcome development because so many lives have been lost around d mentioned local govts in ogun and properties destroyed by fulani herdsmen simply because d farmers refuse d cows 2 graze on dia farmlands.Sometimes when they go on rampage they sexually molest women.It has happened before in imo,benue,ekiti and even ogun.So don't blame ogun govt 4 being proactive. I work in d university of agric,abeokuta and d cattles in d school are kept in a ranch.Thats how it should be.

What the state government should do is to DISARM Fulani herdsmen. If they like they should continue nomadic herding after that. Let me see how they will enter peoples' farms and r,ape women along their herding routes.

What Ogun state should have done is to make sure that any Fulani caught with even a dagger is sentenced to harsh imprisonment.
It is illegal in Nigeria to carry arms about.

The herdsmen are doing there legitimate business but the point is there should be laws to regulate their activities so as to prevent unecessary clashes with farmers who are also doing a legitimate business. Recently Ghana started enforcing laws to regulate business activities of fellow West Africans especially Nigerians. This led to the closure of some shops despite the fact that there is supposed to be a non restriction of movement and business activities among member states within the sub region. What is your take on this? There is a difference between "restriction of movement" and "promulgating laws to regulate business". In case you have forgotten the government is empowered by the constitution to make the environment condusive for business to succeed and one of such ways is the promulgation of laws. . Mr ndu chuks; have you heard of the legal saying.."where one man's right ends,another man's right begins". You see my friend the same section of the constitution you quoted also limits the right it gives you(I suggest you read the accompanying sub section of sec41). If you must know, no right is absolute in the constitution,almost all the rights in chapter IV of the 1999 constitution are qualified in public interest and peace. So I don't see anything wrong in what the ogun state govt has done. they've simply done it to preserve public safety,peace and order.

This is a bold step in the right direction. Let me state here first that i do not have anything against the herdsmen. Having said that, during my undergraduate years in the Federal University of Technology, Minna. I have seen uncountable number of times the herdsmen cross inside the Bosso campus with their cows in large numbers. The northern lecturers and the undergraduates seem comfortable with the practice. It does not make any difference to them. This tells you the level of understading of the herdsmen and an average northerner when it comes to law. Its their culture and that is what matters to them. So when they gain access into the south, they will not be able to differentiate and know where to and where not to graze. Laws don't mean anything to them as that is how laws are disregarded from where they come. And so, no state in the south will find that attractive. Hence this bold step taken by the Ogun people. It should be made permanent as lwas and rules mean rubbish when it comes to the herdsmen and their cows.. In the south, we respect the law, know the law and choose which to disobey. Thumbs up to the Ogun people.

what is going on in Ogun State, is Jang in Ogun State that farmers and fulani herdsmen are fighting. where are those accussing Jang in plateau state, who is now cauisng problem in Ogun State.
that is why one have to think before he talk becos i feel for plateau State the way the crisis is handle and pointing figures at the governor as the cause of all that is going in the state. Is Ogun State govrnor doing the same as Jang. so let join hands together to bring peace than pointing figures.

You would also have to look into the constitutional definition. Livestock might not be permitted as goods. This is technical and if the constitution must be followed it has to be followed completely. I think you'd struggle to find a section in the constitution where livestock is accepted as goods. If I am wrong, then prove me so by uploading that section that pertains to goods.

Bros Dudu_Negro, you, of all people should know by now that joining unrelated issues as a way of muddling up the waters, never works against me. What Kano did was supported by specific constitutional provisions found under Sharia and until our constitution is amended, no court can reverse those actions by Kano.

There is no specific provision which enables Ogun to effectively restrict the freedom of movement of these herdsmen. This law or rule by Ogun will not stand the constitutional test in any court. As law abiding citizens we must respect the law and elect representatives who will modify the constitution to suit our interests.

We have rules against theft, destruction of people's properties, violent crimes, e.t.c why can't Ogun state enforce those laws first? If you find herdsmen who have committed crimes, arrest and prosecute them! This immature and senseless restriction of freedom of movement of innocent Nigerians must be resisted by all means necessary.

BTW hundreds of thousands of herdsmen enter and leave Ogun state yearly without issues, why punish them because of the actions of a handfull (possibly 0.000001%) of these nomads. For every unfortunate victim of a herdsman, you people have killed and maimed thousands of your own state residents. Why don't you put everyone under house arrest because you have armed robbers and other criminal in your state?

Dede1, we are not talking about revising Biafran history, an act filled with subjectivity, embellishment of truths, and attempts to prove that one won a war which was actually lost. What we are talking about is defending the constitution of the Great country Nigeria. How would you like your people who are migrating to Zaria to be told to leave all their tools of trade behind, if they want to be admitted into Zaria? This is not lawyering but common sense, which we all know, is not common with Abriba people. smiley
