Na this kind thing they make me collect three years rent. You see lawyers, I no fit rent my house to them. When ever I place my house on rent, I avoid renting to lawyers, those people are wicked set of people.

Now running to almost 3 years in the flat without paying rent and without leaving....

What stage in the case are you guys at ?

Firstly COVID & the JUSUN strike has not helped in anyway but the non appearance of the either the tenant or his attorney should not derail your case instead it should help you especially if they have been served with the originating processes.

Are you represented by a legal practitioner ? Speak to them about it a simple oral application should do the trick when the matter comes up for trial.

rent someone to stand as him and confess in court asking for 1 month to move out.... court will ask both parties to sign.... when the date comes and real idiot doesn't move out, court bailiff and police will bounce his arse

Firstly, I wish to congratulate you for not falling into your tenant's trap. He would have just claimed you destroyed something his livelihood depends on or you stole a 45 million His office gave to him. There is a due process under the law and I will explain it to you now.

Rent court is faster in these cases than magistrate as magistrate court handles all types of cases. So, go to your local govt office to asked for the location of the rent court and liase with any court clerk there. For rent court, I am not sure but I believe you don't need a lawyer to file your cade but to be sure, the clerk will out you through. If a lawyer is required, they can also give you a lawyer's contact.

If it is magistrate court, you will be needing a lawyer and the rest of the process is about the same.

For an owing tenant, you didn't even need to give a six months quit notice only the seven days notice. However, some states like in my Oyo state requires a one month quit notice before the seven days quit notice. Either way, you've more than compensated for it with the six months and then the seven days notices. Now you go to court. (Had to explain this much due to other readers).

Your lawyer or you (if rent court) files the case and a court notice is sent to the tenant. If he is seen, whether he accepts the notice or not, as long as the bailiff tells him and throws down the paper or gives it to him, it is as good as served and he has no excuse whatsoever as long as the bailiff lays eyes on him.

The process at court is

Mention, hearing, judgement.

The other parts could be skipped if he accepts to actually owing on the first day and sometimes the judge could just wrap everything up and deliver judgement right away saving everyone time. The judge would never say he must move instantly but will still give him time to move but the good thing is the judge will will acceed to your prayers.

Prayers in court terms means request. While discussing with your lawyer, list it all. It should include

That he leaves,
That he pays up all outstanding rent covering all the period he is owing till now (the 10 months)
That he pays all potential rent from now till when court asks him to leave (called mense profits)
That he pays for the court case (the son of a wonderful creature of God has to be taught a lesson)

Now the court might not grant the last one unless you prove you indeed had enough patience with him (in my case, the female judge said she didn't want to lay too much financial burden on her being a student. I've seen another judgement where it was approved). A statement from the resolution centre and/or copies of those quit notices will nail his coffin. The court will certainly ask him to move as well as pay all monies till he leaves.

It might take time but you will have your wish done. The lady I got a court judgement against packed out and even locked the door but we kept pasting all notices on her door. When she knew we did not break the door open and falling into her trap, she came back to open it herself after a week. The court processes still went on till judgement was made even in her absence.

What if he does not leave even after the judgement was said to his ears or posted on his door and he does not leave?

You still go back to court and the court gives you a registrar and police escort to evict him and also a garnishee order to his banh to have the money transferred to you. (Thank God for BVN). As long as he makes money in this Nigeria, you will have your money back. Just find his account details and he is toast.

There is a process and the law works.

Normally, after the defendant is not showing up and the bailiff shows evidence of summons delivery which is by doing one of the two above, the judge progresses the case to the next stage.

Your lawyer should have confirmed the bailiff delivered and mentioned it to the judge that the paper was delivered and as such the defendant had no reason not to show up but was ignoring the court and so the case should proceed to mentionor hearing. (appearance - mention - hearing - judgement. That is the court steps. I don't know which step you are at). If the judge does not hear this from the lawyer those words, the case na everlasting, and as such you keep paying appearance fees.

