Claims that “potentially thousands" of Arizona voters were disenfranchised dissolved during a six-hour court hearing on Thursday, as a lawyer representing the president’s reelection team dialed back allegations of “systematic, improper” vote overrides. Donald Trump's campaign, along with the Republican National Committee and the Arizona Republican Party, had filed a lawsuit on Saturday alleging Maricopa County poll workers routinely disregarded procedures designed to give voters a chance to correct ballot mistakes on Election Day. But within minutes of the start of proceedings on Thursday morning, attorney Kory Langhofer insisted the plaintiffs were "not alleging fraud" or "that anyone is stealing the election" — simply raising concerns about a "limited number of cases" involving "good faith errors." That was perhaps a prescient shift, given that testimony from several witnesses failed to bear out anything more. And before Langhofer even made his opening statement, a controversy emerged over some of the declarations from supposedly misled voters that were submitted as evidence. Attorneys representing Arizona Secretary of State Katie Hobbs, one of the election officials who was sued, moved to have declarations collected online tossed out, arguing they lacked “any guarantee of trustworthiness.” Langhofer acknowledged some of the online declarations were found to be false but noted those entries had been removed, saying his team had cross-referenced the remaining declarations to ensure voters were where they said they were on Election Day. Judge Daniel Kiley was unconvinced, ultimately granting the motion to exclude the declarations collected online. “The fact that your process for obtaining these affidavits yielded affidavits that you yourself found to be false does not support a finding that this process generates reliable evidence,” Kiley said. “This is concerning.” Testimony doesn't support broad claims Things continued south from there for the plaintiffs. The Trump team's original complaint had focused on poll workers overriding potentially "overvoted" ballots instead of allowing voters to make that choice. Overvotes happen when voters mark more options than allowed in a particular race. Because stray markings and other irregularities can cause Maricopa County tabulation machines to perceive an overvote, the tabulators are programmed to alert voters when that happens. A voter then has two choices: “Spoil” the ballot and request a replacement, or cast the original ballot with the warning that overvotes may not be counted. The initial complaint contended voters who chose to proceed with their original ballots were entitled to a manual inspection to ensure all legitimate votes were counted by the machines, but claimed elections officials systematically disregarded that step. And some witnesses brought forward by Langhofer indeed testified that poll workers had pushed through their ballots without an explanation after the machine initially recognized an error. The remaining allegations seemed to fall apart under questioning, however. None of the witnesses indicated they had overvoted any race, or that they had any real reason to believe their votes weren't counted — except for learning after the fact that poll workers shouldn't have pressed buttons for them. Gina Swoboda, the Arizona Election Day Operations director for the Trump campaign, said she received reports on Election Day of ballots "taking two or three chances to go through." "I believe that this is a justified action, that there were concerns expressed to us by the voters, by the observers," she said. But she noted she "would not say that, in general, the poll workers across the county had consistent, regular problems in the administration of the election." Attorney: Case is 'narrow claim about a good-faith failure' The plaintiffs originally had asked election officials to go back and identify ballots with overvotes cast in partisan races in Maricopa County on Election Day, manually inspect those ballots and discard votes only in cases when “it is impossible to positively determine the voter’s choice.” In his closing statement, Langhofer narrowed that ask significantly, saying plaintiffs sought only a reinspection of overvoted ballots in cases where the number of overvotes was greater than the margin of the winning candidate's victory. It's unclear which, if any, down-ballot races this request would affect. County officials have identified 191 overvotes in the most high-profile race, for president, where thousands of votes separate the candidates. And there are only about 950 Maricopa County ballots cast in person on Election Day with overvotes affecting partisan races in general. Langhofer himself noted there weren't "a tremendous number of votes" at stake, calling the suit a "narrow claim about a good-faith failure." That represented a marked shift from his prehearing brief, in which he claimed the "haphazard differential treatment of similarly situated ballots cast within the same geographic jurisdiction in the same election encapsulates precisely the discriminatory disenfranchisement the Equal Privileges & Immunities Clause proscribes." The judge seemed amenable to considering the request, saying he would take it under advisement, but attorneys for the defendants argued there was nothing in state law authorizing such an action. An attorney for the county said the ballots in question already were tabulated, and "counting ballots that have already been counted is a recount." Arizona does not allow recount requests and has strict criteria for automatic recounts. In races where more than 25,000 votes were cast, the margin has to be less than or equal to 200 votes or 0.1% of votes cast for the top two vote-getters, whichever is smaller. The judge did not indicate when he would rule, saying only that he was "aware of the time constraints and the urgency of the matter." Minutes later, the Arizona Republican Party announced it had filed a new lawsuit in Maricopa County Superior Court seeking to force a hand count of votes separated by precinct instead of counting them by voting center. Arizona sided with former Vice President Joe Biden by a 0.3 percentage point margin, with Biden besting President Trump 49.4% to 49.1%, respectively. It was the first time the historically red state had voted blue since former president Bill Clinton's win in 1996. Although votes are still being counted, as of