Judiciary does not lead the prosecution of any crime or gather evidence for prosecution. The functionality of who gets prosecuted or not prosecuted lies in the corridor of ministry of justice which is an executive branch of the government not judiciary. If the ministry of justice decides to withdraw the charges or even withdraw the case, the courts have no business to oppose such endeavor.