Hope in the court filing, your lawyer asked for mense profits which is rent from the time of the court filing till when the case is ended. The initial debt is 1 year and the 2 years more now is the mense profits. Hope also any outstanding utility like power and water bills is included in that lawyer's filing. If your lawyer added these and the above of calling the judge to the bailiff delivery, then the delay is simply court delay but if otherwise, you have an enemy within. Take note that a new lawyer can continue from where the old lawyer left off.

In addition Ohyinyeah, you may visit the court register and ask for informal advice. You could get a bit of it that could help you.

OP, this is one of the old newspaper single ladies that I was talking about.. Most of them lack manners and if you battle with them, some fools here will. say probably because you toasted her and she didn't agree and so you want to eject her, or she may claim domestic violence or sexual harassment or molestation...so, to avoid woman wahala, struck them out of your intending tenant's list...

I am sharing a decade-long experience I have gathered in the real estate business...

The olosho that just quoted me should come and try the rubbish in any of my houses...if she will not lose all her life savings...I have done it before and I can still do it again...

Easy man... Though some or should I say most of these tenants are terrible but we must always think about one thing....which is one day we all gonna leave all this properties and die one day embarassed

I would have suggested that you take the matter to Justice court but since the matter is already in a court, I don't know what else to say.

Also, you are entitled to collect rent from him even during this period of the case being in court. Irrespective of any quit notice given, you are still entitled to collecting your rent as long as he still occupies your building.

Since the matter dey court, you can no longer act aggressively, also
Removing the roof will destroy your ceiling boards or POP ( your property in general).

Now this us what u'll do (let me type fast Chelsea match want start).
Ensure the tenant is at home on this very day.
Go with a carpenter, a vigilante or police man as your escort and have a recording device at hand.
Start recording before starting this conversation with him.
Tell him you want to make renovations to the flat.
Keep recording while the carpenter removed the doors and windows entirely.
Let's see how he will live in an unsecured environment with his family.

It’s simple. As long as he owes you rent you don’t have to give him the 6 months notice rather 7 days notice of owners intention to recover premises thereafter you charge him to court.

Now this is the trick. In a Tenancy Recovery matter where the defendant tries to play smart and not come to court, all your lawyer has to do is apply for default/summary judgement as from all indications the tenants are not ready to appear for the matter. (25 days tops the tenant is out).

Where are you situated?

Same issue happened to my mum
The tenant stayed 5years,the second tenant was about doing the same ,after lawyer has collected money from us,we planned that we ve sold the house , brought someone who acted as the buyer, dropped sand and gravel , removed all the roof ,he was crying begging the man to give him one week,some tenants are wicked

This is the simplest of all suggestions so far.

At least, there is no law that says one should not sell their house. Also, no law says buyer should not take possession.

Get one clay pot, put dirty water inside. Tie it with red and white cloth, put head of chicken and lizard into it. Place it by his door. Repeat every week. He will leave in two weeks.

If you're actually in Lagos.... Tell ur lawyer to withdraw the case, then find us come, we go file a fresh motion on the matter. I promise you, whether the plaintiff get a counsel or not, you will get judgement with a vr short period of 2-3months highest.

Once we get the CTC, sheriff will throw him out immediately.

The normal procedure is you serve him 6 months notice, send a 3 month notice after 3 month, send a 21 days notice at the 21 days to the 6 months expiration, then send him a 7 days quick notice

He e defaults after this, get all your notice, go to a court and obtain a court order to eject him. Take the court order to the police to effect it


You are wrong. It Will end on court when stubborn tenant is involved . Police are not sent to effect eviction . Court has there own people called sherif. They wear uniform...they ve legal right to evict

And there is a law and a court in that town? Oga , I will break part of the ceiling, lock the door and report that my 7.6 million and some relevant documents got missing. Whoever removed the roof should come and explain or would the landlord also deny that he knows nothing about the roof? My brother, whoever sells this removing roof idea, wants to land you into a huge mess. A fellow like me would so press you until you sell that house to pay debts if you should go that way

You should have just given him quit notice of 6 months, and eject him forcefully using mopos or soldiers, after the 6 months.

Now that the case is in court, you have to be patient, else, you would be shooting yourself in the leg!
