I know this is not the visiting visa thread, but I'm sure a lot of people here are experienced in that area hence why I'm asking this question here. so, my mum was granted a visit visa (6months) due to expire mid-September, she arrived the UK end of March and will be returning to Nigeria on the 1st of September (before her visa expires) although we stated in her application she will be returning in June. I have a new born and I'm aslo a student so I need all the help I can get, I want to submit an application for my mum-in-law this week such that she will be here immediately my mum lives to care for the children. However, I'm affraid the Eco will say my mum has not returned yet and I'm submitting another application and possibly deny the visa. Kindly advise. |

lightest: Oh ok good!, make sure you see your kids, make an arrangement to see them if she refuses to allow you see them then go to the council they will step-in to sort out a peaceful solution. Hopefully it will not get to that, you moving out may calm things down and both of you will have a rethink and sort things out Homeoffice will not separate you from your kids, before the visa expires write HomeOffice to explain your situation. They deal with it on case by case basis. Stay strong, you will be fine. 1 Like |

lightest:With kids involved, there may be a way. I am not sure if "right to family life" applies here but you can research that while we wait for the experienced ones like Lexusgs430. Meanwhile, what is you skillset? You can look for a Tier2 sponsored job as well. |

lightest: Do you need to proof maintenance funds for your visa renewal? if yes, make sure you have it set aside just in case you both reconcile before January next year. Was domestic violence or emotional abuse involved? I know women can have their drama but it takes a lot for a woman to get to the point where she throws the man out, especially when you both have kids together. I don't know your faith but have you considered involving your pastor or Imam to see if they can mediate and resolve the conflict between the both of you? How long have you been in the UK? You might be able to apply for discretionary leave to remain. 2 Likes |

It falls under FLR (HRO) outside the PBS rules which I mentioned earlier using Article 8 right to family life. I remember helping a friend with article 2 and 8 back then .. Best to also involve a solicitor if there's a need to dustydee: |

Deportation might not be an issue but he can become an overstayer if he is not careful. Not sure discretionary leave would be granted for a child that's not British or has spent more than 7 years in this country. justwise: |

Lexusgs430: Again as long as he is not a danger to the wife, those kids or the country..his chances of remaining in this country remains high.. He should be actively involved in those kids life, avoid any violent and go through the legal process. 1 Like |

dupyshoo: If your case is with HomeOffice you are considered a legal resident until your case is decided and you are asked to leave the country. I don't think he will allow his visa to expire carelessly without exploring other legal means. 1 Like |

Lexusgs430: working on that bro. And for the record I am not the cause of the issue. I think she has being planning this since. she has refuse to put my name on the rent and refuse me to be paying any bills on our names. all I do is to send money to her acc despite me telling her that I have read it here that if we need to renew our visa we need to let the 2 names reflect on the bills I believe she might have friends that are teaching her. But which ever way, I am prepare to use immigration lawyer to help me look into my odds and favours. |