Monday evening Biden still had a 14,746-vote lead. The call for Arizona was one many said handed President-elect Biden the win -- though Trump has refused to concede his position. The lawsuit was filed Saturday in partnership with the Arizona Republican Party and Republican National Committee. In a Tuesday motion, attorney Kory Langhofer said the Trump campaign planned to submit evidence including the feed from inside a polling place. Alternatively, Maricopa County attorney Thomas Liddy said that the Maricopa County Board of Supervisors, Democratic Secretary of State Katie Hobbs, and Democratic County Recorder Adrian Fontes had no quarrel with redacting information protected under state law. The simple reason is that even though over 60 million voted for Trump, that doesn't mean they didn't believe Biden won now that the result is out. Reasons like this are the reasons why this cases are being thrown out in court. I am a programmer and i know this things happen in a system. This is what we call exceptions in a system and they are never in large quantity. This is why we would always have a job just so we can make the system better Whatever my explaination is, you won't believe cause you probably would not go deep like courts would do to know the real story of this lawsuits. Adakintroy:The case of dead person voting have actually been debunked. It's kind of a long story. It was a case of clerical mistake causing record of someone dead in 1984 showing when a search was made for someone of same name which turns out to be the dead person's son. The thing is, verification on ID and signature is done on each person's ballot for it to be valid. So in this situation, the person's ballot would have counted anyways. Few mistakes like this are expected i an election of over 150 million people. I am a programmer and i know oversights like this happen in any system. It shouldn't just be much. Things like this are common though. It's not just about this election. Trump will get his day in court. Whichever the decision. It's no big deal. Fact is my mayor/state election has more effect on me than presidency. Issue is, Trump and You won't still accept if court decision didn't go your way (which is really the point of the lawsuit, to massage Trump's ego...lol. and to make it look like he didn't loss) |

Trump cannot force US Supreme Court to take a case that it does not have Jurisdiction for. Only very very few of this case would even smell the Supreme court. FYI, election lawsuits are common. They just don't result to anything serious. Omny reason why there is shouts about this is because Trump shouted about it. There was lawsuits in last elections too. They just never amount to anything. Election fraud lawsuits in the US for the last 5 US elections have only confirm 12 cases of fraud. Yes 12. 2016 election confirmed 5 cases out of 130 million vote. I live in the US and i know the process for the election and i can tell you it is very difficult to do mago mago. There is technology to confirm integrity of each ballot. For counting they are always observers from each party and camera to capture every count. Commiting election fraud in the US is a felony so no one would go scot free. When you do your research and see the process you would understand why we only have 12 cases in the last 5 elections. Now you are talking about Trump being a rich man so he would fight well in court. Pennsylvania Multiple legal battles over the Keystone State’s election laws were underway well before Election Day, but this week, the Trump campaign upped the ante. Pennsylvania Attorney General Josh Shapiro said in an interview that “there has been a lot of noise about litigation” but it has had “zero material impact” on the electoral process. “The count has continued. Legal votes are being tallied and soon the commonwealth will respect the will of the people and certify a vote,” he said. Since Tuesday, the campaign has filed at least five separate lawsuits, with mixed results: 1. To compel Philadelphia election officials to stop counting ballots. A federal judge dismissed the request. 2. To compel state election officials to allow Trump campaign officials closer observation of the counting process. A state judge ruled in the campaign’s favor, allowing campaign officials to observe the Philadelphia process from a six foot distance. Philadelphia election officials appealed the decision to the state Supreme Court, and the outcome of that appeal is pending. Levitt says this ruling will likely affect the pace of the count, rather the outcome. “Imagine a gymnasium, with observers lining the walls: to let the observers get closer, they’ve got to move the count closer to the walls and not be counting in the center,” he writes. Since people can no longer count in the center of the gym, “the count is going to move more slowly.” 3. To compel Pennsylvania Secretary of State Kathy Boockvar and all 67 counties to impose an earlier date for voters to show proof of identification if it was not on their initial ballots. Litigation is ongoing. The presiding judge ordered all counties to segregate ballots if the voters do not provide supplemental identification by Nov. 9. The ballots with supplemental identification provided after Nov. 9 cannot be counted until approved by the court. Local Republicans filed a separate suit against Boockvar in state court, alleging she subverted state law when she issued guidance telling voters with deficiencies on their mail-in ballots to cast provisional ballots, and trying to prevent those provisional ballots from being counted. A state judge denied that request, but ordered officials to segregate provisional ballots from voters who submitted deficient mail-in ballots before election day. 4. To compel the Montgomery County Board of Elections to stop counting mail-in-ballots The campaign and Republican National Committee filed suit to halt the process of counting mail-in ballots in Montgomery County, one of the counties in suburban Philadelphia, alleging that the board of elections was counting 600 ballots that had not been placed in secrecy envelopes and was therefore not complying with requirements. Pennsylvania election data shows Montgomery county overwhelmingly voted for Biden. The litigation is ongoing. 