Prettychild:Lol. Defence of provocation? I bet he'll explain to the court how and where he got the knife from. The time it will take him to search for a knife (which will most likely be in the kitchen) and come back to stab him will definitely ruin any chance of defence of provocation availing him. Moreover, defence of provocation is not exculpatory in nature, rather it will only ameliorate the sentence; for instance, from murder to manslaughter whereby the court can slam him 5years to life imprisonment |