5. To intervene in an already existing dispute before the U.S. Supreme Court about whether ballots the state received after 8 p.m. on Election Day should count. The litigation is ongoing. Some legal experts are skeptical SCOTUS will take the case, while others say that even if the Justice do, their ruling is unlikely to change the outcome of the Presidential election. “I think that the court is going to be very hesitant to involve itself in the process in the most politically contentious context possible,” says Michael Dimino, an election law expert at Widener University in Pennsylvania. Joshua Geltzer, executive director of the Institute for Constitutional Advocacy and Protection at Georgetown Law, notes that the number of ballots that may fall in this category “appears increasingly irrelevant to the election outcome given the sheer vote numbers in that state regardless of those ballots.” The backstory: After Pennsylvania’s Supreme Court extended the ballot receipt deadline to Nov. 6, state Republicans twice appealed the case to the U.S. Supreme Court. The first time they were unsuccessful, and the second time the court declined to expedite the decision before the election, but left open the possibility of hearing it afterwards. On Friday, Supreme Court Justice Alito, in response to a motion from Pennsylvania Republicans, ordered state election officials to segregate any ballots that arrived after election day. State officials had already ordered counties to segregate any ballots that arrived after Election Day, likely anticipating a future challenge. Nevada With Trump narrowly trailing Biden in the state, the Trump campaign has backed two cases to impact the counting of ballots: 1. To impose an injunction on the automated signature-verification machines used in Clark County as ballots continue to be counted. A federal judge rejected the request on Nov. 6, ruling that federal judges should not be involved in state election administration and there is no evidence Clark County is doing anything unlawful. The backstory: The Trump campaign held a press conference on Nov. 5 introducing Jill Stokey, a Nevada voter who claimed that when she tried to cast a ballot, she was told someone had already cast a mail-in ballot in her name. She alleged that the signature verification technology used in Clark County, the most populous county in the state, enabled someone to cast a mail-in ballot in her name. Her lawsuit asserted, without evidence, that “lax procedures for authenticating mail ballots” had resulted in “over 3,000 instances of ineligible individuals casting ballots.” Aaron Ford, Nevada’s Attorney General, called Stokey’s allegations “absurd.” “While the Attorney General’s Office normally does not comment on pending litigation, I feel compelled to dispel the misinformation being circulated to undermine the public’s trust in our election,” he said in a statement. 2. To compel state election officials to allow the public closer observation at a Clark County ballot-counting facility. The Trump campaign, Republican National Committee, and a plaintiff, Fred Krause, filed a lawsuit before election day in state court seeking to halt the counting process in Clark County until they could observe the process A district judge rejected the lawsuit, ruling they lacked standing to bring the claims and had no evidence to back up their arguments. The plaintiffs appealed to the state Supreme Court, which accepted the request to expedite the case, but denied the request for immediate relief. In a November 5 order, the State Supreme Court said the campaign and state Republicans had reached a settlement. According to local news, the settlement included expanding observation access, so that all counting tables would be visible to the public. Michigan While the Associated Press called Michigan for Biden on Nov. 4, the Trump campaign and Republicans have continued to file lawsuits attempting, unsuccessfully, to stop the state ballot count. The state has seen two cases since Election Day: 1. To halt the counting of absentee ballots, on the grounds that campaign officials had not been given access to observe the process as required by state law. Michigan Court of Claims Judge Cynthia Stephens denied the campaign’s request on Nov. 6. 2. To halt the certification of election results in Detroit, Michigan’s largest city and a Democratic stronghold. Judge Timothy Kenny denied the motion for injunctive relief on Nov. 6, saying there was no evidence that oversight procedures had not been followed. “Chief Judge Kenny’s quick decision mirrors a decision yesterday by Court of Claims Judge Stephens – specifically, that, once again, the allegations are mere speculation,” Michigan Attorney General Dana Nessel’s Press Secretary Ryan Jarvi said in a statement. “The swift, clear and decisive opinion should put to rest the meritless claims that have been made in Michigan and other states around the country.” The backstory: The case was not brought by the Trump campaign, but by a conservative group, the Election Integrity Fund, and sought to stop election workers in Detroit from “curing” absentee ballots that could not initially be read by a machine, a normal part of the ballot counting process. The case alleged that the work had not always been overseen by election inspectors from both major political parties, and that certification should be delayed until inspectors could review the process. Georgia In Georgia, where the on-going count suggests an extremely tight race, the Trump campaign has filed one suit: 1. To disqualify about 53 ballots. A poll watcher in Chatham County reported seeing a stack of late ballots that may have arrived after the 7 p.m. Election Day deadline get mixed in with ballots that had arrived on time. A Superior Court judge in Chatham County rejected the suit on Nov. 5 after hearing testimony from county officials that the ballots had, in fact, arrived on time. “There is no evidence that the ballots referenced in the petition were received after 7:00 p.m. on Election Day,” the court found. Arizona: Fox News and the Associated Press have declared Biden won the state, but other networks have held off, deeming the race too close to call. On November 7, the Trump campaign and Republican National Committee filed a lawsuit in state court alleging voters’ ballots had been rejected because they contained “bleeds,” splotches” and “stray marks.” These allegations appear similar to claims circulating on social media that ballots would not be counted if voters filled them out using a Sharpie marker. Election officials have said these claims are false.
